Gasbarro, Blackwell and Associates Inc. — This is the second hearing for sand drift fence Page 1 of 8 Reviewed changes made to the plan based upon comments in the first hearing and awaiting comments from Massachusetts Natural Heritage on the revise plan. Will be removing the nourishment component. Massachusetts Natural Heritage was concerned about machinery access to the beach for the nourishment. Sand drift fence posts will be shorter; materials carried to the beach; changed the materials to green oak; and installation of the posts will be with a 2 -man auger running off an hydraulic generator. Public None Discussion (4:14) Lafarge — At the low end, there appears to be a gully; it was stated the other two would be filled. Asked if Staff this would be filled. Gasbarro — No, we will match this plan; that gully is outside the scope of work. Oktay — Asked if any changes to the bank occurred in the last couple of storms that will change the volume of sand for this. Gasbarro — Explained that sand is already being delivered for the nourishment for geo -tube project and that is changing his volume. One day it is a convex bank and the next it is concave. An appropriate condition of this order would be to report the volumes of sand delivered. Lafarge — Asked if the reporting on the geo -tube volume would be made a condition to this. Discussion about when the planting will take place and not be affected by storms; planting to take place in about March /April timeframe. This was left open for comments from the public on plans submitted at the table; have received none. It is hard to condition one project based upon another. Have everything needed to close. Representative David M. Haines, Haines Hydrogeologic Consulting — This is a continuation for additional information. Submitted a revised plan and letter detailing the work. Owner has cleared down to the 25 foot and little closer in one location; that is shown on the plan. Also revised it based upon Laurentide comments to install a culvert at the ditch. In regards to concerns about trucks being able to traversing the driveway, widened it to 12 feet and 14 feet at the curve; this still maintains the 25 -foot setback. Explained how the area will be protected from machinery to allow plants to grow back; have requested a waiver to do that based upon no reasonable alternative. The area is not in an endangered species habitat; that has been researched. The plan shows test pits to determine the highest level of groundwater. Haines — Shrubs; explained how the mats would be laid and that the plants will grow back. The work was done all be hand and the roots are still viable. They will monitor for two years. Steinauer — There was a concern expressed about blocking the view. Haines — There is a swale in which the wetland sits, so it is not visible from the road. Steinauer — Asked if anyone has checked to see if there is a vernal pool within the wetland. Swain — Client is concerned about the scale of the project; a truck trying to get a 36X72 foot house with a 12 -foot overhang on each side down that driveway and swinging that corner will risk further encroachment within the 24 -foot buffer. He would like to see an engineering report that the house movers are capable of making that turn and stay within the 5 -foot waiver. Haines — He spoke to a person at Toscanna who would be in charge of the move; he was assured that the truck and house can make that turn with the present configuration. MacKinnon — Looking at aerials, she too was wondering about a vernal pool. It has a lot of the characteristics that define a vernal pool, which would extend protection; even if it isn't a certified vernal Page 2of8 Staff Minutes for February 18, 2015, adopted Mar. 4 pool, the state requires it to be protected as if it were. Suggested another survey in the spring. The vernal pool buffer zones are based upon its highest level of water. Haines — He looked at the property in April last year and it was dry at that time; it is wet this winter. Do not propose to do any work in the wetland area. They would like to be able to move the house in April. Reviewed certified vernal pools in the area. Steinauer — Asked for staff clarification situations such as this. Haines — Explained that the standing water present this winter is contained within the edges of the wetlands and reiterated that it was dry last spring. Oktay — Would like to verify whether or not there is a vernal pool. Steinauer — If it is a vernal pool, it looks like the house won't fit in there. Haines — Pointed out that Massachusetts Natural Heritage has identified vernal pools in the area and in their review of this site did not identify a vernal pool. This is a red -maple swamp. MacKinnon — If it is a vernal pool, it could be smaller and still meet the setback. Pointed out that identification could be made before April. The ditch is about only 20 feet long. The waiver is requested for disturbance to the vegetation for the road. Can condition it for a maximum disturbance to the buffer zone. Read the definition of a vernal pool under Section 1.02 of the Town Wetland Protection Regulations; read the definition for a vernal pool and areas of protection. There is