Approval of Minutes: Ms Williams made a motion to approve the minutes CD 9, 2012,
seconded by Mr. Brannigan; a positive vote followed.
Nomination and election of Chairman and Vice - Chairman. Ms Williams made a motion to keep
Mr. Beaugrand as Chairman and Mr. Brannigan as Vice - Chairman, Mr. Larivee seconded the
motion; a positive vote followed.
Correspondence: CPA legislation signed by Governor Patrick (forwarded to Committee on
7/10/2012).
Mr. Beaugrand read Section 5.b2 to the committee and pointed out the very last sentence in that
section: "With respect to recreational use, the acquisition of artificial turf for athletic fields shall
be prohibited." This is new language along with many other changes made in the Community
Preservation Act: Enabling Statue- M.G.L ch.44B. Mr. Beaugrand expressed concern over this
change pertaining to the artificial turf fields because at the March 31, 2012 Annual Town
Meeting, the Town adopted Article 32 as follows:

TECHNICAL CORRECTION VIA THE MODERATOR:

of land for recreational use, in particular, the construction of one artificial surface playing
field, including all costs incidental and related thereto, at the Nobadeer Farm Road
plaiokle complex to complement the existing two grass playing fields previously
funded and constructed with funds from the Community Preservation Committee; and as
funding therefor to authorize the Treasurer, with the approval of the Board of Selectmen,
to borrow said sum pursuant to the provisions of G.L. c44B, section 11 and G.L. c. 44,
section 7(25) or any other enabling authority, and to issue bonds and notes therefor.
VOTE: The vote on the motion pursuant to Article 32 as recommended by the Finance Committee
with a Technical Correction brouaht forward throuah the Moderator, was by 213 Maionty
Handcount Vote. The motion was adopted.

ARTICLE 32
(Appropriation: Nobadeer Farm Road Playing Fields)
To see if the Town will vote under the Community Preservation Act, to raise and appropriate,
borrow pursuant to any applicable statute, or transfer from available funds the sum of $1,100,000 ( One
million, one hundred thousand dollars) to be spent by the Community Preservation Committee for the
purpose of funding the creation and completion of land for recreational use, in particular, the construction
of one artificial surface playing filed, including all costs incidental and related thereto, at the Nobadeer
Farm Road complex to complement the existing two grass playing fields previously funded and
constructed with funds from the Community Preservation Committee; and as funding therefor to authorize
the Treasurer, with the approval of the Board of Selectmen, to borrow said sum pursuant to the provisions
of G.L. c44B, section 11 and G.L. c. 44, section 7 or any other enabling authority, and to issue bonds and
notes therefore.

FINANCE COMMITTEE MOTION: Moved to appropriate from the Community Preservation surcharge
and the State matching funds Nine Hundred Ninety Thousand Dollars ($990,000) to be spent under the
direction of the Town Manager in consultation with the Community Preservation Committee to fund the
construction of one artificial surface playing field, including all costs incidental and related thereto, at the
Nobadeer Farm Road playing fields complex.
Because of this concern, Mr. Beaugrand directed Mr. Richert to get in touch with the Coalition to
find out how the new language in the Act will effect this decision made by Nantucket voters. Mr.
Brannigan also mentioned that he would contact Paul Derensis who forwarded the new
legislation to the CPC and was instrumental in crafting the CPA legislation.
Guest: Ms. Witte at the invitation of Mr. Larivee to talk about the AHTF requests. Jonathan
Silverstein and John Brescher to talk about restrictions on Sachem's Path.
Fund Requisitions: Mr. Larivee requested we hold back on item E (AHTF) until we got to new
business and all agreed. Mr. Larivee made a motion seconded by Ms Dunton to pay all
requisitions A -D, positive vote follow with Ms Williams re- cusing on item C.

