Call to Order: Mr. Brannigan called the meeting to order at 3:20PM
Approval of Agenda: Mr. DeCosta motion to approve the agenda, seconded by Mr.
Rector; a
positive vote followed.
Approval of Minutes: Mr. Rector made a motion to approve the minutes of February 19, 2013,
seconded by Mr. Larivee; a positive vote followed.
Correspondence: Mr. Brannigan read the correspondence from Bond Counsel on Section 5 of
Chapter 3 of the Acts of 2013 and agreed with its passage, Nantucket CAN borrow under c.44b
for the Turf Field Project.
Re: History
Amendment to the CPC Act signed by Govenor Patrick on 7/8/12, Section 77. Subsection (b) of
said section 5 of said chapter 44b, as so appearing, is hereby further amended by striking out
paragraph (2) and inserting in place thereof the following paragraph: - (2) The community
preservation committee shall make recommendations to the legislative body for the acquisition,
creation and preservation of open space; for the acquisition, preservation, rehabilitation and
restoration of historic resources; for the acquisition, creation, preservation, rehabilitation and
restoration of land for recreational use; for the acquisition, creation, preservation and support of
community housing; and for the rehabilitation or restoration of open space and community
housing that is acquired or created as provided in this section; provided, however, that funds
expended pursuant to this chapter shall not be used for maintenance. With respect to community
housing, the community preservation committee shall recommend, whenever possible, the reuse
of existing buildings or construction of new buildings on previously developed sites. With
respect to recreational use, the acauisition of artificial turf for athletic
fields shall be prohibited.
The underlined section above was a great concern for the CPC and at its July 17"', 2012 meeting
the following took place.
Correspondence: CPA legislation signed by Governor Patrick (forwarded to Committee on
7/10/2012). Mr. Beaugrand read Section 5.b2 to the committee and pointed out the very last
sentence in that section: "With respect to recreational use, the acquisition of artificial turf for
athletic fields shall be prohibited." This is new language along with many other changes made in
the Community Preservation Act: Enabling Statue- M.G.L ch.44B. Mr. Beaugand expressed
concern over this change pertaining to the artificial turf fields because at the March 31, 2012
Annual Town Meeting, the Town adopted Article 32 as follows:

(Appropriation: Nobadeer Farm Road Playing Fields)
To see if the Town will vote under the Community Preservation Act, to raise and appropriate,
borrow pursuant to any applicable statute, or transfer from available funds the sum of $1,100,000 ( One
million, one hundred thousand dollars) to be spent by the Community Preservation Committee for the
purpose of funding the creation and completion of land for recreational use, in particular, the construction
of one artificial surface playing fled, including all costs incidental and related thereto, at the Nobadeer
Farm Road complex to complement the existing two grass playing fields previously funded and
constructed with funds from the Community Preservation Committee; and as funding therefor to authorize
the Treasurer, with the approval of the Board of Selectmen, to borrow said sum pursuant to the provisions
of G.L. c44B, section 11 and G.L. c. 44, section 7 or any other enabling authority, and to issue bonds and
notes therefore.

TECHNICAL CORRECTION VIA THE MODERATOR replaced the FINANCE COMMITTEE MOTION with
the following: Moved that the Town vote under the Community Preservation Act, to appropriate the sum
of One Million One Hundred Thousand Dollars (1,100,000) From the Community Preservation surcharge
and the State matching funds Nine Hundred Ninety Thousand Dollars ($990,000) to be spent under the
direction of the Town Manager in consultation with the Community Preservation Committee to fund for the
purpose of funding the creation and completion of land for recreational use, in particular, the construction
of one artificial surface playing field, including all costs incidental and related thereto, at the Nobadeer
Farm Road playing fields complex to complement the existing two grass playing fields previously funded
and constructed with funds from the Community Preservation Committee; and as funding therefor to
authorize the reasurer, with the approval of the Board of Selectmen, to borrow said sum pursuant to the
provisions of G.L. c44B, section 11 and G.L. c.44, section 7(25) or any other enabling authority, and to
issue bonds and notes therefor.
Because of this concern, Mr. Beaugrand directed Mr. Richen to get in touch with the Coalition to
find out how the new language in the Act will effect this decision made by Nantucket voters
Mr. Brannigan also mentioned that he would contact Paul Derensis who forwarded the new
legislation to the CPC and was instrumental in crafting the CPA legislation.
At the September 18, 2012 meeting under "Other Business" Mr. Rector commented on recent
current Town Council should be utilized
Mr. Brannigan sent thank you letters to those who helped in securing approval for the H:57
Section 5 Act. Letters were sent to Tim Madden, Stuart Saginor, Daniel Wolf, and Paul
DeRensis. The Act was signed by the Governor on February 15, 2013; it gave Nantucket the
permission to go ahead with the acquisition of artificial turf for athletic fields using CPC funds.

Fund Requisitions: After a brief discussion on d. Sachem's Path and e. Nobadeer Farm Road
Field House, Mr. DeCosta made a motion to approve fund requisitions A -G. The motion was
seconded by Ms. Williams. Positive vote followed.

Old Business: Ms. Damon stated that On March 29, Architecture for approval from HDC to
move forward on Higginbotham House
New Business: Mr. Rector presented a letter from the Director of Family and Children Services,
Peter Swenson: returning the remaining $50,000 from the TryWOorks House back to the CPC.
Bobby DeCosta and Barry Rector expressed concern over the use of Paul DeRensis for this
matter.
Other Business:
Adjournment: Mr. DeCosta made a motion to adjourn at 4:15 pm and seconded by Ms.
Williams, positive vote followed.
