PRESENT: Bartlett, Gardner, Paterson, Reinhard, Stackpole.

Susan Campese, Assistant Administrator; Resource PlannerBcologist, Bruce Perry.
Land Bank counsel, Valerie Swett was also present at call to order.
A. PUBLIC HEARING:
1. Proposed Restatement of Rules and Regulations: Pursuant to Section 14 of the Land Bank
Act, the Commission held a public hearing for the purpose of receiving comment on a proposed
restatement of the Nantucket Land Bank Commission Rules and Regulations. Chairman Stackpole
opened the hearing. No members of the public were present. The Chairman waived the reading of a
summary prepared by Jesse Bell for the benefit of the public regarding the recent statutory
amendment and need for new forms.
Ms. Bell presented comments received from attorneys Marianne Hanley and Kevin Dale
through email correspondence dated June 1, 2011 and June 3, 2011, respectively, regarding the
interpretation of a right of first refusal as a type of option to purchase which would now fall under
the definition of "real property interest"; concern with how this would interact with the "M"
exemption; and disapproval of the fee for an advance ruling being raised from $1,500 to $2,500. In
response to Ms. Hanley's concerns, Ms. Swett and Ms. Bell presented the Commission with an
additional proposed amendment to the "M" exemption.
There being no further comments or discussion, upon a motion made and duly seconded, it
was VOTED to close the hearing.
Upon a motion made and duly seconded, it was unanimously VOTED to make the following
findings and resolutions:
WPIEREAS, the Massachusetts legislature passed Chapter 3 54 of the Acts of 2010, effective
January 6, 2011, among other things restating the definition of "Real Property Interest" as used in the
Land Bank Act (Chapter 669 of the Acts of 1983, as amended); and
WHEREAS, pursuant to notice published in the Inquirer & Mirror on May 26, 2011, on June
28, 2011, this Commission held a public hearing to receive public comment on restated rules and
regulations which incorporate the changes made to the Act by said Chapter 354, and to make other
changes useful for clarifying the regulations and aiding efficient administration of the Act.

NOW, THEREFORE, be it resolved that the draft Rules and Regulations reviewed by the
Commission at its June 28, 201 1, meeting be and hereby are amended as follows:
Add the following subparagraphs to Section 4.16 of the Regulations:
(12) A Purchaser who is otherwise qualified to receive the "M" exemption will not be
disqualified from receiving the exemption if the Purchaser has previously owned an
option or right of first refusal which was not exercised prior to the date of the transfer
which is eligible for the "M" exemption.
(13) The granting of an option or right of first refusal to purchase a property which is
subject to an "M" exemption on the date such option or right of first refusal is granted
shall not, by itself, be deemed to terminate the exempt Purchaser's full time
permanent residence at the property. Exercise of the rights under an option or right of
first refusal such that the property is transferred within five years of the "M"
exemption transfer shall be an event of non-compliance with the requirements of
Section 12(m) of the Act.
RESOLVED FURTHER, that the draft Rules and Regulations as so amended be and hereby
are adopted, to take effect July 22, 2011.
RESOLVED FURTHER, that Land Bank staff are instructed to arrange for publication of the
new Rules and Regulations in the Inquirer and Mirror in advance of said effective date, and to take
all other procedural steps required.
B. CITIZEN BUSINESS/ANNOUNCEMENTS:
1. Muskeget Endangered Bird Monitoring: Mr. Savetsky reported on assisting
Massachusetts Audubon volunteer Edie Ray in identifying and cordoning off Piping Plover and
American Oyster Catcher nests on the western, Land Bank side of Muskeget, informing the
Commission that the blocked off areas did not prevent the public from using the island. Mr.
Savetsky also updated the Commission on the continued erosion of the island.
2. Sloselc Property -Event Request: Mr. Savetsky presented a request from Sustainable
Nantucket to hold a fundraising event on Saturday, July 16, 2011 on the planted fields at Moors End
Farm, with the proposed set up of a dinner tent and dancing tent, and expectation of up to 250
attendees. Upon a motion made and duly seconded, it was unanimously VOTED to approve the
request provided Sustainable Nantucket carry event insurance with the Land Bank named as
additionally insured.
3.40th Pole -Maintenance Request: Mr. Savetsky reported on receiving a request from the
Eel Point Association asking the Land Bank to cut back the brush on the Land Bank's frontage on
Eel Point Road. The Commission expressed no objections to the request.

4. Holdgate Property -Labyrinth Funding Request: Volunteer Judy Zurheide updated the
Commission on the progress made on the Labyrinth and requested funding to replace the high grass
border with a Belgian block border which would be easier maintain for property management staff.
Additionally, she asked the Commission to think about their long-range vision for the property and
presented them with some naming options to consider. Upon a motion made and duly seconded, it
was unanimously VOTED to move forward with the block border and to have Land Bank staff
search for the most economic source in purchasing the materials.
Attorney Richard Loftin entered the meeting at 4:43 p, m.
Ms. Zurheide departed the meeting at 4:52 p. m.
5. New Land Bank Forms -Public Comment: The Chairman declined to reopen the public
hearing. Mr. Loftin suggested minor wording revisions to Form C as well as Form 2. The
Commission thanked Mr. Loftin for his comments and for taking the time to review the restatement.
Mr. Loftin departed the meeting at 4: SS p. m.
C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was unanimously
VOTED to accept, approve and release the regular session minutes of May 28, 2011, and the special
meeting minutes of June 3, 2011, as written.
D. TRANSFER BUSINESS:
1. May 2011 Transfers -Record Nos. 31648 through 31711: The Commission reviewed
transfers for the period of May 1, 2011 through May 31, 2011.
a. Current "M" Exemptions and Liens: The Commission authorized the placing of a
lien against the following property as a result of the purchasers claiming the "M" exemption as first-
time buyers of real property.

