Assistant Director (Jesse Bell) — Annual Review ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of April 7, 2014 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 3:09 p.m. PRESENT: Bartlett, Paterson, Reinhard, Stackpole. ABSENT: Gardner STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Assistant Director; Susan Campese, Administrator/Finance Manager. A. CITIZEN BUSINESS /ANNOUNCEMENTS: None. B. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED to go into executive session in order to discuss the purchase, exchange, lease or value of real property and potential litigation. Each member was polled individually. All members voted yes. The Chairman declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene in regular session following executive session. RETURN TO OPEN SESSION Candidate for Land Bank Commission, Jeanne Miller entered the meeting at 3:22 p. m. C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously VOTED to accept, approve and release the regular session minutes of March 25, 2014, as written. D. TRANSFER BUSINESS: 1. March 2014 Transfers — Record Nos. 34995 through 35065: The Commission reviewed transfers for the period of March 1, 2014 through March 31, 2014. a. Current "M" Exemptions and Liens: The Commission authorized the placing of liens against the following properties as a result of the purchasers claiming the "M" exemption as first -time buyers of real property: No. 35002 Jose R. Gutierrez No. 35042 Jeffrey A. Booms No. 35045 Andrea Facey Candidate for Land Bank Commission, Bruce Perry entered the meeting at 3:24 p. m. E. FINANCIAL BUSINESS: Land Bank Commission April 7, 2014 Page 2 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing fiscal years 2013 and 2014 through March 2014 were presented to the Commission. 2. Warrant Authorization — Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to execute the April 7, 2014 warrant document in the amount of $82,221.00 to be provided to the county treasurer. F. REGULAR BUSINESS: 1. Regular Meeting of April 22, 2014 — Rescheduling Request: Commissioner Bartlett requested moving the regular meeting of Tuesday April 22, 2014 to Thursday, April 24, 2014 so he could attend. Upon a motion made and duly seconded, it was unanimously VOTED to move the meeting to April 24, 2014 at 4:00 p.m. G. PROPERTY MANAGEMENT: 1. Mobile Vending Permit Fee — Discussion: Due to increased requests over the last two years from commercial mobile beach vendors doing business at Land Bank beaches, Mr. Savetsky recommended that the Commission adopt a permit fee, similar to the fee the Land Bank charges for commercially catered beach events to cover administrative costs. After some discussion, upon a motion made and duly seconded, it was unanimously VOTED to charge a $250 permit fee for mobile vendors on Land Bank properties with a discounted rate of $100 for student vendors. 2. Craig/4 Polpis Harbor Road — "Peter and John" Movie Scene Filming Request: Ms. Bell presented a request for the use of the Craig property on April 13, 2014 from 1:00 p.m, to sunset for a film that was being produced through a non - profit company with the use of college and local film students. There would be approximately 15 people, a port -a john and the parking lot used for staging equipment to film a scene of a horse drawn cart on the road at sunset. After some discussion, upon a motion made and duly seconded, it was unanimously VOTED to approve the request and to charge a student discounted permit rate of $100. 3. Craig/4 Polpis Harbor Road — "Grey Lady" Movie Scene Filming Request: Ms. Bell presented a request to use the Craig property on Friday, May 2, 2014 for the filming of a low budget film for national distribution. The scene will require 15 to 20 people and 5 to 6 vehicles from 5:00 p.m. to 9:00 p.m., and depicts the movie's hero walking towards the harbor at sunset. After some discussion, upon a motion made and duly seconded it was unanimously VOTED to approve the request and to charge a permit fee of $250. Property Management Supervisor, Jeffrey Pollock and Attorney, Kathleen Killoy entered the meeting at 3:48 p.m. 4. Land Bank Beaches — Mobile Vending Request (Bus Boys): Ms. Killoy presented a request from her client Clara Bingham (dba "Bus Boys ") to operate a mobile vending concession serving non - alcoholic drinks, chips and packaged ice cream at various locations including Cisco, Land Bank Commission April 7, 2014 Page 3 Ladies and Madequecham Beaches in her 1974 blue VW Camper from early July to Labor Day, as she did the last two years. After some discussion, upon a motion made and duly seconded, the Commission unanimously VOTED to approve the request with a permit fee of $250 to grant a one- year permit to "Bus Boys" to visit Cisco, Ladies and Madequecham beaches seven days a week between 10 a.m. to 5 p.m. for a maximum of two hours per day per beach. Further, "Bus Boys" will be responsible for providing trash receptacles while on the property taking away any trash collected when they leave. Ms. Killoy departed the meeting at 3:52 p. m. 5. Property Management Monthly Update: Mr. Pollock provided an overview of work performed since the last update, including the completion of 2014 mitigation work for the Industrial Park; removal of pine trees and view shed maintenance as well as closing off unauthorized roads in Trott's Hill; staking and rough cutting the area for the proposed dog park on the Backus property and removal of dead pine