Present: Mickey Rowland, Jeanette Topham, Georgia Snell, Phil Hubbard, Maribeth Maloney, Karenlynn Williams, Penny Snow arrived at 3:40, and Brenda McDonough Absent: Guests: Matt MacEachern, Architect with Emeritus Development Call to Order: 3:35 p.m. Agenda: Mr. Rowland stated, by unanimous consent we are adopting the agenda. Note: The minutes were approved later in the meeting because Matt MacEachern presented his variance application for 21 Old South Road. Minutes: 3:52 p.m. Ms. Topham motioned to approve July 14, 2015 minutes, which Ms. Snell seconded, and all the remaining, present Commission members voted in favor of this motion. Topics: 3:35 p.m. New :Business: Variance Application for 21 Old South Road Matt MacEachern presented an application for variance from the 521 CMR, the Architectural Access Board's rules and regulations, for 21 Old south Road. This is new construction, so the whole building must comply with the 521 CMR. However, Mr. MacEachern is seeking a variance to install a limited use access elevator (LULA) instead of an elevator. Also, Mr. MacEachern is seeking a variance to install the LULA elevator whose cab measures 51 "x 51" instead of the required minimum dimensions of 36" x 60 ". 3:40 p.m. Penny Snow arrived. Mr. MacEachern explained that the LULA elevator will provide access to the four, Group I apartments on the second level. LULA elevators are usually smaller than a typical elevator that is required by the 521 CMR and is substantially less expensive. Mr. Rowland explained that LULA elevators have been installed in many public buildings around the island. Ms. Topham voted to support the variance request because the LULA elevator will provide access to the second level and people who are disabled will have full access to the whole building. Ms. Snell seconded this motion and all the present Commissioners voted to support this motion. 3:52 p.m. Mr. MacEachern left our meeting. Old Business: 3:52 p.m. • Mr. Rowland said that the Commission would table limiting the number of Commissioners to seven members, and that we will keep the range of Commissioners from five to nine members. • Ms. McDonough mentioned that she has not been successful dealing with the Hallkeen Management Company, who manages Academy Hill apartments, in having them install two automatic door openers on their exterior doors at Academy Hill. There is a new regional manager responsible for Academy Hill and Ms. McDonough will contact her and advocate strongly for these automatic door openers. If Ms. McDonough does not get the desired results, then she will contact the president of Hallkeen. Ms. Williams wondered if the weight of the exterior doors would create an unsafe situation in the event of an emergency and suggested that we get Libby Gibson involved. Mr. Rowland was wondering if the building department could be involved because the doors are so heavy. The Commission members believe that we need pressure from the town to get the attention of Hallkeen Management. Other Business: 4 :05 p.m. Ms. Maloney spoke to a Stop &Shop representative about the two "car pool" parking spaces in the parking lot. She was told that they were installed for multiple families to drive together in one vehicle. Ms. McDonough mentioned that she e- mailed Dave Monast, Manager of the Stop &Shop, and requested additional accessible parking spaces from Memorial Day through Labor Day. She also suggested replacing the two "car pool" spaces with two more accessible spaces. Ms. Maloney mentioned that there was a vehicle parked in the accessible parking space at the White Elephant with an expired disable parking permit. She called the police and is not sure what happened, but as she was leaving she noticed that the vehicle was gone. Mr. Rowland mentioned when he was visiting the brewery he noticed that an unauthorized vehicle was illegally parked in the accessible space and he called the police. Ms. McDonough said that she would continue to e -mail Chief Pittman and keep requesting that his officers patrol all the parking lots including the brewery. Ms. Topham reported that she received a complaint about vehicles parking on the sidewalk on Liberty Street therefore blocking access to the accessible entrance to the Methodist Church. She also informed the Commission that the airport plans to install a van accessible space. Executive Session: 4:2.5 p.m. Ms. Snell motioned to go into Executive Session to discuss the parking permit applications, and not to return to the Open Meeting once the Executive Session is adjourned, which Ms. Topham seconded, and Mr. Rowland, Ms. Topham, Ms. Snell, Ms. Maloney, Ms. Williams, Ms. Snow and Mr. Hubbard voted in favor of this motion.
