I. Call to Order, Agenda, Approval of Minutes, Future Meetings

B. The acceptance of the minutes from October 16, 2012, was moved by Joe
Mucklinger and seconded by D. Anne Atherton and approved unanimously.
C. Chair Reinhard discussed the dates for next two meetings and asked about
potential attendance. The regularly scheduled meeting for next month is December 18a'.
Four of the five present indicated that they could meet on that date. The January meeting
would be Tuesday, January 15, 2013. Closer to the dates of those meetings, Chair
Reinhard will assess the agenda items and call or cancel the meetings.
2. Review/Recommendations on Town Infrastructure Threatened by Erosion.
Chair Reinhard, by e-mail, had distributed to the Committee members a
confidential memo from Town Counsel summarizing the responsibility of the Town to
maintain public ways in danger of erosion. Allen Reinhard said that we have been asked
by the Town Manager to review and make recommendations about the situation
regarding public ways in danger of becoming lost to erosion. Dave Fronzuto and Bob
DeCosta are the Town representatives working on the issues. The memo is confidential
so we will not post it.
In addition to information in the memorandum mentioned above, much general
information summarizing Massachusetts law governing public ways is available,
including documents received by our committee in the past few years, to guide our
discussion: "ANRs and Ancient Ways" by Alexandra Dawson, "A History of Roads and
Ways in Nantucket County" by Frances Karttunen, and "Official Maps" by Rich
Hucksam.
Although several members of the Committee said that the confidential
memorandum was now a public document, the Committee chose to respect the request by
Town Manager for confidentiality and its content will not be included here. It was clear

Town Manager suggestions was drawn up by Joe. In anticipation of a recommendation
to send the revised policy forward, the Committee discussed the issue of enforcement.
Rather than identify one Town official only, the following language was adopted by
consensus, [enforcement should be by] "a Town official designated by the Director of
Planning and Land Use Services." The Committee unanimously approved the revised
and amended draft for submission to the Town. It was agreed that we should ask for a
place on the Board of Selectmen's agenda to report on this policy. Secretary Saperstein
agreed to prepare the report for this presentation; this draft is attached to these Minutes
[ATTACHMENT].
5. Open Space Plan update.
Chair Reinhard met with Nick Holland, GIS coordinator and land planner with the
consultants that are preparing the update to the Town's Open Space Plan, to review
progress. Subsequently they walked, with a hand -held GPS unit, all of the trails on
Town -owned open -space lands. Mr. Holland reported that he reviewed those owned by
the Nantucket Conservation Foundation and the Land Bank with those organizations.
The consultants are preparing a public-opinion survey to be presented to the public by
means of the Internet (SurveyMonkey) and printed text. D. Anne Atherton suggested that
the Town Clerk has included similar surveys with the Annual Town Census
questionnaire. Chair Reinhard will contact the Town Clerk to see if this is possible
[ACTION: Contact Town Clerk re: survey]. The revised Open -Space Plan will be an
asset to the Island
6. Nantucket Railroad Trail research
Joe Marcklinger and Lee Saperstein shared their research and plots of the
Nantucket Railroad route to `Scenset. Lee did a review of aerial photographs, both
current and historic, to find the roadbed and Joe entered the data onto a digital trap of the
Island. This map shows property lines and they will enable Lee to create a table or
spread sheet of lands and their owners. The following step would be to prepare a report
that can be shared with those land owners who provide public access in anticipation of
creating an historic walking trail [ACTION: Saperstein to create spread sheet]. Lee will
also discuss with Andrew Vorce the older route to Surfside to see if it can be found
[ACTION: Lee will share map with Andrew Vorce].
7. Old, new and other business.
Lee Saperstein said that he had heard that the deed restrictions on the Polpis
Harbor Access Road were to be renewed by the Nantucket Conservation Foundation.
Allen Reinhard said that this was so and D. Anne Atherton agreed. After a short
discussion on the use of this way by Nantucket Community Sailing, it was agreed that
there was no issue here for the Committee.

With the printed agenda completed, adjournment by acclamation came at 5:35 pm
Next meetings will be on call: December 18, 2012, and January 15, 2013, in the 2
Fairgrounds Road Training Room.
