CALL TO ORDER: 4:01 p.m.
PRESENT: Gardner, Paterson, Reinhard, Stackpole. ABSENT: Bartlett.
STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Administrator /Fiscal Officer;
Susan Campese, Assistant Administrator.
A. CITIZEN BUSINESS /ANNOUNCEMENTS: None.
Commissioner Bartlett entered the meeting at 4: 02 p.m.
B. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED
to go into executive session in order to discuss the purchase, exchange, lease or value of real
property, and review and approve executive session minutes. Each member was polled individually.
All members voted yes. The Chairman declared that discussion of these matters in open session
may be detrimental to the Land Bank's negotiating position and that the Commission would
reconvene in regular session following executive session.

Mr. Perry, Resource Planner /Ecologist entered the meeting at 4:18 p.m.
C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously
VOTED to accept, approve and release the regular session minutes of June 26, 2012, and the special
meeting minutes of June 29, 2012, as written.
D. TRANSFER BUSINESS:
1. Transfer Hearing Decision and Determination — No. 30969 Caleb N. Cressman, I1:
Pursuant to the requirements of Massachusetts General Court Acts of 1983, Chapter 669 (the
"Act "), as amended, Section 14(a), after a discussion of the matter, a review of the proposed
decision and determination, and after a hearing held at 4:00 p.m., Tuesday, June 26, 2012, at the
Land Bank Meeting Room, 22 Broad Street, Nantucket, the Commission entered a decision and
determination. Upon a motion made and duly seconded, it was VOTED that the Decision and
Determination as presented are consistent with the instructions provided to staff by the Commission
and therefore it was accepted as presented. A copy of the signed Decision and Determination shall
be attached to the minutes of this meeting and incorporated therein by reference. The vote was
unanimous.

2. June 2012 Transfers — Record Nos. 32725 through 32817: The Commission reviewed
transfers for the period of June 1, 2012 through June 30, 2012.
a. Current "M" Exemptions and Liens: The Commission authorized the placing of a
lien against each of the following properties as a result of the purchasers claiming the "M"
exemption as first -time buyers of real property:
No. 32771 Patricia AF Roggeveen
No. 32772 Frederick Bisaillon and Denise Corson
No. 31780 Kimberly E. Sparks
E. FINANCIAL BUSINESS:
1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing fiscal years
2011 and 2012 and calendar years 2011 and 2012 through June 2012 were presented.
2. Warrant Authorization — Fiscal Year -End 2012: Upon a motion made and duly seconded,
it was unanimously VOTED to execute the fiscal year -end June 30, 2012 warrant document in the
amount of $73,909.68 to be provided to the county treasurer.
3. Warrant Authorization — Cash Disbursements: Upon a motion made and duly seconded, it
was unanimously VOTED to execute the July 10, 2012 warrant document in the amount of
$31,266.35 to be provided to the county treasurer.
F. PROPERTY MANAGEMENT:
1. Petrel Landing /Commercial Street: Mr. Savetsky reported on having a strategic planning
meeting with attorney Sarah Alger, licensed professional engineer Arthur Gasbarro and Mr. Perry
for the permitting and design of the bulkhead and dock project at Petrel Landing, recommending
that a staff level meeting with interested stakeholders might be beneficial to have soon.
Additionally, Mr. Savetsky indicated that the first round of sediment sampling, eel grass and
shellfish testing was already underway.
G. FINANCIAL BUSINESS (continued):
1. Fiscal Year 2013 Budget: Mr. Savetsky presented the Fiscal Year 2012 Budget
Comparison (showing approved vs. actual expenditures) and Fiscal Year 2013 Proposed Budget for
the Commission's review. Upon a motion made and duly seconded, it was unanimously VOTED to
approve the Fiscal Year 2013 proposed budget as presented.
H. REGULAR BUSINESS:
1. Mobile Food Vending Request: Mr. Savetsky presented a proposal from Clara Bingham
(dba "Bus Boys ") to operate a mobile vending concession serving drinks, chips and packaged ice
cream at various locations including Cisco, Ladies and Madequecham Beaches. After some

