Arthur D. Gasbarro, Blackwell and Associates Inc. — Secdnd hearing for a new foundation located in the
buffer to a wetland and coastal bank. Asked for a waiver for an addition within the 50 -foot buffer. The
shed is out of the buffer and will be planting a buffer of native vegetation; believes that is a net benefit and
improvement to the site.

Emily MacKinnon, Nantucket Land Council — In the application there is a waiver for 2 -foot separation
from high groundwater but there are no details or information about that separation or temporary
dewatering. As far as the waiver for the addition within the 50 -foot buffer, the commission should be
careful about "horse- trading" the revegetation of an area for a permanent addition.

Erisman — Asked if the area where the shed is presently located would be lawn or vegetated.
Gasbarro — It will become part of the vegetated buffer; where the shed is going is presently a planting bed
and increases its distance from the buffer. They have done what they could to keep work outside the 50-
foot buffer. The scope of work is to jack up the house onto cribbing, excavate the foundation, and lower
the house. Don't have any information that suggests there is groundwater there.
Erisman — Concerned about the proximity of the silt fence from the wetland and construction vehicles
parking so close and rain runoff during construction.
Staff
Can condition the silt fence maintain a 15 -foot distance from the wetlands. Have everything needed to
close.

Mark Rits, Site Design Engineering — This is for an after -the -fact house relocation. Reviewed additional
information he was asked to provide: footprint, foundation, and groundwater. He did 5 shallow borings,
about 3.5 feet, and did reach groundwater at about 3 feet. He confirmed the foundation is a slab with frost
wall. The original house footprint had about 1100 square feet (SF) within the buffer; the proposed is
about 800 SF within the buffer. A chicken coop has been temporarily moved and will ultimately be
relocated outside the 50 -foot buffer.

Emily MacKinnon, Nantucket Land Council — Asked if there is a determination of the actual depth of
the foundation and what the actual separation from groundwater will be. Nantucket Land Counsel holds a
conservation restriction on an adjacent property. Referred to a letter of concerns from Bruce Perry, Third -
party Consultant Conservation Commission. Information about upland soils wasn't included in Mr.
Perry's report, and Nantucket Land Counsel would like more hydrology information.
Bruce Griffin, New England Environmental — The abutters he represents feel there is a lack of
delineation on the property. The 2 -foot separation relates to high groundwater as found in the spring,
according to the Performance Standards. He spoke to David M. Haines, Haines Hydrogeologic
Consulting, who told him when the wetlands were delineated and that it was not intended for this
property; he stopped at the property line though the wetlands do not stop at the property line.
Kendra Kinscherf, Davis, Malin & D'Agostine for Marsh Fader 36 Liberty Street — Shares the same
concerns about wetland delineations. Because of the fill and pervious patio, the project has changed the
flow of water. Asked that this project be conditioned to mitigate those impacts.
Discussion (4:34)
Rits — This is a standard 4 -foot foundation. Without getting equipment in there, it's hard to figure out
where the groundwater actually is. The deck doesn't impact groundwater; it's the house foundation, which
has been greatly reduced and is a 4 -foot frost wall all outside the 50 -foot buffer. Over the years, there has
been quite a lot of disturbance in this area. In 2003, the wetland was flagged almost entirely off this
property; it has pushed up since then.
Steinauer — Given the concerns, thinks it might behoove this project to remain open to confirm the
delineation of the wetland.
Cohen — Wants to ensure all testing is done before the next hearing so that this application does not go
through multiple continuations.
Rits — Requested a continuance to Dec. 16 to allow time for soil testing.

Mark Rits, Site Design Engineering — Would like to know if there are any other questions that need to be
addressed. This is for a 2nd- dwelling, pool, and pervious driveway. It hinges on the delineation discussed in
the previous project. The shed has been moved outside the 50 -foot buffer. The slab will be at elevation 24.5
with the water at about elevation 21. Any dewatering would be temporary and would request a Department
of Public Works permit to pump into Town stormwater runoff. He anticipates the bottom of the pool will
be at groundwater. Due to the tiny amount of wetlands on this property, it would not be possible to do
much in the way of invasive species removal; alternately proposing an increased the native vegetation
buffer. In terms of most of the site work, the driveway will be pervious shell so shouldn't impact run off.
Steven Cohen, Cohen & Cohen Law PC — Noted that the abutting property pumps water into the
wetlands.

Emily MacKinnon, Nantucket Land Council — In the original delineation letter, it mentions a pond on
Marsha Fader's property, which could be connected to ground water; it should be delineated to determine if
it is an additional resource area. It's important to get some sense of the groundwater in regards to the pool.
Bruce Griffin, New England Environmental — In 2013 he went onto Ms Faders property and assessed the
area next to the pond; he found hydric soils 14 feet from the edge of the pond and an obligate wetland
plant growing in that area.
Kendra Kinscherf, Davis, Mahn & D'Agostine for Marsh Fader 36 Liberty Street — Although there is a
waiver for the pool; there isn't a waiver for alteration of more than 50% within the buffer area nor has the
applicant proven no adverse impact and no reasonable alternative. A pool in this area has especially serious
impact on the resource areas. At this point the application is deficient in regards to the full extent of impact
on resource areas including the pond. The pond was dug in 1910; don't know if there is a connection to the
groundwater since it isn't a lined pond. Groundwater in this area is very high.

