Administrator/Fiscal Officer - Conflict of Interest Disclosure ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of November 9,2010 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:01 P.M. PRESENT: Gardner, Johnson, Reinhard, Stackpole. ABSENT: Bartlett. STAFF PRESENT: Eric Savetsky, Executive Director; Jesse Bell, AdministratorlFiscal Officer; Susan Campese, Assistant Administrator. A. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into executive session in order to discuss the purchase, exchange, lease and/or value of real property. Each member was polled individually. All members voted yes. The Chairman declared that discussion of these matters in open session may be detrimental to the Land Bank's negotiating position and that the Commission would reconvene into regular session following executive session. RETURN TO OPEN SESSION B. CITIZEN BUSINESS/ANNOUNCEMENTS: None. c. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was VOTED to accept, approve and release the regular session minutes of October 26, 2010, as written. Bruce Perry, Resource Planner/Ecologist; Jeffrey Pollock, Property Supervisor and Robert Earley, Assistant Property Manager entered the meeting at 4:49 P.M D. TRANSFER BUSINESS: 1. October 2010 Transfers - Record Nos. 31066 through 31169: The Commission reviewed transfers for the period of October 1,2010 through October 31, 2010. a. Current "M" Exemptions and Liens: The Commission authorized the placing of liens against the following properties as a result of the purchasers claiming the "M" exemption as first-time buyers of real property: No. 31070 Kurt M. and Alexandra M. Rosenberg No. 31131 Ashley Rose and Jason Bonville No. 31156 Christopher R. Roche and Corey Costa No. 31159 Christopher M. Carnevale b. Purchase Price Documentation Required - No. 31070 Kurt M. and Alexandra M. Rosenberg: The Commission asked staff to request supplemental documentation from the purchasers to support the stated purchase price on the above-referenced transfer. c. Additional Information Required: The Commission asked staff to request additional Land Bank Commission November 9,2010 Page 2 information on the following transfers: No. 31066 Richard and Margaret Griswold, et al. No. 31076 Obed Joy LLC No. 31116 Folger Lane LLC 2. "M" Exemption Update: a. Five-Year Domicile Compliance/Release of Lien - No. 25721 Daniel Sullivan: Ms. Bell reported that Mr. Sullivan provided copies of his current car registration and driver's license, as well as his 2008 and 2009 Massachusetts Residence Income Tax Return in order to show compliance with the "actual domicile" requirement of the "M" exemption. Accordingly, upon a motion made and duly seconded, the Commission VOTED to rescind the Notice of Assessment for the outstanding fee, accrued interest and penalty in the total amount of $8,080.00 and to authorize the issuance of a Release of Lien as a result of the purchaser fulfilling all of the requirements of Section 12, subsection (-m-). 3. Transfer Update: a. Additional Information Provided: Based upon the submission of additional information, the Commission found the following transfers to be in order: No. 30872 Patricia Ann Park Realty Trust Nos. 30928 and 31166 Raja Abdul-Karim E. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: Monthly transfer statistics reports comparing calendar years 2009 and 2010 through October 2010 were presented. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to execute the November 9,2010 warrant document in the amount of$71,147.37 to be provided to the county treasurer. 3. Warrant Authorization - 2007 Series A Semi-Annual Bond Payment: Upon a motion made and duly seconded, it was VOTED to approve payment and authorize staff to wire the Series A semi- annual bond payment of interest and principal in the total amount of $811,409.38 from the Land Bank's Collection Account to the Bond Trustee at U.S. Bank. James Manchester, Director of Parks and Recreation, and Charles Bartlett, Property Manager of Parks and Recreation, entered the meeting at 5:03 P.M F. PROPERTY MANAGEMENT: 1. Nobadeer Farm Road Property - Ball Fields Project Discussion: Mr. Manchester presented design plans for the ball fields, along with price estimates comparing asphalt to gravel for the building and annual maintenance of the driveway and parking areas. Additionally, he informed the Commission that CHA Sports, the firm that won the bid for generating the bid specs, recommended asphalt based on Land Bank Commission November 9,2010 Page 3 the volume of vehicle traffic expected at the site. Commissioner Johnson inquired as to whether CHA Sports had considered the use of AckPack and magnesium flakes as a more environmentally-friendly, aesthetically-pleasing alternative. Mr. Bartlett