PRESENT: Bartlett, Gardner, Johnson, Reinhard. ABSENT: Stackpole. STAFF PRESENT: Jesse Bell, AdministratorlFiscal Officer; Susan Campese, Assistant Admin- istrator. A. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Vice Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related to land acquisition. RETURN TO OPEN SESSION B. APPROV AL OF MINUTES: Upon a motion made and duly ~conded, it was VOTED to accept, approve and release th~ regular session minutes of April 27, 2010, as written. C. CITIZEN BUSINESS/ANNOUNCEMENTS: None. D. TRANSFER BUSINESS: 1. April 2010 Transfers - Record Nos. 30648 through 30697: The Commission reviewed transfers for the period of April 1 , 2010 through April 30, 2010. a. Current "M" Exemptions and Liens - No. 30667 Scott P. Allan and David Hoggard: The Commission authorized the placing of liens against the above-referenced purchasers' property as a result of their claiming the "M" exemption as first-time buyers of real property . b. Additional Information Required: The Commission asked staff to request a completed Form B, Part G from the sellers on the following transfers: No. 30655 26 SP Road LLC No. 30681 Frank E. Viano and Susan F. Viano Land Bank Commission May 11,2010 Page 2 c. Purchase Price Documentation Required: The Commission asked staff to request additional information arid/or supplemental documentation from the purchasers to support the stated purchase price on the following transfers: No. 30650 The Huntt-LaFrance Realty Trust No. 30661 James Bennett No. 30669 Samuel 1. Aloisi and Lynne M. Aloisi No. 30674 William 1. Colgan No. 30675 Curtis G. Wohlers No. 30681 Frank E. Viano and Susan F. Viano No. 30690 Michael A. Felger and Sara M. Underwood 2. "M" Exemption Update: a. Two-Year Domicile Non-Compliance/Waiver Request - No. 28953 Timothy Shea: Ms. Bell summarized the history of the transfer and presented a written request from the purchaser to waive the penalty and accrued interest due to circumstances of financial hardship. After a discussion of past decisions made on similar cases and based on the purchaser's good faith effort in payment of the fee, upon a motion made and duly seconded, the Cortnnission VOTED to waive the penalty asked staff to issue a Notice of Assessment for the remaining interest in the fixed amount of$2,216.67. b. Five- Year Domicile Non-Compliance/Payment Not Received - No. 25397 Jesse Dutra: Ms. Bell reported that despite numerous reminders, the purchaser failed to submit payment of the outstanding fee and penalty within the 6Q.day time period - a contingency which was specified in the Commission's decision to waive the interest on March 9, 2010. Upon a motion made and duly seconded, the Commission VOTED to reinstate the accrued interest from the date of transfer. E. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: The April 2010 transfer statistics were presented to the Commission. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly "seconded, it was VOTED to execute the May 11,2010 warrant document in the amount of $119,088.28 to be provided to the county treasurer. 3. Warrant Authorization - Latici House Demolition Permit: Upon a motion made and duly seconded, it was VOTED to execute the May 11, 2010 warrant document in an amount not to exceed $500.00 to be provided to the county treasurer. 4. Warrant Authorization - 2007 Series A Semi-Annual Bond Payment: Upon a motion made and duly seconded, it was VOTED to execute the May 11,20102007 Series A Semi- Land Bank Commission May 11,2010 Page 3 Annual Bond Interest Payment warrant to be provided to the county treasurer in the amount of $291,409.38. F. REGULAR BUSINESS: 1. Memorandum of Understanding - Town Conveyance of "Hunt Parcel": Pursuant to a Memorandum of Understanding with the Town of Nantucket dated January 27, 2010, upon a motion made and duly seconded, the Commission VOTED to accept and endorse the deed from the Town, conveying ownership of Lots 1,4 and 5 on Plan No. 2009-44 to the Land Bank. 2. Muskeget Island - Wind Data Tower Discussion: Commissioner Reinhard summarized proposed changes to the deed, legislation and conservation restriction submitted by Town counsel which would reserve the right for the Town to erect a temporary wind data tower on Muskeget Island. Based on the concern that these changes might jeopardize the entire transaction, upon a motion made and duly seconded, it was VOTED to authorize Mr. Reinhard to voice the Commission's opposition at the next Board of Selectmen meeting on May 12,2010. G. PROPERTY MANAGEMENT: 1. Multiple Vendor Requests - Management Discussion: Ms. Bell reported that there were two separate mobile ice cream vendors seeking permission to do business on Land Bank properties for the summer season. The Commission determined to continue the discussion at the May 25, 2010 meeting at which Mr. Savetsky would be present. Resource Planner/Ecologist Bruce Perry entered the meeting at this time. 2. Miacomet Golf Club Practice Chipping Area - Approval of Mitigation Fund Agreement: Mr. Perry summarized the changes to the original permit with the state as a result of the amendment required to add the practice chipping area at Miacomet Golf. Upon a motion made and duly seconded, the Commission VOTED to ratify the previously executed Mitigation Fund Agreement. 3. Latici Property - House Demolition: Mr. Perry reported that two price estimates for demolition of the Latici main house had been received and presented them to the Commission for consideration. Upon a motion made and duly seconded, the Commission VOTED to grant the demolition work to Atlantic Aeolus Corporation, authorizing the expenditure of $7,000, exclusive of tipping fees. 4. Craig Property - Permitting Update: Mr. Perry reported that a request had been filed with the Conservation Commission in order to expand the parking area at the Land Bank's Craig property . Annual Road Grading Review: Mr. Perry provided a brief review of the Land Bank's annual road maintenance needs and presented an estimate from Miles Reis to do the grading work for the summer season. Upon a motion made and duly seconded, the Commission VOTED to grant the work to Miles Reis for the total estimated amount of$17,900.