discussion, upon a motion made and duly seconded, the Commission unanimously VOTED to
approve the request and grant a one -year license to "Bus Boys" so long as they obtain all necessary
Town permits and provide trash receptacles when stopped at each location.
I. PROPERTY MANAGEMENT:
1. Golf Course Capital Planning Committee Update: As Chairman of the golf capital
improvements committee, Commissioner Gardner reported on the substance of discussions at two
meetings and requested that Mr. Savetsky be voted in as an additional member of the committee.
Upon a motion made and duly seconded, it was unanimously VOTED to approve the request.
Commissioner Gardner continued, stating that the focus of the committee was to identify and
prioritize future capital needs of `Sconset and Miacomet Golf Courses (including grounds, facilities
and equipment), develop a timeline for such projects and estimate associated costs. As a first step,
the committee recommended developing a master plan for the layout of facilities. Additionally,
improving the condition of the cart paths was identified as a top priority for the committee and
paving them was considered to be the best long term solution. After reviewing previous paving
plans, upon a motion made and duly seconded, it was unanimously VOTED to authorize the
expenditure of funds out of Miacomet Golf's operating budget to revise the plans and come up with
cost estimates for the project.
2. Golf Planning Meetings — Discussion: The consensus of the committee was that regularly
scheduled golf meetings were not necessary at this time, and that special golf meetings should
continue to be scheduled on an `as needed' basis.
Robert Williams entered the meeting at 4:59 p.m.
3. Coffin Family Membership — Discussion: Mr. Savetsky reported on receiving a call from
realtor Gloria Grimshaw on behalf of her client Stephanie Coffin to inquire about the Coffin family
members receiving lifetime memberships to `Sconset Golf. After some discussion, the Commission
asked Mr. Savetsky to find out how many grandchildren there were before making a decision.
4. Friends of Sconset Golf — Update: Mr. Savetsky presented a mission statement and
proposal from Judy Zurheidi with a plan of actions to be taken by the newly formed group in order
to start gathering historical information about the course, including starting a website, holding gams
and creating a link to the website and email on the Land Bank's website.
5. `Sconset Golf Barn — Discussion: Commissioner Paterson inquired about the process of
applying for a Community Preservation Committee (CPC) grant for the historical renovation of the
`Sconset Golf Barn. Mr. Savetsky reported that he had received information from CPC Chairman,
Ken Beaugrand and the process had begun with the assistance of architect William McGuire for the
September 14, 2012 filing deadline.
J. REGULAR BUSINESS:
1. Hummock Pond Road Bike Path: Robert Williams of the Friends of Hummock Pond

Road Bike Path was in attendance to present the Town of Nantucket's bid specifications for the bike
path to Cisco Beach, pointing out that the proposed path ended about 1500 short of the Land Bank's
Cisco Beach parking lot. He reported on meeting with three homeowners associations and many
neighbors, and the overwhelming consensus was that the bike path needed to continue to the beach.
Further, although the Town was reluctant to alter the bid specifications at this time, they were
willing to eliminate the bike racks at the terminus and support the public and Land Bank continuing
the bike path to the beach. After some discussion, it was the consensus of the Commission that the
path should continue to the beach, indicating that they would support the concept of having plans
drawn up for that purpose.
Mr. Williams departed the meeting at 5:40 p.m.
K. PROPERTY MANAGEMENT: Continued.
1. Cisco Brewers — Discussion: Commissioner Bartlett reported that parking for Cisco
Brewery along Bartlett Farm and Hummock Pond Roads was an increasing safety issue and often
blocked access to the Land Bank's lot at Mount Vernon Farm. Various options were discussed, such
as moving the gate and /or installing additional signage at the entrance to the lot. Mr. Perry
suggested that the Commission wait until the next meeting to make a decision so that he could come
back and present a sketch plan for them to consider.

DECISION AND DETERMINATION
In the matter of:
Transfer Record No. 30969, Caleb N. Cressman (the "Purchaser "),
pursuant to Notice of Assessment dated May 23, 2012, regarding
Premises at 300 Polpis Road (Assessor's Map 20, Parcel 11), Nantucket, Massachusetts.
FACTS
1. Pursuant to the requirements of the 1983 Acts and Resolves of the Massachusetts General
Court, Chapter 669, as amended (the "Act "), Section 14(a), the Nantucket Islands Land Bank
Commission (the "Land Bank ") hereby enters this decision and determination, after a hearing
held 4:00 P.M., Tuesday, June 26, 2012, at the Land Bank Meeting Room, 22 Broad Street,
Nantucket. This decision and determination is based upon the Commission's record in this
matter.
2. Present at the hearing for the Purchaser were the Purchaser and his legal representative,
Attorney Arthur I. Reade.
3. Land Bank Transfer Record No. 30969 involved the transfer of property located at 300
Polpis Road (the "Property ") by deed from Laura B. Hussey (the "Seller ") to the Purchaser for a
stated purchase price of $750,000 on August 31, 2010 (the "Time of Transfer ").
4. At the Time of Transfer the agreed value of the Property was $1,750,000.00. The
consideration of the conveyance consisted of a monetary payment of $750,000.00 and the making
of a gift from the Seller to the Purchaser in the amount of the excess in value of the property
above the monetary consideration paid by the Purchaser.
5. At the Time of Transfer the Purchaser claimed the "M" exemption (the "Exemption ")
from the Nantucket Land Bank fee (the "Fee ") on the first $400,000 of the purchase price,
pursuant to Section 12 ( -m -) of the Act, as a first -time buyer of real property.
6. As stated in Section 12 ( -m -) of the Act, the "M" Exemption applies to:
"a purchaser who, or whose spouse at the time of transfer, has at no time before the
said transfer owned or possessed any real property interest as defined in section 1
either within or without Nantucket county; but the purchaser shall make the real
property interest which is the subject of the transfer the purchaser's actual domicile
within 1 year of the time of transfer, and shall remain permanently or for an
indefinite time and without any certain purpose to return to a former place of abode."

