Miacomet Golf Course — Management RFP Update ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of November 8, 2011 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:00 P.M. PRESENT: Gardner, Paterson, Reinhard, Stackpole. ABSENT: Bartlett. STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, Administrator /Fiscal Officer; Susan Campese, Assistant Administrator. A. CITIZEN BUSINESS /ANNOUNCEMENTS: None. B. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED to go into executive session in order to discuss the purchase, exchange, lease and /or value of real property. Each member was polled individually. All members voted yes. The Chairman declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene into regular session following executive session. RETURN TO OPEN SESSION C. PROPERTY MANAGEMENT: Commercial Wharf property owners, Richard Corey, his attorney, Arthur Reade and Mickey Rowland entered the meeting at 4:17 p. m. Robert DeCosta, Board of Selectman and SHAB member entered the meeting at 4:20 p. m. Bruce Perry, Resource Planner /Ecologist entered the meeting at 4:22 p. m. Jeffrey Pollock, Property Supervisor entered the meeting at 4:26 p.m. 1. Petrel Landing Property/Commercial Street — Planning Discussion: Mr. Savetsky presented conceptual sketches of the property prepared in 2008 as a result of meetings with David Fronzuto and Sheila Lucey of the Marine Department and Dr. Sarah Oktay of the Harbor Plan Implementation Committee. Attorney Reade expressed concern that the installation of floating docks and dinghy piers would impact the neighbors' enjoyment of their properties. Mr. DeCosta, speaking on behalf of the Shellfish and Harbor Advisory Board (SHAB), told the Commission that the commercial fisherman were not in favor of floating docks or dinghy piers, but were enthusiastic about the bulkhead being installed for a solid filled pier allowing short-term docking for loading and off - loading for both commercial and recreational boaters. Mr. Savetsky said the plan envisioned a park -like setting and three (3) drop off /pick up parking spaces with a proposed 15 minute time limit, in addition to a shell drive to allow vehicular access to the bulkhead. Mr. Savetsky stated that the fisherman, Marine Department and Nantucket Police Department collectively could potentially enforce the time limits. Chairman Stackpole stated no decisions had been made and input from all affected would be taken into account before plans were finalized. Land Bank Commission Page 2 November 8, 2011 Mr. Corey, Mr. Reade, Mr. Rowland and Mr. DeCosta left the meeting at 4.49 p.m. D. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously VOTED to accept, approve and release the regular session minutes of October 25, 2011, as written. Judy Zurheide entered the meeting at 4:50 p.m. E. PROPERTY MANAGEMENT: 1. Petrel Landing Property /Commercial Street — Planning Discussion Continued: Ms. Zurheide expressed concern over public land being used for commercial purposes. Chairman Stackpole assured Ms. Zurheide that any improvements to the property Nould be for the benefit of all the public, not just for the sole use of the commercial fisherman. Ms. Zurheide left the meeting at 4:58 p.m. F. TRANSFER BUSINESS: 1. October 2011 Transfers — Record Nos. 32022 through 32099: The Commission reviewed transfers for the period of October 1, 2011 through October 31, 2011. a. Current "M" Exemptions and Liens: The Commission authorized the placing of liens against the following properties as a result of the purchasers claiming the "M" exemption as first -time buyers of real property: No. 32078 David A. Guevara Menjivar No. 32083 Jill Yeagy b. Additional Information Required: The Commission asked staff to request additional information on the following transfers: No. 32029 Mira Mar Nominee Trust No. 32030 Mira Mar Nominee Trust No. 32078 David A. Guevara Menjivar G. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar years 2010 and 2011 through October 2011 were presented. 2. Warrant Authorization — Cash Disbursements: Upon a motion made and duly seconded, it was unanimously VOTED to execute the November 8, 2011 warrant document in the amount of $89,050.75 to be provided to the county treasurer. 