Ms. Coombs would have all of the responsibilities and duties of the full membership position until the expiration of the term in April of 2015, whereupon the vacancy would be on the annual town election ballot. Mass. Gen. Laws Section A301 -4 ( "Act") specifically states in Subsection 3 that the "Chairman of the Historic District Commission may designate an associate member to sit on the Commission in case of absence, inability to act or conflict of interest ... or in the event of a vacancy on the Commission until said vacancy is filled in the manner provided herein." The Act also provides for the ability of the Board of Selectmen ('BOS ") to also perform the same action for the unexpired term. I am asking that the BOS refrain from such an appointment in favor of the appointment of Ms. Coombs by me. Should the BOS prefer to open the vacancy then I would respectfully request that they ratify Ms. Coombs appointment to fill said vacancy as she is eminently qualified due to tenure and experience on the HDC.
