A. CITIZENS BUSINESS/ANNOUNCEMENTS: None. B. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED to go into executive session in order to discuss the purchase, exchange, lease or value of real property and litigation. Each member was polled individually. All members voted yes. The Chairman declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene in regular session following executive session. RETURN TO OPEN SESSION Meghan Perry entered the meeting at 4:42 p. m. C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously VOTED to accept, approve and release the regular session minutes of September 23, 2014, as written. D. PROPERTY MANAGEMENT: 1. Big G Farm - Livestock Land Use Request: Ms. Bell presented a request from John Drahzal of Big G Farm to use a half to one acre to house his 200 chickens, 40 sheep and 20 ducks as he is being evicted from his current situation due to an impending sale of the property. After some discussion, the Commission determined to deny the request mainly due to the private commercial nature of the use. 2. Carter/ 27 Quaise Road — Garage Addition Request: Mr. Savetsky revisited a request from abutter Carl Jelleme to add a 3/4 floor studio space with bathroom to the garage which sits on Land Bank property. In exchange, Mr. Jelleme proposed to release his reversionary rights in the Land Bank's deed to the Pilgrim Road property and would pay for three beach nourishments at the Carter property, as well as assist with creating a trail and better access to the Pilgrim Road property. After much discussion, upon a motion made and duly seconded, it was VOTED to approve the request subject to Mr. Savetsky working out favorable details. Commissioner Paterson recused himself prior to the discussion, Commissioner Bartlett abstained from voting, and Chairman Reinhard was opposed. 3. Nantucket Pond Coalition — Hummock Pond Invasive Species Eradication: Upon a motion made and duly seconded, it was unanimously VOTED to allow the Nantucket Pond Land Bank Commission September 30, 2014 Page 2 Coalition pilot Phragmites removal test area to take place on the Gardner property and to pay for the permitting of such project at an estimated amount of $6,000. Meghan Perry departed the meeting at 5: 00 p.m. E. TRANSFER BUSINESS: 1. Refund Request - No. 33495 W. Duane Realty Trust: Ms. Campese read a request from Attorney, Richard Glidden requested a refund of the Land Bank fee of $35,700 on behalf of his client as the property was transferred back to the original owner when the Land Court deemed the lot had merged with another and was therefore unbuildable. After some discussion, the Commission determined to deny the request as the 30 request for refund period had expired and the property was deeded back to the prior owner as part of a private agreement between parties. F. FINANCIAL BUSINESS: 1. Warrant Authorization — Note No. 33 Lamb: Upon a motion made and duly seconded, it was unanimously VOTED to authorize the transfer of funds for payment of the principal due on Land Bank Note No. 33 held by Susan L. Moore, Trustee of the Lamb Nominee Trust and to issue a check payable to Susan L. Moore in the total amount of $500,000.00. G: GOLF BUSINESS: 1. Golf `Sconset Golf Club — Clubhouse Project Discussion: Ms. Bell reported to the Commissioners that after meeting all procurement law requirements, four bids were received and due diligence had been done on the low bidder, A.P. Whitaker. Further, A.P. Whitaker agreed to work with the Land Bank to employ local subcontractors when possible. Upon a motion made and duly seconded, it was unanimously VOTED to award the contract to the lowest responsible and responsive bidder, A.P. Whitaker, for the renovation of `Sconset Golf Course Clubhouse in the amount of $2,134,000.