3. Warrant Authorization — 2007 Series A Semi - Annual Bond Payment: Upon a motion made and duly seconded, it was unanimously VOTED to approve payment and authorize staff to wire the Land Bank Commission November 8, 2011 Page 3 Series A semi - annual bond payment of interest and principal in the total amount of $821,009.39 from the Land Bank's Collection Account to the Bond Trustee at U.S. Bank. 4. Warrant Authorization — Note 432, Barrett: Upon a motion made and duly seconded, the Commission VOTED to authorize payment (by check or wire) of the remaining principal due on Note No. 32 held by the Ravanike Realty Group (25 %), Peter J. Barrett and Clara Hayes Barrett (50 %), and Vangel R. Zissi and Barbara J. Zissi as Trustees of the C &J Realty Trust (25 %), in the total amount of $3,450,000 to be allocated as follows: Peter J. Barrett and Clara Hayes Barrett $2,156,250.00 Vangel R. Zissi and Barbara J. Zissi $1,293,750.00 H. REGULAR BUSINESS: 1. 2012 Annual Town Meeting — Warrant Article Proposals: Mr. Savetsky informed the Commission he was working on several warrant articles with Andrew Vorce of the Planning Department that would eliminate the paper portion of Bartlett Road and the paper roads laid out within Miacomet Park and the Weweeder valley railroad corridor. I. PROPERTY MANAGEMENT: 1. Property Supervisor's Monthly Update: a. Burn Program Update: Mr. Pollock reported on the successful completion of one burn thus far, indicating that they were hoping for more this season. Mr. Pollock reported that he, Rob Earley and Ed Boynton had completed their classes at New York Wildfire Academy. Additionally, he requested the expenditure of up to $1,500 to replace the bladder bag used on one of the engines with a permanent 300 gallon poly tank, hose reel and skid. After some discussion, upon a motion made and duly seconded, it was unanimously VOTED to approve the request to purchase a poly tank, hose reel and skid with a price not to exceed $1,500. b. October Work Review: Mr. Pollock summarized projects staff worked on over the last month, including equipment maintenance, patrols, storm clean up of trails, additional boardwalk construction at the Sanguinetti Property, closing of Madequecham Beach parking lot for the winter. Further, staff had a proposed layout of trails for the Kelley Road property that would link it with the Milestone trails. In addition, daffodils had been planted on the Wolfe Property. c. Sharp Property: Mr. Pollock said there was a growing problem of abandoned trailers and boats at the Sharp Property. After some discussion, the Commission determined to have property management staff strictly enforce the stated rules by attempting to notify owners, then towing and impounding abandoned property. d. Carter Property: Mr. Pollock reported on posting "no trespassing" signs at the Carter property due to safety concerns, indicating that they would stay up until the house is removed within the next few weeks. Further, the last storm had caused major erosion above the bulkhead as well as the beach under the stairs. Land Bank Commission November 8, 2011 Page 4 e. Gaillard Property — Sign Discussion: Commissioner Paterson requested an update on the status of the signage for Gaillard property. Mr. Savetsky said the sign would need to be approved by the Historic District Commission (H.D.C.) and had not been applied for as of yet. As an alternative, he suggested that the Commission consider shrinking the sign down to one square foot which would not need H.D.C. approval. 2. Barrett /Zissi Property /30B Washington Street — Planning Discussion: Mr. Perry reported that the move on/move off applications for the Lyman Perry building at 30B Washington Street were on the evening's agenda, with the move off location being the Bartkowiak's property on Somerset Road. 3. Lamb Property /36 Wauwinet Road — Planning Discussion: Mr. Savetsky and Mr. Perry presented an aerial of the property and reported that Rob Anderson of Habitat for Humanity had viewed the building to see if they might be interested in moving it for their use. Mr. Perry explained that property staff was meeting this week to create a work plan for the year and would be discussing the property, but suggested surveying and posting the corners, installing split rail fencing on the sides and thinning the plants and trees along the road to open up the views of Polpis harbor. 4. Miacomet Golf Course — Management RFP Update: Staff updated the Commission on the RFP process, explaining that each member of the evaluation committee would fill out a ranking sheet and then would meet to compile the rankings and vote on an overall ranking. Then, once the rankings and interviews were complete, the Town of Nantucket's Procurement Officer, Diane O'Neil, would open up the price proposals, discuss the options with the committee and a decision would be made.
