Land Bank Newsletter - Discussion ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of September 8, 2015 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:00 p.m. PRESENT: Gardner, Glidden, Paterson, Reinhard, Stackpole. STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Assistant Director; Susan Campese, Administrator /Finance Manager. The Inquirer and Mirror reporter, Lindsay Pykosz; Nantucket Pond Coalition member Robert Williams; and David Fredericks were also present at call to order. A. CITIZEN BUSINESS /ANNOUNCEMENTS: 1. Sustainable Nantucket /Powers Field — Request for Utility Easement: Mr. Savetsky presented a request from Sustainable Nantucket (SN) to grant an electrical easement along the property line of the Powers field and the Community Garden which will allow the relocation and replacement of the existing line and provide permanent power to SN's garden plots. Upon a motion made and duly seconded, it was unanimously VOTED to execute the easement document. 2. Miacomet Pond — Request to Include Phragmites Removal in CPC Proposal: Mr. Williams requested permission to include the Reis property on Miacomet Pond in the Pond Coalition's CPC application for Phragmites removal. He explained that Rachael Freeman reviewed and supported the proposal as it called for removal of small patches which are much easier to tackle now prior to becoming more established. Further, Mr. Williams asked the Land Bank to fund the removal and cost associated with the Notice of Intent (NOI) if the Conservation Committee required an additional application. Upon a motion made and duly seconded, it was unanimously VOTED to approve the request to include the Reis property in the CPC application and additionally, to pay for the removal work and cost of the NOI if necessary. Mr. Williams departed the meeting at 4.-15 p. m. 3. Non - Binding Ballot Question — Discussion: Mr. Fredericks explained that many concerned residents have approached him about the Land Bank investing significant money in a new clubhouse at Miacomet Golf. He suggested putting a non - binding ballot question on the April ballot, which would invite a larger debate about whether such a fundamental shift by the Land Bank (from acquisition of new properties to capital improvements of existing properties) was supported by the community. The Commissioners thanked Mr. Fredericks for his thoughts and said they would take it under advisement. Mr. Fredericks and Ms. Pykosz departed the meeting at 4: 22 p.m. Land Bank Commission September 8, 2015 Page 2 B. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED to go into executive session in order to discuss the purchase, exchange, lease or value of real property and review and approve executive session minutes. Each member was polled individually. All members voted yes. The Chairman declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene in regular session following executive session. RETURN TO OPEN SESSION Ms. Pykosz entered the meeting at 4:56 p.m. C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously VOTED to accept, approve and release the regular session minutes of August 25, 2015 and the Miacomet Golf Annual Membership Meeting of August 31, 2015, as written. D. PROPERTY MANAGEMENT: 1. Drone Policy Discussion: Mr. Savetsky explained that he received a letter from Tharon Dunn describing an incident where a drone flew over her property, thereby disturbing her privacy. The drone was being used for commercial purposes to photograph real estate and had been launched from Land Bank property. Mr. Savetsky stated that the use of Land Bank property for a commercial venture was a concern and suggested the Commission consider adopting the Nantucket Conservation Foundation's policy on the issue. It was further noted that national parks did not allow drones. The consensus of the Commission was to review policies of other organizations, although it was difficult to envision an effective enforcement mechanism. Commissioner Gardner additionally pointed out that there had only been one complaint to date. 2. Sconset Golf Update: Ms. Bell reported on observing maintenance issues in and around the clubhouse, noting the abundance of weeds, flowers needing dead heading, and bathrooms needing toilet paper and a good cleaning. She had voiced these concerns to management directly who responded that they had not budgeted anything for cleaning and gardening this year. Upon a motion made and duly seconded, it was unanimously VOTED to have the Golf Capital Committee review the issue and report back with a recommendation. 3. Barrett - Zissi /30A & 30B Washington Street — Use Request: Ms. Bell presented a request from a movie production company that was currently filming a feature film on the island to set up an 8'x8' tent and a 6' table for craft service for their crew on Friday, September 11, 2015. After a brief discussion, the Commission determined to deny the request based on the view that it was not an appropriate use of Land Bank property. 4. Carter /27 Quaise Road — Garage Addition Update: Mr. Savetsky explained that Mr. Jelleme had received Historic District Commission approval for the garage addition on the Carter property, however his building application has been held up by zoning issues which required relief from the Zoning Board of Appeals, which was an application that Mr. Savetsky would need to sign as a representative of the Land Bank as owner of the property. Upon a motion made and duly Land Bank Commission September 8, 2015 Page 3 seconded, it was unanimously VOTED to approve the request with Commissioners Glidden and Paterson recused. E. TRANSFER BUSINESS: 1. August 2015 Transfers — Record Nos. 36530 through 3630: The Commission reviewed transfers for the period of August 1, 2015 through August 31, 2015. a. Current "M" Exemptions and Liens: The Commission authorized the placing of a lien against each of the following properties as a result of the purchasers claiming the "M" exemption as first -time buyers of real property: No. 36542 Isaiah Stover and John Stover No. 36563 Olga Vasko and Alexandr Zhabrovets F. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar years 2014 and 2015 through August 2015 were presented. 2. Warrant Authorization — Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to execute the September 8, 2015 warrant document in the amount of $113,642.72 to be provided to the county treasurer. G. REGULAR BUSINESS: 1. Miacomet Golf Clubhouse Committee — Update of RFQ Review for Designer Services: Chairman Reinhard explained that three members of the committee had met to review and rate the submissions, and summarized each applicant's strengths and weaknesses. Based on their ratings, the committee recommended that the Commission interview the top two applicants: (1) Brown Linquist Fenuccio and Raber Architects, Inc. and (2) Coastal Engineering Company, Inc. /Chip Webster Architect. Upon a motion made and duly seconded, it was unanimously VOTED to accept the recommendation of the committee and set up interviews with the Commission. 2. Former Commissioner Appreciation Event: Ms. Bell explained that Assistant Administrator, Marian Wilson, was working with Dorothy Bartlett and Miacomet Golf to organize a cocktail party to honor Philip Bartlett for the 30 plus years of service to the Land Bank. Ms. Bell suggested October 1St as the tentative date which seemed to work best for everyone. 3. Land Bank Newsletter — Discussion: Commissioner Paterson suggested that the Land Bank put out a quarterly newsletter highlighting the accomplishments of the Land Bank and updating the public on the progress of ongoing projects. The Commission was in favor of the idea and directed Ms. Campese to research different options of distribution and publication and report back with details and pricing at a future meeting.