Discussion (4:58) Erisman — A shell driveway would become compacted by cars.
Rits — There will be some. In terms of flooding, there is a catch basin of dubious worth; there appears to
be no effort to channel flooding into that catch basin.
Erisman — Asked what is being done about roof run off.
Rits — Can put something under the driveway. Asked if the commission would be satisfied with an aerial
photo of the pond. Asked that his consultant have permission to go onto Ms Faders property to delineate
the pond.
Steinauer — The ground layer is a carpet of mustard garlic and Japanese knotweed; the applicant should get
permission for invasive species removal and maintenance.
Rits — Asked for a two -week continuance.
Staff Ms Fader would have to grant written permission for access to her property in order to assess the pond.

Representative Arthur D. Gasbarro, Blackwell and Associates Inc. — This is the 2nd hearing for maintenance of a timber
bulkhead and protection to the end of the structure. A change is to bring in short, sand -filled coir tubes
placed at an angle at the end of the structure and a single line of sand -drift fence in front of the tubes
running from the end of the bulkhead to the property line. He can keep up with annual reporting and
typical post storm event reporting.
Public Emily MacKinnon, Nantucket Land Council — Nantucket Land Council has a conservation restriction on
this property. Confirmed where the end of the new work will be. Would like a silt fence in place during
work.
Discussion (5:21) Steinauer — Would like monitoring of end scour to determine how well this holds up.
Erisman — Asked about the plantings.
Gasbarro — A single layer of cloth with beach grass plugs and temporary watering until the plants are
established.
Erisman — Would like monitoring of the amount of mid -Island sand that is washed into the harbor system.
Staff In cases of patch repair to structures, we have asked for storm reporting and annual report with a survey.
He doesn't think a quarterly survey would provide much information. Have everything needed to close.

possibility of an easement up and over; there isn't that would be safe and workable. Nourishment is already
an on -going condition above the bank and covering the existing stone revetment. Contends there aren't
many alternates; the owner feels there is an obligation to protect dwelling and maintain the existing
structure. The owner doesn't feel a softer structure is a viable alternative.

Discussion (5:29) Steinauer — Something that came up in the 'Sconset Beach Preservation Fund negotiations is maintenance
of a walkable beach; even though this is the extension of a grand- fathered structure, they should put sand
down to maintain the walkable beach. Wonders if that is part of the Chapter 91 license. Since it is eroding
out at the top and acting like a coastal bank, wonders if anchoring coir bags on top would be a viable
alternative.
Golding — He believes it is important for this board to protect public access and asked the commission to
consider a softer solution.
Gasbarro — He is trying not to expand the footprint by adding boards and avoid the maintenance of
deflating coir tubes.
Erisman — The commission needs to review the affect of nourishment on the environment. We also have
to acknowledge there is no beach and that is the reason for the wave velocity.
Discussion about the extension of the bulkhead as proposed versus the coir bag.
Gasbarro — Asked for a continuance to further discuss options with the owner.

Debbie Deeley Culbertson, 21 Easy Street — Stated that when replacing fence posts on her property, they
hit railroad ties. In 2002 she replaced her section of bulkhead; asked how the two will be connected
seamlessly. Asked how raising the top 18 inches will affect her property; the flood runoff would wash
around the bulkhead via her property.
Patty Roggeveen — Noted that the Chapter 91 license for Dreamland obligates them to take care of the
brick walkway.

shed and addition of a spa adjacent to the existing pool and 4 -foot retaining wall. The shed will go on the
leveled area on the side slope of a bank and outside the 50 -foot buffer. No waivers are required; this is a
buffer zone filing. A portion of the site is located within a state - mapped Massachusetts Endangered Species
Act (MESA) area. Made a filing with the natural Heritage and Endangered Species Program (NHESP) but
have not received a response from back. Laurentide Environmental, LLC is in agreement with the location
of the wetland line; they noted exterior lighting should be directed away from the wetland. The slope is
vegetated with perennial rye grass and some trees; it was a fill slope dev eloped with the original order of
consent. They will be developing a more detailed landscape plan to go along with the approval. Explained
the grade change around the spa and the shed. Asked for a 2 -week continuance.

a. Erisman — Asked what's going on at the 'Sconset Beach Preservation Fund; there are photos of machinery at the
high tide line. Staff — He had a report from the Environmental Police of a vehicle on the beach but he doesn't
know if it was machinery or a dune buggy.
b. Steinauer — Working with the Land Council and the Invasive Species Committee to bring Seth Wilkinson to the
Island for a training session on invasive specie removal techniques with minimal application of herbicides.
4. Administrator /Staff Reports
a. Explained that the cards he passed out indicate the commissioners are official members of Massachusetts Association of
Conservation Commissions.
