Sconset Golf Course — Barn Discussion ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of November 13, 2012 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:01 P.M. PRESENT: Paterson, Reinhard, Stackpole. ABSENT: Barlett, Gardner STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Administrator/Fiscal Officer; Susan Campese, Assistant Administrator. A. CITIZEN BUSINESS /ANNOUNCEMENTS: Mr. Savetsky reported on receiving a thank you letter from Peter Krough, President of the Seal Abatement Coalition ( "SAC "), for the Commission's support of SAC's research efforts on the impacts of the gray seal population on the islands of Nantucket, Tuckernuck and Muskeget. B. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED to go into executive session in order to discuss the purchase, exchange, lease and/or value of real property and approve executive session minutes. Each member was polled individually. All members voted yes. The Chairman declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene in regular session following executive session. RETURN TO OPEN SESSION 4:21 p.m. — Bruce Perry, Resource Planner /Ecologist Jeffrey Pollock Property Supervisor; Robert Earley, Assistant Property Manager; and Richard Turer, Downtown Marketplace Coordinator for Remain Nantucket entered the meeting. C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously VOTED to accept, approve and release the regular session minutes of October 23, 2012 and the special meeting minutes of November 2, 2012, as written. D. TRANSFER BUSINESS: 1. October 2012 Transfers — Record Nos. 33075 through 33196: The Commission reviewed transfers for the period of October 1, 2012 through October 31, 2012. Current "M" Exemptions and Liens: The Commission authorized the placement of liens against the following properties as a result of the purchasers claiming the °M" exemption as first -time buyers of real property: No. 33090 Daniel O. Southey and Michele L. Currie No. 33142 Ethan Griffin and Bridgette Hynes E. FINANCIAL BUSINESS 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar years 2011 and 2012 through October 2012 were presented. 2. Warrant Authorization — Cash Disbursements: Upon a motion made and duly seconded, it was unanimously VOTED to execute the November 13, 2012 warrant document in the amount of $163,505.19 to be provided to the county treasurer. 3. Warrant Authorization — 2007 Series A Semi -Annual Bond Payment: Upon a motion made and duly seconded, it was unanimously VOTED to approve payment and authorize staff to wire the Series A semi - annual bond payment of interest and principal in the total amount of $836,159.39 from the Land Bank's Collection Account to the Bond Trustee at U.S. Bank. F. PROPERTY MANAGEMENT 1. Property Supervisor's Monthly Update: a. October Work Review: Mr. Pollock summarized property management projects performed over the last month, including re- establishing the property line of the Lily Pond with privet hedge along the edge of the Blair house lot and planting the excess privet along the back of the new 5 -bay cold storage building to create screening from the golf course; removing bamboo along the sides at the Peterson property; continuing to clear the road edge on the Lamb property and establish the boundaries and a parking area; emptying the contents of the Gardner shack in anticipation of its removal; closing down the Crocker houses; removing the ramp and dock from the Sharp property; and closing of Madequecham and Nobadeer Beach parking lots for the winter. Additionally, staff had been busy cleaning up some minor tree damage from the past two storms. Mr. Pollock stated that they were planning to clear out kayaks and dinghies after Thanksgiving and that the new signage about closing down the racks for the winter seemed to be working. Additionally, Mr. Pollock reported that he gave a lecture to Nantucket High School seniors about how the Land Bank works and reminded them that properties were for perpetual public use and asked them to respect them as their own. 2. Petrel Landing/Commercial Street — Discussion: Mr. Savetsky reported on a meeting with Mr. Perry and project engineer, Art Gasbarro, who reviewed the latest results of the eel grass surveys and made recommendations for impact mitigation using Helix moorings to replace regular moorings in the immediate area. Mr. Savetsky stated that the next step in the permitting process would be to develop a surface plan to attach to the Conservation Commission application. Further, Land Bank Commission November 13, 2012 Page 3 he would speak with the Town regarding their ongoing storm water drainage project and how that would impact the plan for Petrel Landing. Additionally, he recommended that the Land Bank seek letters of support from the Shellfish and Harbor Advisory Board and the Harbor Plan Implementation Committee. 3. Hummock Pond Road Bike Path — Discussion: Mr. Savetsky reported that without requesting permission from the Land Bank, the Town had begun to plant arborvitae, a fast growing non - native evergreen along Land Bank properties on Hummock Pond Road that would effectively screen the view of the fields from the public. Mr. Savetsky relayed the message to Mike Bums, Transportation Planner for the Town, that the Land Bank did not want them planted there and if the Town did not remove them, the Land Bank would remove them and use them elsewhere. 4. Workshop /125 Somerset Road — Project Update: Mr. Perry informed the Commission that the project was moving along quickly with cement poured this week and backfrlling planned for the end of the week. 5. Sconset Golf Course — Barn Discussion: Mr. Perry reported on speaking with Mark Voigt, Administrator of the Historic District Commission ( "HDC "), who indicated that there were no `emergency' processes available at the HDC to allow the Land Bank to remove what is left of the old barn (either in whole or in part) that was destroyed in last week's storm. Mr. Savetsky said the Community Preservation Committee application requesting funds to restore the barn had been approved, but was contingent on the reuse of materials from the old barn for funding. The Commission asked staff to go through the debris and try to salvage any material worth preserving for utilization in the potential rebuilding of the barn. 6. Barrett/30A Washington Street — Discussion: Chairman Stackpole reported that Harbor Master, Sheila Lucey, had expressed interest in relocating the cottage to Town land at the end of Washington Street for lifeguard housing. 7. Bench/Memorial — Policy Discussion: Commissioner Reinhard questioned whether there was a policy regarding the approval and locating of benches and memorials on Land Bank properties. Mr. Savetsky explained how requests were evaluated and after some discussion it was determined that decisions should continue to be made on a case -by -case basis. 8. Massasoit Bridge/Munson Property — Discussion: Commissioner Reinhard asked about the possibility of creating an area on the Munson property along the side of the bridge for people to turtle, crab and fish at the site safely, as the current width of the bridge was not conducive to those activities. Mr. Perry stated that he had spoken to the state engineer about adding a cantilevered boardwalk to the bridge, but was told the upcoming renovation of the bridge was only to replace decking and not reengineering the bridge at this time. More discussion followed about exploring adding a simple dock on Land Bank property such as the one on the first bridge on Madaket road. Mr. Perry indicated that he would look into various options and report back to the Commission. 9. Gardner Property Boardwalk — Discussion: Commissioner Paterson asked if there was a plan to repair the boardwalk over the marsh at the Gardner property. Mr. Perry stated that he was Land Bank Commission November 13, 2012 Page 4 looking into a new foundation product specifically designed for environmentally sensitive areas that may overcome many of the issues that have been delaying the project.
