PRJ':SENT: Bartlett, Johnson, RcinllJrd, Stackpole. ABSENT: Gardner. 1\. CITIZEN BUSINESS/ANNOUNCEfvfENTS: The Director reported that a written lctter along with a $250 donation "var. received ('rom Barry and Peggy Berman of 28 North Liberty Strcct thanking the Land Bank for the irnprovcmcnJs made to the Lily Pond/Blair HOllse and for "all you do to make Nantucket a better l,lacc for everyone." The Commission asked the Director to send a letter to thc IkrnJan's thanking Ihelll for their donation and positive feedback. B. APPROVAL OF 1UNUTES: Upon a motion made and duly seconded, it was VOTED to accept, approvc and release the regular session minutes of August 25, 2009, as written. C. PROPERTY MANAGEt-..1ENT: 1. Nobadecr Farm Roau n Parks & Recreation License Agreement: Upon a motion made and duly seconded, it was VOTED to authorize and execute the ten-year license agreemcnt with the Town of Nantucket, acting through its Park and Recreation Commission, for the Nobadeer Farm Recreation Facility subject to ptlymcnt of an annual license fec of $2,400, a liability policy inc1udin8 the Land Bank as n:lll1cd in;;urcd, and compliance with the requircments of the Laud Bank's Conservation and Management Pennit No. 008-126.DI'W. 2. Great Harbor Yacht Club Floats: Commissioner Stackpole indicated that Frank Balester donated two 7' by 20' floats to the Land Bank and asked slaffto determine if they could be used to replace the existing float8 at the Walker or Sha1l1C propcrty. D. TRANSFER BUSINESS: 1. Transfer Hearing Dccision and Determination - No. 242'P Jivko V. Kalpazanl)v and Anna Kalpazanova: Pur~;uant to the requirements of MassachuscHs General Court Acts of 1983, Chapter 669 (the "Act"), as arncndcd, Section 14(a), ancr a discussion of the mattcr, a review of the proposed decision and determination, and aIleI' a hearing held 4:00 P.M., Tuesday, August. 25,2009, at the Land Bank :tvlceting Room, 22 Broad Street, Nantucket, the Commission entered a decision and determination. Upon a motion made and duly seconded, it was VOTED tlUlt the Decision and Determination as presented arc consistent \vith the instmctions provided to statTby the Commission and therefore it was accepted ::IS presented. A copy of the signed Decision and Determination shall be attached to the minutes of tbislIlceting and incorporated therein by rcfcrenct~. The vote was Illlann1101lS. 2. Current "M" Exemptions and Liens: The Commission authorized placing liens against the following properties as a result of the purchasers claiming the "M" exemption as first- time buyers of real property: No. 30026 Lee-Jay Hurley and Richard C. Ross No. 30057 Christopher C. Bouque No. 30059 James E. Grieder and Katharine Robinson Grieder b. Purchase Price Low - No. 30050 Zeta Real Estate Management II, LLC: The Commission asked staff to request additional information and/or documentation from the purchaser to support the stated purchase price on the above referenced transfer. 3. Transfer Update: a. Additional Information Provided: Based upon the additional information provided by purchasers' attorney as to the underlying ownership interests in the purchaser-trusts, the Commission found the following transfers to be in order: No. 29997 Harris Family Realty Trust No. 29998 Lundin Family Nominee Realty Trust E. FINANCIAL BUSINESS: I. Monthly Transfer Statistics: The August 2009 transfer statistics were presented. 2. Warrant Authorization':"" Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to execute the September 8, 2009 warrant document in the amount of $66,794.71 to be provided to the county treasurer. F. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related to approval of the minutes and land acquisition.