Old Business:
New Business: a. Mr. Larivee would like to talk about the responsibility of the committee as it
pertains to the spending of the funds awarded to the various projects. He is looking for guidance
regarding what is relevant to the AHTF fanding/spending. Mr. Larivee was also questioning if
there is administrative funding. Not having the language for the use of the funds it was asked that
the administrator get this language and send out an e -mail to the parties so it can be clarified as
to the use of the funds from FY 2012. Mr. Larivee then presented the following items for
payment from the AHTF: Items E. $2,967.41; F. $250.00; G. $12,427.55, he made a motion that
these items be paid, seconded by Ms Williams and a positive vote followed. ( *Mr. Richert has
done the inquiry and on the spreadsheet from FY '12 prior to the payment that will be going
through from this CPC meeting there is a balance of $76,021.51.) The language in Article 28
from 2011 Annual Town Meeting for the use of these funds reads as follows:

session when ...the adoption of all articles not heretofore acted upon as recommended by the
Finance Committee, or as recommended by the Planning Board was duly motioned and
seconded.
TECHNICAL CORRECTION VIA THE MODERATOR: FINANCE COMMITTEE
MOTION: Moved that the following sums be appropriated or reserved for later
appropriation from the Community Preservation Fund Fiscal Year 2012 revenues or other
available funds as indicated herein, for the administrative and operating expenses of the
Community Preservation Committee, the undertaking of community preservation projects
and all other necessary and proper expenses, for Fiscal Year 2012 community preservation
purposes as set forth herein, with each item considered a separate appropriation to be
spent by the Community Preservation Committee

Provided however, that the above expenditures &re may be conditional on the recording of
appropriate affordable housing restrictions for community housing; running in favor of an
entity authorized by the Commonwealth to hold such restrictions for such expenditures;
meeting the requirements of Chapter 184 section 12 of the Community Preservation Act of
the Massachusetts General Laws.
Finance Committee Comment: The purpose of the technical amendment is to clarify the
timing of the disbursement of funds at the direction of the Community Preservation
Committee to follow the policy established over the last ten years. All Community
Preservation grants provide that an appropriate restriction will be in place.
VOTE: The vote on the motion pursuant to Article 28 as recommended by the Finance
Committee with a Technical Correction brought forward through the Moderator, was by
Unanimous Voice Vote. The motion was adopted.
b. Mr. Brannigan: Project Manager's Responsibilities - -- Discuss changes to item #4. Mr.
Brannigan directed Mr. Richen to send off a copy to the CPC members of the changes made to
item 4 for the committee can have a chance to read it prior to the next meeting. c. Mr. Brannigan:
discuss Annual Public Forum. Mr. Brannigan stated that we will not be having our regular
meeting next month because we will be having our Annual Public Forum. He spoke in length to
the committee about the activities that will be taking place and also stated that we will
celebrating a major project also showing the committee the ad that will be appearing in the I &M
for five consecutive weeks and in Mahon About Town for two weeks leading up to the event. He
stated that he is looking to make the event very informal so people can ask their questions
publicly on a one -on -one basis. He is also looking for an outreach to families with children. He
asked the office staff to put posters up all over the island to accomplish this.
Donations thus far: Soccer balls from Rich Brannigan and the Nantucket Soccer Association;
Lacrosse sticks and balls from Andrew and Melissa Wing of the Nantucket Youth Lacrosse
League; Tennis rackets and balls from Jimmy Manchester; Hot dogs, rolls, water, and
condiments from Stop & Shop; more to come.
Other Business:
Mr. Brescher who has been in conversation with Jonathan Silverstein from Town Counsel's
Office about preparing the final 40B permit for Sachem's Path and has a few questions to ask of
the Committee. Mr. Brescher introduced Jonathan Silverstein from Town Counsel who asked the
committee to allow him to draft an agreement between the CPC /Town and Sachem's Path to
ensure that the houses will remain affordable and to ensure that the Housing Assistance
Corporation does not take any monies from the project until it is completed. The draft agreement
will be sent to the CPC for its approval. The committee assured Mr. Silverstein that the CPC is in
agreement in principal with this process. Mr. Silverstein and Ms Witte then left the meeting.
Adjournment: Ms Williams made a motion to adjourn at 4:40 pm and seconded by Mr. Larivee,
positive vote followed.
The next meeting will be the Annual Public Forum held on Tuesday, August 21, 2012 at the New
Nobadeer Farm playing fields between 4:30- 6:OOPM.
