Annual "M" Exemption Amount—Adoption 2. 2015 Meeting Schedule ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of December 9, 2014 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:00 P.M. PRESENT: Bartlett, Gardner, Paterson, Reinhard, Stackpole. STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Assistant Director; Susan Campese, Administrator/Finance Manager; Marian Wilson, Assistant Administrator. A. CITIZEN BUSINESS/ANNOUNCEMENTS: Ms. Bell mentioned the letter that was previously emailed to the Commission from the middle school chorus teacher, Laura Bryne, thanking Ms. Bell for her help and the Commission for generously allowing her students to use the Lily Pond property for their Halloween Haunted Hike. B. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED to go into executive session in order to discuss the purchase, exchange, lease or value of real property,potential litigation and review and approve executive session minutes. Each member was polled individually. All members voted yes. The Chairman declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene in regular session following executive session. RETURN TO OPEN SESSION C. GOLF BUSINESS: 1. Sconset Golf Course—2015 Rates and Budget: Commissioners Stackpole and Bartlett abstained as members of Miacomet Golf Club, and Commissioner Gardner abstained due to his spouse being a member of Miacomet Golf Club. At this time, the Rule of Necessity was invoked based on the fact that the Commission was unable to obtain a quorum due to disqualification of Commissioners as members (or due to close association with a member) of Miacomet Golf Course and, as a last resort, those disqualified participated under the authority of the Rule of Necessity. Upon a motion made and duly seconded, it was unanimously VOTED to ratify and confirm the previous vote of December 8, 2014 to keep the rates the same as 2014 and approved the budget with the additional $2,000 expense added for water. 2. Miacomet Golf Course—2015 Rates and Budget: a. Miacomet Golf Course—Fees: Ms. Campese presented a fee schedule with the Land Bank Commission Page 2 December 9,2014 changes voted by the Commission on December 8, 2014. Commissioners Stackpole and Bartlett abstained as members of Miacomet Golf Club, and Commissioner Gardner abstained due to his spouse being a member of Miacomet Golf Club. Miacomet Golf Course— 100%Managers Shift Meal Discussion: Commissioner Paterson suggested that the 100% managers shift meals be revised, suggesting instead that a 50% discount should be applied evenly to managers as well as hourly employees. Upon a motion made and duly seconded, it was unanimously VOTED to eliminate the policy of providing free shift meals to management staff in favor of providing a 50% discount. c. Miacomet Golf Course—2015 Budget: Ms. Campese presented the revised budget based on changes recommended at the December 8, 2014 meeting as well as salary information for 1 key employees. Mr. Savetsky recommended that the commissioners wait on approving the budget until after January 15, 2015 and Mr. Costa's annual review. He indicated that Mr. Costa should be present to answer any questions pertinent to the 2015 budget approval process. D. PROPERTY MANAGEMENT: 1. Sconset Golf Clubhouse—Nantucket Preservation Trust, Event Request: Ms. Bell presented a request from the Nantucket Preservation Trust to host their Annual Fete with 350 attendees expected on Thursday, August 6, 2015 from 6:00 p.m. to 9:00 p.m. at the newly renovated Sconset Golf Clubhouse. After some discussion, with regret,the Commission determined to deny the request based on the size and concern about setting a precedent for large events at the new facility. 2. Lily Pond Parking Lot—Discussion: Mr. Savetsky explained that heavy rains cascaded down Woodbury Lane directly into the entrance of the Lily Pond parking lot causing a significant erosion problem. He informed the Commission that property management staff planned to relocate the parking lot entrance further down the street to prevent the runoff from entering the property. 3. 28 Washington Street—Maria Mitchell Association Lease Extension: Mr. Savetsky stated that he met with John Daniels from the Maria Mitchell Association regarding the aquarium lease which currently runs through 2016. Mr. Daniels requested that the lease be extended an additional six years until 2022 as the organization has had difficulty raising the money to build the science center and after careful consideration, were reorganizing and taking a long term approach to the capital campaign. Upon a motion made and duly seconded, it was unanimously VOTED to extend Land Bank Commission Page 3 December 9, 2014 the lease until 2022. E. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously VOTED to accept, approve and release the regular session minutes of November 25, 2014, as written. F. TRANSFER BUSINESS: 1.November 2014 Transfers—record Nos. 35747 through 35831: The Commission reviewed transfers for the period of November 1, 2014 through November 30, 2014. a. Current"M" Exemptions and Liens: The Commission authorized the placing of liens against the following properties as a result of the purchasers claiming the"M"exemption as first-time buyers of real property: No. 35785 Andrea P. Solimeo, Megan A. Brown, Giovanna Solimeo No. 35792 James Kuratek No. 35817 Matthew Dunham 2. "M"Exemption Update: a. Five-Year Domicile and Ownership Compliance- Release of Liens: Upon a motion made and duly seconded, it was unanimously VOTED to authorize the issuance of a Release of Lien for the following transfer as a result of the purchasers fulfilling all of the requirements of Section 12, subsection (-m-): No. 30347 Michelle Meckler No. 30358 Eric Shoemaker and Meghan Wiley No. 30379 Desmond St. John Wixted and Kristina Wixted G. FINANCIAL BUSINESS: • 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar years 2013 and 2014 through November 2014 were presented. 2. Warrant Authorization—Cash Disbursements: Upon a motion made and duly seconded, it was unanimously VOTED to execute the December 9, 2014 warrant document in the amount of $318,496.76 to be provided to the county treasurer. 3. Warrant Authorization—Closing Cost 39 and 44 Washington Street: Upon a motion made and duly seconded, it was unanimously VOTED to execute the December 9, 2014 warrant document in an amount not to exceed $25,000 to be provided to the county treasurer for closing costs associated with the closing of 39 and 44 Washington Street and various related Town conveyances. Warrant Authorization—2009 Series A Bond Semi-Annual Payment: Upon a motion made and duly seconded, it was unanimously VOTED to approve payment and authorize staff to wire the 2009 Series A Semi-Annual Bond Interest Payment in the amount of$102,733.75 from the Land Bank's Collection Account to the Bond Trustee at U.S. Bank. H. REGULAR BUSINESS: 1. Annual "M"Exemption Amount Adoption: Ms. Campese presented statistics for 2013 and 2014"M" exemption transfers. Based upon an analysis of those statistics and knowledge of current sale prices for residential real property in the Town and County of Nantucket, upon a motion made and duly seconded, it was unanimously VOTED that the value of the "M" exemption shall remain $400,000 for the calendar year 2015. 2. 2015 Meeting Schedule: Upon a motion made and duly seconded, it was unanimously VOTED to accept and confirm the regularly scheduled Land Bank meeting dates for 2015. ADJOURNMENT: Upon a motion made and duly seconded, it was VOTED to adjourn at 6:28 P.M.