7. Further, Section 12 ( -m -) of the Act and Section 4.16 of the Rules and Regulations of the
Commission state:
"In the event of a later transfer within 5 years of the transfer exempted from the fee
under this paragraph, other than the transfer of a mortgage to an institutional lender,
the fee exempted shall become due, together with the accumulated interest and
penalties, and in addition to any fee otherwise due as a result of the later transfer.
The purchaser shall certify as to the foregoing, and the Commission shall attach to
the deed a certificate which shall recite the fact that there is running with the land a
lien equal to the amount of the fee exempted plus accumulated interest and penalties
until such time as all conditions of this subsection have been met."
8. On May 4, 2012, the Purchaser transferred a portion (approximately 4.4 acres) of the
Property to Tessa B. Cressman, filed as Transfer Record No. 32653 for a stated purchase price of
$500,000.
9. The Land Bank assessed a fee, together with interest and penalty, as evidenced by a
Notice of Assessment dated May 23, 2012, which was issued in response to the Purchaser's later
transfer within five years of the transfer exempted from the fee.
10. Land Bank Administrator /Fiscal Officer, Jesse Bell, presented the circumstances of the
transfers and provided a summary of the Commission's record on this matter.
11. The following exhibits were made part of the Commission's official record without
objection by the Purchaser's attorney and are incorporated herein by reference:
Exhibit A, Transfer Documents Record No. 30969, including Form A and deed conveying
300 Polpis Road (approximately 8.8 acres) from Laura B. Hussey to Caleb N. Cressman, II,
with a purchase price of $750,000 (claiming "C" exemption on $1,000,000 of agreed value
of $1,750,000 and "M" exemption on $400,000 of stated purchase price), recorded at the
Nantucket Registry of Deeds on August 31, 2010, as Book 1242, Page 339;

12. Pursuant to Section 12 of the Act, the burden of proof as to whether an exemption is
applicable rests on the Purchasers.
13. The Purchaser's Attorney requested this hearing in order to present his argument as to
why he believes the Purchaser is still in compliance with the requirements of the Exemption.

14. The Purchaser's Attorney presented his interpretation of the requirements of the
Exemption and argued that although there was a later transfer of a portion of the Property, the
Purchaser should be entitled to retain his claim of the "M" Exemption, in this instance, as a result
of the Purchaser's continued domicile on the portion of the Property which was not transferred to
Tessa Cressman.
FINDINGS
1. Based on the facts, documentation and information provided at the hearing, the
Commission finds that the Purchaser is not in compliance with the "ownership" requirement of
the Exemption.
2. The Commission finds that the Purchaser has failed to meet the burden of proof that
Transfer Record No. 30969 remained exempt from the Land Bank fee pursuant to Section
12 ( -m -) of the Act as of May 4, 2012.
3. The intention of the Section 12 ( -m -) of the Land Bank Act is to provide a substantial
savings to first -time homebuyers who wish to make Nantucket their home, to discourage
developers and speculators from claiming and profiting from the exemption by requiring them to
own the property for a period of five years and requiring purchasers to make the property their
actual domicile within the first year of ownership.
4. The Purchaser has not fulfilled the ownership requirement of Section 12 ( -m -) as a result
of a subsequent transfer of a portion of the Property on May 4, 2012 to Tessa B. Cressman.
DETERMINATION
ACCORDINGLY, the Commission finds that pursuant to the requirements of the ( -m -)
exemption as outlined in Section 12 ( -m -) of the Act, the exempted Land Bank fee is due,
together with accumulated interest and penalties.
However, in recognition of the Purchaser continuing to satisfy the domicile requirements of
Section 12 ( -m -) of the Act and in anticipation of the Purchaser's good faith efforts to cooperate,
upon a motion made and duly seconded, it was VOTED to extend a period of 30 (thirty) days
from the date hereof within which the Purchaser may pay back the exempted Land Bank fee in
the amount of $8,000 without incurring interest and penalty.
The Commission reserves the right to hereafter revise said assessment in the best interests of the
Land Bank.
Purchaser has the rights set forth in the attached copy of the Act, for further proceedings in
connection with this Decision and Determination.
