Will replace 4X4 posts as the board walk is built up and can be installed with hand -held hydraulic machines. Increased size opening of fiber -grate decking to 1 Y: inch openings. This location selected as best to maximize North/South direction to maximize sunlight penetration for vegetation under the board walk. Proposed as a water dependent use. Discussion (4:05) Steinauer — Asked if monitoring of vegetation has been previously required on elevated boardwalks. Oktay — Right now it would be easy to do a vegetative quadrate and look at the number of stems. Would like plans approved by staff before installation Staff In other similar applications, have required monitoring in and around the footprint and a vegetative survey of representative plots 3 feet either side of and beneath the board walk in all the resource areas. Representative Bruce Perry, Nantucket Islands Land Bank — Bulkhead repair, in February requested an emergency permit, this is for work outside that permit. There is 40 -feet without any pilings: dig out behind, straighten, install pilings and install tiebacks, back fill, 50 cubic yards of beach nourishment with beach compatible sand. Representative Mark Rits, Site Design Engineering — Construct single row of wooden sand -drift fencing and dune nourishment with beach compatible sand and plant beach grass. There will be no bags. On similar projects, have not had much in the way of monitoring other than post -storm nourishment. Public Bruce Perry, Nantucket Islands Land Bank — The access point for all these Eel Point Road projects is across Land Bank property. The Land Bank granted permission to 99 and 97 Eel Point Road; ask that the applicants of the projects to come to the Land Bank to get appropriate permission to use Land Bank Land for access. Discussion (4:21) Oktay — Asked if there was a monitoring performance standard for this. Want to be able to evaluate these projects for how well they work. Asked about the dates for shore bird protection. If they are coming in after April 1, they need someone to evaluate whether or not any birds are in the way. Staff On similar projects, we have had a monitoring component asking for a report every 6 months on how much sand was brought and if it was re- nourished and a post major storm report. Can have route of travel approved by property owners as a condition. Massachusetts Natural Heritage has at times prohibited vehicular use due to shore- bird protection between April 1 and September 15; they did not in this case. Have not had actual bird activity in this area in a long time; that occurs farther west. Have everything needed to close. Motion Motion to Close. Representative Mark Rits, Site Design Engineering — Also asking for dune nourishment and single row of sand -drift fence at toe of bank. Also asking permission to move the house out of the 100 -foot buffer to the top of the bank. New septic will be outside of the 100 foot buffer as well as that for a wetland across the road. Proposing to extend boardwalk from where it ends now to new position of house across previously disturbed land. The existing house footprint will be planted with a mix of beach grass and bayberry.. Representative Mike Ball, Wilkinson Ecological Design — Driveway redesign. Submitted a revised land - management plan and letter that address Lamentide Environmental, LLC's technical review. Removed several plants from the planting list and replaced with native plants. Mowing would be part of the management suite of activities against species like honeysuckle. Submitted a document that addresses the means by which woody invasive species would be removed and where that work would occur. There is a lot of invasive honeysuckle growing on native cedars; removing the honeysuckle would leave an open habitat. MESA is a No Take with no adverse impact on local species. Julie Jordin, The Garden Design Company — Will increase the grade and apply geo- textile fabric per Arthur D. Arthur D. Gasbarro's recommendation to protect the single trench. Public None Discussion (4:38) Glowacki — Information was submitted in response to technical questions raised by Laurentide and commissioners; we are struggling with issues about native plants, exotic plants, invasive plants gradations and how to interact with the public on that; stated he wants to be clear that if one or two commissioners raise concerns, those are the concerns of one or two commissioners not of the commission as a whole. On the matter of local geno types, asked where that was addressed. (Answer: addressed on the page on land management and lists plants) Asked how one knows whether or not it is a local geno -type. (Answer: By knowing the plants and the seed source; there is a native plant nursery.) Oktay — The proposal is removing invasive woody species and replacing with sand -plane grass plants, it makes more sense to replace woody species with woody species; otherwise the habitat is being changed. Asked about the leach field trench under the circle driveway, wants assurance the design is such that it can handle the weight of vehicles in the driveway. Steinauer — There will also be natural recruitment of native shrubs back into the area. It is easier to control exotic species in an open area. Staff Have everything needed to close. Representative John Stover, Stover Engineering — Deck pier foundation system was installed which was damaged in the October storm which exposed the tight tank and power cables. At this point would like to bury the tank and power cables. On the opposite side, repair a set of stairs. Title 5 requires the tight tank be buried. Once erosion reaches a point, the electric company will shut down power. Request continuance. Public Emily MacKinnon, Nantucket Land Council — Is the application a one -time covering or for on- going. (Answer: would like it to be on- going.) Discussion (4:49) Oktay — High Tide is getting very close. This is a vulnerable spot and at high tide waves will be breaking under the house; wonder how long the tank and cable would remain buried. It is too dynamic an area. Glowacki — Asked if it is harmful to bury the tank. Oktay — Answered no, but a tight tank that keeps getting uncovered could be harmful. Bennett — Asked how tight the tight tank is should it end up under water. (Answer: It is sealed up to the manhole; but sand around it would liquefy and the tank would settle more, which could result in its being recovered or cracking.) Oktay — Wants assurance that a pump truck could access the tank. Staff Can't close due to lack of MADEP file number; can ask for additional information. The Town is keeping an eye on this area; if it looks like it has eroded past, there is the option of an emergency permit to remove quickly. Need information as to what the power cable is for. In lieu planning to rerouting existing grass path to the beach and incorporating a sitting area. Proposing native plants and upgrade of 50 -foot buffer area with propose irrigation but no fertilizer. Looking for recommendation from the commission on a light aerial spray of Round -up®. Public Bruce Perry, Third -party Consultant Conservation Commission — NOI suggested not taking off site which allows the plants to re -seed. When the plant comes up this year, use Renovate®, which is more selective and will kill the plant this year. Renovate® is wetland approved. Asked if the NOI talked about herbicide. Request a waiver under no adverse impact on the other side of landscaped area. Garage will be slab construction and material stored outside the 50 -foot buffer and cart off what won't be used. In what is currently lawn area, the proposal is to run water and electrical to the main house and sewer to the street. Karberg — Include monitoring, Oktay — Stated that based upon scientific studies that the walkway will cause adverse impact. Their desire to access the beach does not override the greater than negligible impact. They have done everything they could do to comply with State regulations. Glowacki — Said that he looks for studies published in journals and scientific reviews as opposed to opinion pieces. He would want to be able to cite scientific facts in the event of a denial. Discussion about reports on studies published that are pertinent to this project. Oktay — Posts tend to attract a rack line and that kills vegetation; should require that is cleaned up.