The Commission asked staff to request additional information on the above-referenced transfer.
2. Transfer Updates:
a. Five-Year Domicile and Ownership Compliance -Release of Liens: Upon a
motion made and duly seconded, it was unanimously VOTED to execute and authorize the issuance
of a Release of Lien for each of the following transfers as a result of the purchasers fulfilling all of
the requirements of Section 12, subsection (-m-):

b. Two-Year Domicile Non-Compliance/Extension Request - No. 29912 Catherine
A. Kinsella: The Commission considered a written request from the purchaser seeking aone-year
extension of the two-year domicile requirement of the "M" exemption. The purchaser claimed that
financial issues had caused some delay in construction, but the project had now resumed and her
family expected to be domiciled there within the year. Upon a motion made and duly seconded, the
Commission unanimously VOTED to extend the domicile requirement period for one year ending
June 3, 2012.
E. FINANCIAL BUSINESS:
1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing fiscal years
2010 and 2011 through May 2011 were presented to the Commission.
2. Monthly Financial Report: The Commission accepted the May 2011 financial report
including the balance sheet and income statement previously provided by electronic
correspondence.
3. Warrant Authorization -Cash Disbursements: Upon a motion made and duly seconded, it
was unanimously VOTED to execute the June 28, 2011 warrant document in the amount of
$24,090.97 to be provided to the county treasurer.
F. PROPERTY MANAGEMENT:
1. Maintenance Facility/125 Somerset Road -Award of Design Services Contract: Mr.
Perry present four responses received from the request for qualifications for architectural design
services, reporting that only Nantucket Architecture Group had satisfied all the criteria requested.
Upon a motion made and duly seconded, it was unanimously VOTED to award the contract to
Nantucket Architecture Group.
2. Road Maintenance:
a. Road between Kelly Road and Moors End Lane: Mr. Perry presented three quotes
for road grading on portions of the road between Kelly Road and Moors End Lane. After some
discussion, upon a motion made and duly seconded, it was unanimously VOTED to award the work
to Atlantic Aeolus for price not to exceed $2,060.
b. Barrett Farm Road: Mr. Perry presented three quotes for road grading on a portion
of Barrett Farm Road. After some discussion, upon a motion made and duly seconded, it was
unanimously VOTED to award the work to Myles Reis for a price not to exceed $2,200.

3. Latici Property/29 North Cambridge Street -Shed Demolition: Mr. Perry presented three
quotes for demolition of the existing sheds and removal of debris from the Latici property. Upon a
motion made and duly seconded, it was VOTED to award the work to Toscana Corporation for a
price not to exceed $1,440 and landfill tipping fees of $275 per ton. Commissioner Paterson
abstained.
4. Chase Property/50 Tennessee Avenue -Septic Tank Abandonment: Mr. Perry requested
three quotes for the filling of the existing tight tank with flowable sand, loam and reseeding of
disturbed areas. Mr. Perry presented the two prices he received and after some discussion, upon a
motion made and duly seconded, it was unanimously VOTED to award the work to Myles Reis
Trucking for a price not to exceed $880.
5. Madequecham Valley West Property -Parking Lot Resurfacing: Mr. Perry presented
three quotes for re-grading, resurfacing and compacting the new surface of the Madequecham
Beach parking lot, which was never properly finished. After some discussion, upon a motion made
and duly seconded, it was unanimously VOTED to award the work to Myles Reis for a price to not
exceed $9,000, with the stipulation that the gravel be mixed into the hardener.
6. Ladies Beach/Smooth Hummocks -Event Request: Mr. Savetsky presented a request
from the catering company `A Taste of Nantucket' for a family cook-out at Ladies Beach with
tables, chairs and portable toilets for 60 people on Saturday, July 23, 2011 from 5:30 to 8:30 p.m.
After some discussion as to the appropriateness of this location given the timing and size of the
event, upon a motion made and duly seconded, it was unanimously VOTED to approve the request
with the modification that the location be changed to Miacomet Beach.
Attorney Edward Foley Vaughan entered the meeting at S: 41 p. m.
G. TRANSFER APPEAL HEARING - No. 31665 John J. McAtee, Jr.:
Pursuant to Section 14 of the Land Bank Act, the Commission held a hearing to consider an appeal
of the Land Bank transfer fee of $161,610 paid under protest on May 9, 2011 by Mr. John J.
McAtee, Jr. for property located at 226 Polpis Road.
The hearing was tape recorded.
Edward Foley Vaughan, Esq., was present to serve as legal representative for John J. McAtee, Jr.
The hearing was opened by Chairman Stackpole.
Attorney Vaughan provided a summary of the transfer, describing how the Internal Revenue
Service treated the transaction as a substitution of assets and not a sale. Land Bank counsel Valerie
Swett posed several questions for Mr. Vaughan to answer concerning the relevance of the Internal
Revenue Code in relation to the Land Bank Act.
Ms. Bell asked that the following documents be entered into the record as exhibits. The following

G. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was unanimously VOTED
to enter into executive session in order to discuss the purchase, exchange, lease or value of real
property. Each member was polled individually. All members voted yes. The Chairman declared
that discussion of these matters in open session may be detrimental to the Land Bank's negotiating

position and that the Commission would reconvene into regular session following executive session.