pointed out that approximately 200 vehicles would be using the lot year-round on a daily basis. Commissioner Johnson requested that Mr. Manchester bring back additional information from CHA Sports, explaining why alternatives to asphalt were determined to be unsuitable for the parking lot. Chairman Stackpole thanked Mr. Manchester and Mr. Bartlett for their time. Mr. Manchester and Mr. Bartlett left the meeting at 5: 16 P.M 2. Property Supervisor's Monthly Update: a. October Work Review: Mr. Pollock provided an overview of work performed in October at the Keane property, Long Pond trails, Reith parking area, road clean up in Trotts Hills, restoration work at the Dias/Pilot Whale property, improvements to the Rodts entrance, hedge-trimming at the Blair House and continued progress with the construction of the Sanguinetti boardwalks. He further reported that property management staff had reduced their patrols of Land Bank properties from seven to three days per week. b. Burn Program Update: Mr. Pollock and Mr. Perry reported on the successful completion of two burns thus far, indicating that they were hoping for two more this season. Mr. Pollock reported that students and teachers from the Lighthouse School were present to watch one of the burns and students had catalogued research plots, planning to return in the spring to record the changes. 3. 125 Somerset Road - Marble Farmhouse Roofing: Mr. Pollock reported that the Somerset Farmhouse needed to be reroofed and presented three price estimates for the Commission to consider. Based on Mr. Pollock's recommendation, upon a motion made and duly seconded, it was VOTED to authorize the expenditure of $1 0,500 for Peter Halik to complete the work. 4. Cisco/Hummock Pond Area - Pine Tree Removal: Mr. Perry showed pictures of the dead pine trees near Cisco Beach, Moth Ball Way and Heller's Way, presenting estimates from Nantucket Tractor Company ("NTC") to cut and grind the trees on site. Upon a motion made and duly seconded, the Commission VOTED to move forward with the work, contingent upon Mr. Perry being able to negotiate the price down to $16,000 for all three properties. 5. Crocker Property - Driveway and Septic System Maintenance: Chairman Stackpole asked property management staff to trim the driveway of the Crocker property so trucks and emergency vehicles could access it. In addition, Mr. Perry reported that the septic inspection deadline for the Madaket Watershed was rapidly approaching, explaining that the septic system had failed and Ms. Crocker was required to replace the system in 2005 and as of yet had not. The Commission requested that Mr. Perry speak to Ms. Crocker about trimming the driveway and the need to install a tight-tank for seasonal use or a new septic system if she was planning on staying at the property beyond a year. 6. Petrel Landing Maintenance: Chairman Stackpole asked property management staff to figure out a temporary fix to stave off the erosion at Petrel Landing and make it safe for public use. After further discussion, the Commission prioritized the need for a new bulkhead and dock and asked Mr. Perry to begin the permitting process for these projects. Somerset Farm Property - Maintenance Building Renovation: Commissioner Gardner suggested that the Commission form a committee to assess the needs of property management staff and put together a plan for the renovation of the maintenance facility. Upon a motion made and duly seconded, it was VOTED to appoint Chairman Stackpole and Commissioner Gardner, along with Mr. Savetsky, Mr. Pollock and Mr. Perry as members of the committee, with the expectation that they would bring back findings and present a recommendation for moving forward at a future meeting. G. REGULAR BUSINESS: 1. Historic District Commission ("HDC") Letter Discussion: The Commission discussed a recent letter to the editor in the Inquirer and Mirror by HDC Assistant Administrator James E. Grieder which publicly criticized the Land Bank as well as several other town departments. The Commission determined that the appropriate response was to have Mr. Savetsky aggressively pursue the matter with Town administration. H. PERSONNEL MATTERS: 1. Administrator/Fiscal Officer - Conflict of Interest Disclosure: Ms. Bell disclosed that as an attorney admitted to practice in the Commonwealth, she was able to obtain her real estate broker's license with minimal effort, for the sole purpose of being the listing broker on her mother's home located at 8 Jefferson Lane. Further, in order to eliminate any apparent conflict, the state ethics commission had advised her to disclose the financial interest in writing to her appointing authority, which Ms. Bell had already done via electronic correspondence.
