COMMUNITY PRESERVATION COMMITTEE
Tuesday January 17, 2012 3:30PM

Present: Ken Beaugrand, Chairman; Rich Brannigan, Vice Chair; Dave Larivee; Bob
DeCosta; Linda Williams; and Mark Voigt (3:40).
Call to Order: Mr. Beaugrand called the meeting to order at 3:30 PM
r.;
Approval of Agenda: Mr. Larivee asked to change the agenda by removing items III (a)
—(d) , the requests from the Affordable Housing Trust and that they be deferred to the--5
next month's meeting. With those changes, Mr. DeCosta made a motion to approve the.
agenda which was seconded by Mr. Larivee. Carried.

Approval of Minutes: December 20, 2011, Motion to approve was made by Mr.
Brannigan and seconded by Mr. Larivee. Carried.
Correspondence: Mr. Beaugrand reported on the discussions with the Land Bank for
their approval for the creation of artificial turf fields as part of our warrant article and
that it was hoped that the approval to change the lease for the land to allow the artificial
turf fields would be approved at their meeting on January 24, 2012.
Guest: Loren Goldberg, Town counsel from Kopelman and Page explained the need to
change the town bylaw concerning the membership of our local Community Preservation
committee. After full discussion, on motion by Mr. DeCosta and seconded by Mr.
Brannigan, it was resolved:
To see if the Town will vote to amend Chapter 11, Article VI of the Code of the Town of
Nantucket as follows (NOTE: new language is shown as underlined text, language to be deleted
is shown by strikeout; these methods to denote changes are not meant to become part of the final
text; and, further, that non - substantive changes to the numbering of this bylaw be permitted in
order that it be in compliance with the numbering format of the Code of the Town of Nantucket):
The Community Preservation Committee is established in accordance with MGL c.
44B, §§ 3 through 7. The Committee shall consist of nine members. The members shall
include an appointed designee from each of the following boards, commissions or
authorities: one member of the Conservation Commission; one member of the Historic
District Commission; one member of the Planning Board; one member of the Park and
Recreation Commission; and one member of the Nantucket Housing Authority.
Additionally, the Land Bank and the Board of Selectmen shall each appoint one member,
who may, but need not be a member of the appointing body. The respective board,
commission or authority shall appoint each designee and, whenever necessary, fill
unexpired terms. There shall also be two members -at -large elected for three year terms
from among the registered voters of the Town. Whenever necessary, these members -at-
large shall be appointed by the Board of Selectmen to fill an unexpired term.
And further, to see if the Town will vote to authorize the Board of Selectmen to petition the
General Court for special legislation set forth below; provided, however, that the General Court
may with the approval of the Board of Selectmen, make constructive changes in language as may
be necessary or advisable towards perfecting the intent of this legislation in order to secure
passage; or to take any other action related thereto.
An Act relative to the Community Preservation Committee in the Town of Nantucket
Section 1. Notwithstanding the provisions of section 5(a) of chapter 44B of the general
laws, or of any other general or special law to the contrary, where the historical
commission of the town of Nantucket created under section 8D of chapter 40 did not exist
at the time the Community Preservation Act was adopted by said town, the community
preservation committee in the town of Nantucket shall include one member or designee
of the historic district commission established under section 4 of chapter 40C of the
general laws, as selected by the commission, in place of one member of the historical
commission. Provided, however, that the preceding sentence shall not be interpreted to
preclude the town of Nantucket from including a member of said historical commission on
the community preservation committee either by appointment or election consistent with
the then applicable community preservation committee bylaw.
Section 2. This act shall take effect upon passage.
A unanimous positive vote followed.
There was then further discussion for the need to formalize any awards made at town
meeting by the execution of a grant agreement between the Town and the recipients
which agreement, while drafted by the CPC needed to be entered into with the recipients
by the administration of the Town.
Fund Requisitions: Mr. DeCosta made a motion to approve fund requisitions e,f,g,h,j abd
K, which was seconded by Mr. Voigt.

Motion Carried unanimously..
Mr. Brannigan made a motion to approve fund requisition i. (1800 House / Brannigan
$134,858.12 FY '04 -05), and seconded by Mr. Voigt. Mr. Beaugrand abstained from this
vote.
Motion Carried.
Old Business: As to the $50,000 being held in the Try Works account in Mr. Rector's
absence this id =s deferred to the February 21, 2012 meeting.
As to the Dreamland Theater Restriction Mr. Voigt pointed out that there were e a
few matters that he need to get clarified on this matter.
New Business: Mr. Beaugrand requested approval to pay the 2012 Community
Preservation Coalition dues at $3,750. On motion by Mr. DeCosta and seconded by Mr.
Brannigan, carried unanimously.
Mr. Larivee asked about remote access at meetings. Mr. DeCosta stated the
Town is looking to may adopt some remote access, but the timetable has not yet been
established..
Adjournment: Motion was made by Mr. Brannigan at 4:45 and 2nd by Mr. Voigt.
The next regular meeting will be held at 3:15 on Tuesday, February 14, 2012 in the
Community Room of the Public Safety Building located on 1 St floor at 4 Fairgrounds
Road, Nantucket, MA.