no evidence that it isn't a vernal pool; nor is there evidence that it is. If there is a vernal pool, that would make this application fall under state regulations. Gasbarro, Blackwell and Associates Inc. — Need a file number and final signoff from Massachusetts Natural Heritage. This is for net benefit maintenance work in conjunction with and for Nantucket Islands Land Bank (NLIB) & Nantucket Conservation Foundation (NCF). Improvements have to do with repair to existing culverts on the property. Propose a small elevated walkway of 4X4 posts. It looks like the property was used in the 1800s for cranberry production and there is a hydraulic berm that would be removed and restored. There is an old filled culvert that would be replaced with a box culvert to establish an open, natural stream. Will provide post - construction photos and reporting for a year or two. Would like to mow the isolated upper field on a periodic basis; considering a temporary bridge to span the stream and allow access during time of mowing only. The property is gated so vehicles won't be able to access the area except for their own maintenance vehicles or vehicles to allow persons with disabilities access. Will be requesting a continuance. Rachel Freemen, Nantucket Islands Land Bank Karen Beattie, Nantucket Conservation Foundation — She took pictures of all the wetland crossings and will provide those to the commissioners. None Discussion (4:59) Steinauer — Noted a wetland where a vehicle got stuck. Gasbarro — That is other NCF property. There is an existing walking trail that would be maintained as a pedestrian path with parking off Almanac Pond Road. Oktay — Would like to see the area that will be mowed. Gasbarro — Included with the plan aerials that would clarify what areas would be mowed to keep it open for different plants and foraging material. Most work would be in house with few to no contractors. Steinauer — This property has had issues of tractors being driven into the wetlands. Gasbarro — There is an order of conditions from 2011 that allowed for the maintenance of historic roads. This will take it a step farther to keep pathways open. Oktay — Asked if sheep management would be rotational. There was an issue of leaving the sheep in one place. Beattie — Sheep grazing would be outside the 50 -foot buffer and rotational during the growing season. Using best management practices want to get rid of invasive plant population while the are small. Freeman — Explained that burning was left off this management plan due to feasibility issues. Discussion about the proposed management plan. Staff Suggested a field visit before the next meeting. Sounds like there's interest for more photos. Motion Continued to March 4 without objection. Renovation and maintenance work on an existing structure within the 25 -foot setback. The shed component has been removed. Waivers are required based upon no adverse impact /no reasonable alternative for groundwater separation for the garage foundation and work in the setback. Steinauer — The Invasive plant species committee met and discussed the Pond Coalition. The Coalition wants to change the pond to Miacomet Pond; that was never discussed. Staff — The Pond coalition has filed for two files for aquatic vegetation on Xhacomet Pond and phragmites control on Long Pond. Those will be on the next agenda. b. Oktay — There has been overzealous use of equipment on the beach for replenishment; the beach has been torn up with tractor treads by many trips from the toe of the bluff to the high -water mark. This is on the North Shore. She asked that pictures be sent to ConCom staff. Staff — He has not yet receive those pictures. Oktay — Appreciated the timely submission of the condition reports from Mr. Gasbarro on the projects along Eel Point Road. Staff — It looks like not all boards were removed from the toe of the structure at 87 Eel Point Road. Arthur D. Gasbarro, Blackwell and Associates Inc. — That was an issue with the wall that was illegally built. He doesn't know how to get that out with total destabilization of the bank. Staff — If it isn't fixed, an enforcement order can be issued. 4. Administrator/ Staff Reports a. Addressed Mr. Cohen's question in regards to scheduling the settlement in regards to the 'Sconset Beach Preservation Foundation: Sent to Town Counsel a draft summary of a discussion with the Selectman subcommittee. It is his intent to get everyone in a room together and will have that scheduled by the end of February. Oktay — Asked if the board might get a storm report even though there isn't an Notice of Intent. Staff — They are to report on initiation of repairs. Jamie Feeley is diligently keeping track of that. The superseded order is not active. The only active permit is the emergency certification. b. There is a new Conservation Commission webpage specific to applications with down - loadable forms. c. A recertification program for commercial fertilizer applicators is scheduled for March 17 at the Dreamland. It will be an all-day event focusing on the best management practices. d. This Saturday, February 21, the Fire Department is hosting and event to highlight the Natural Resources Shell Recycling Program.
