(-] ~ "l MINUTES Nantucket Land Bank Commission Regular.Meeting of March 9, 2010 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts , CALL TO ORDER: 4:02 P.M. PRESENT: Johnson, Gardner, Reinhard. ABSENT: Bartlett, Stackpole. STAFF PRESENT: Eric Savetsky, Executive pirector; Jesse Bell, Administrator/Fiscal Officer; Susan Campese, Assistant Administrator. A. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related to land acquisition. RETURN TO OPEN SESSION B. CITIZEN BUSINESS/ANNOUNCEMENTS: None. C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was VOTED to accept, approve and release the regular session minutes of February 23,2010, as written. Resource Planner/Ecologist Bruce Perry entered the meeting at this time. Jesse and Hadley Dutra also entered the meeting at this time. D. TRANSFER BUSINESS: 1. Five-Year Domicile Non-Compliance - No. 25397 Jesse Dutra: Ms. Bell provided a brief chronology of events leading up to the placement of a lien against the purchaser's property due to his non-compliance with the "actual domicile" requirement of the "M" exemption on the above-referenced transfer. Mr. and Mrs. Dutra presented a request for a waiver of the fee, penalty and interest accrued or alternatively a transfer of the "M" exemption to their new property at 76 Hummock Pond Road, emphasizing that they did not fully understand the requirements of the "M" exemption when they claimed it, and further, that they continue to own the property and remain year-round residents of Nantucket. Jesse and Hadley Dutra left the meeting at this time. 2. Modification of Assessment - No. 25397 Jesse Dutra: After a discussion of past decisions made on similar cases and based on the purchaser's fulfillment of the five-year - Land Bank Commission .. March 9, 2010 Page 2 ownership requirement and continued status as a year-round Nantucket resident, upon a motion made and duly seconded, the Commission VOTED to waive the accrued interest since the date of the transfer subject to receipt of the outstandingfee and 'penalty in the amount of $5,000 within 60 days. 3. February 2010 Transfers - Record Nos. 30507 through 30573: ,The Commission reviewed transfers for the period of February 1, 2010 through February 28,2010. a. Current "M" Exemptions and Liens: The Commission authorized placing liens against the following purchasers' property as a result of their claimingtbe "M" exemption as first-time buyers of real property: No. 30525 Jared M. Chretien and Rachel K. Day No. 30571 Robert D. Dickinson and Jamie T. Dickinson b. Additional Information Required: The Commission asked staff to request additional information and/or supplemental documentation from the purchasers to support the exemptions claimed on the following transfers: No. 30517 Alan H. W. Shiff Revocable Trust No. 30518 Carol S. Shiff Revocable Trust c. Purchase Price Documentation Required: The Commission asked staff to request additional information and/or supplemental documentation from the purchasers to support the stated purchase price on the following transfers: No. 30549 127 Wauwinet, LLC No. 30555 Richard L. Cumbie No. 30557 Michael W. Mirabelli and Victoria Mirabelli 4. Transfer Update: a. Additional Information Provided - No. 30403 Nicholas Heras, Jr.: Based upon the submission of a satisfactorily completed Form B, the Commission found the above- referenced transfer to be in order. b. Purchase Price Documentation Required - No. 30454 GWK New Mill Nominee Trust: Based upon the submission of the requested documentation in support of the stated purchase price, the Commission found the above-referenced transfer to be in order. E. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: The February 2010 statistics were presented to the Commission. Land Bank Commission March 9,2010 Page 3- ~ 2. Warrant Authorization - Cash Disbursenients: Upon a motion made and duly seconded, it was VOTED to execute the March 9, 2010, warrant document in the amount of $65,578.33 to be provided to the county treasurer. 3. Notice of Future Expenses: Mr. Savetsky reviewed some previously unanticipated expenses ~th the Commission, inclu~g the installation of a new heating system at the Bamber House, along with the need for a new copy machine and phone system repairs at the Land Bank ' office. F. PROPERTY MANAGEMENT: 1. Burchell Property- Use Request: Mr. Savetsky presented a written request from Daniel Baird, an experienced grain and potato farmer from Nova Scotia, to lease 2 to 3 acres of the Burchell property which abuts his property on Appleton Road to do some organic family farming. The Commission responded favorably to the concept, provided there is a public education component incorporated into the lease in exchange for his use of the property, and asked Mr. Perry and Mr. Savetsky to continue explore the possibility with Mr. Baird. 2. Sanguinetti Property -Trail Construction Modification: Mr. Perry requested permission from the Commission to modify the trail route in order to rninimi7,e the disturbance of the wetlands, indicating that in this scenario, boardwalk construction would be reduced from 490 to 240 feet. Upon a motion made and duly seconded, the Commission VOTED to approve the proposed trail changes and authorized Mr. Perry to seek a modification of the permit issued by the Conservation Commission for this project. 3. Coffin Setoff - Memorandum of Understanding with Town: Mr. Savetsky updated the Commission on discussions with the Town regarding the continuing legal expenses incurred by the Town for the Madequecham land swap and indicated that Town Manager Libby Gibson and Selectman Chairman Michael Kopko were interested in having a meeting with Mr. Savetsky and Land Bank Chairman John Stackpole to discuss the issue. Vice Chairman Leslie Johnson offered to be available if Mr. Stackpole was away for the scheduled meeting. 4. Gaillard Property - Building Renovation: Mr. Perry updated the Commission on the Gaillard barn renovl;ltion and recommended that the Commission approve the expenditure of additional funds now rather than later to complete the project. The Commission agreed with Mr. Perry and upon a motion made and duly seconded, it was VOTED to authorize the expenditure of$10,900 for Kyle Snell to finish rebuilding the door and other two walls of the barn and $4,000 for T & T Roofmg to do the shingling. 5. 2009 Annual Smooth Hummocks Advisory Committee (SHAC) Report: Mr. Perry presented the recently completed annual SHAC report detailing management and monitoring activities and funding compliance as required by the Miacomet Golf Course Conservation Permit. 6. Ray Boathouse - Building Move Update: Mr. Savetsky reported that moving the Ray - Land Bank Commission .. , March 9, 2010 Page 4 ~ Boathouse to Jackson Point was no longer an option due to a restrictive agreement the Town had with abutter Alfred Sta.ntey, however the Admiralty Club was now interested in receiving the building and given their location in Madaket, Mr. Perry thought the Historic District Commission (H.D.C.}would approve the move, off to that location. Upon a motion made and duly seconded, the Commission VOTED to ittcurthe costs of moving the building to the Admiralty Club~s propertY and authorized Mr-Perry to seek the necessary permission from the H.D.C. for the relocation. 7. Consue Springs - Invasive Species Removal: Mr. Perry reported that the permit application for the Phragmities removal at Consue Springs was on the agenda for the next scheduled Conservation Commission ni~;on,March 17, 2010. 8. Latici Property - House Removal: Mr. Perry reported that the permit application for the removal of the house from the. Latici property ,was on the agenda for the next scheduled Conservation Commission meeting on March 17, 2010. 9. ChippinglPutting Area - Permitting Update: Mr. Perry summarized the application which was sent to Natural Heritage in order to amend the existing permit with the state for the installation of a new chipping/putting area at Miacomet Golf.