trees. Further, the Land Bank's effort to assist in the cutting of trails and adding a split railed parking area to Riddick Commons in exchange for an easement from the Sconset Trust was complete except for the transplanting of cedar trees over the next three years to create screening from the development on the east side of the property. Work was completed at the Severn's property puking lot as well as repairs to the third floor apartment and common areas at 22 Broad Street. Mr. Pollock reported he and two other members of the property staff, were taking classes in order to receive applicators licenses for invasive species removal. Further, the bum crew had a very productive day of training with Bob Bale from Wildland Restoration International and also burned approximately 80 acres of Nantucket Conservation Foundation land. Mr. Pollock informed the Commission that the painters had started working on the exterior of the Sconset Golf clubhouse and were finding a lot of rot, which he and Peter Halik would address as needed. Mr. Pollock explained that he and Mr. Savetsky had met with Leo Asadomian of Blackwell and Associates to create specifications for a bid package for road grading. Lastly, Mr. Pollock had inspected the encroachment by the Summer House restaurant on the neighboring Land Bank property and had reported it to the Environmental Police, as the dumping of garbage and restaurant equipment was blatant and extensive. Allen's Way residents Lauren Sinatra and Robert King, Jr. entered the meeting at 4:02 p.m. 6. Backus Lane Dog Park — Discussion: Ms. Sinatra and Mr. King explained they were supporters of a dog park, but were concerned with the proposed location. Mr. Savetsky told them that as soon as a sketch plan was drawn up, the Land Bank would hold a public input meeting regarding the park. Further, he explained that the Backus property had been chosen as the ideal property due its central location and easy public access. Chairman Reinhard assured them that their concerns would be taken into consideration before plans were finalized. Ms. Sinatra and Mr. King departed the meeting at 4:10 p.m. 7. Nobadeer Farm Road Property — Agricultural Use Request: Mr. Savetsky read a letter from abutter, Dylan Wallace requesting to use a portion of the property to plant an organic diverse fruit orchard that could serve as an outdoor classroom for the "seed to plate" curriculum. After Land Bank Commission April 7, 2014 Page 4 some discussion, the Commission determined to deny the request, as the property would be best used for recreational purposes since it was already permitted for anything allowed under the Land Bank Act and the rest of the surrounding property was being used for recreation (paddle tennis and flat sport fields). However, the Commission asked Mr. Savetsky to encourage Mr. Wallace to submit his request again at an alternate site. 8. Nobadeer Farm Road Property — Tennis Club Discussion: Mr. Savetsky reminded the Commission that a group was interested in leasing the property for public tennis courts with a membership. The group sent Mr. Savetsky a preliminary plan that showed eight courts on the site, but had no room for parking. Mr. Savetsky reported that he suggested the group talk to the Nantucket Paddle Tennis club to see if they could share parking, as the two sports encompass different seasons. Maeve Harrington, Wendy Metcalfe, Juliet, William and Met Met Hunter of Island Girls entered the meeting at 4: 27 p. m. 9. Land Bank Beaches — Mobile Vending Request (Island Girls Ice Pops): Ms. Hunter and Ms. Metcalfe presented a request from The Island Girls to sell their all natural ice pops they produce in a commercial kitchen and sell from a small towable cart designed specifically for frozen products at Cisco, Codfish Park, Pebble, Ladies and Miacomet beaches seven days a week for no more than two hours a day per beach. Upon a motion made and duly seconded, it was unanimously VOTED to approve the request and to charge the student discounted permit fee of $100. Ms. Harrington, Ms. Metcalfe and the Hunters departed the meeting at 4:32 p.m. 10. Bachman/158 Orange Street —Abutter Request: Mr. Savetsky presented a request and plan from Kenneth Goldberg of 156 Orange Street to file ajoint Conservation Commission application to remove the Land Bank's portion of the dock and block public access to the walkway. The Commission determined to deny the request. After some discussion, upon a motion made and duly seconded, it was unanimously VOTED to proceed with the needed dock repairs. H. PERSONNEL MANAGEMENT: Ms. Bell and Ms. Campese voluntarily departed the meeting at 4:51 p. m. 1. Administrator/Finance Manager (Susan Campese) — Annual Review: Based on a recommendation from the Executive Director, upon a motion made and duly seconded, it was unanimously VOTED to approve a base wage increase of $6,120 for Ms. Campese, which brings her base annual salary to $74,120 per year. The Commission authorized Mr. Savetsky to execute a Personnel Change Form to be provided to the County Treasurer. 2. Assistant Director (Jesse Bell) — Annual Review: Based on a recommendation from the Executive Director, upon a motion made and duly seconded, it was unanimously VOTED to approve a base wage increase of $4,250 for Ms. Bell, which brings her base annual salary to $89,250 per year. The Commission authorized Mr. Savetsky to execute a Personnel Change Form to Land Bank Commission April 7, 2014 be provided to the County Treasurer.
