Special Town Meeting Article Review ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of August 11, 2009 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:02 P.M. d \-0 PRESENT: Gardner, Johnson, Reinhard, Stackpole. ABSENT: Bartlett. = A. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to gQ;i;hto Executive Session. Each member was polled individually. All members voted yes. The ChaiI:man noted that the Commission would reconvene into regular session and that the purpose of gomg into executive session was to discuss matters related to approval of the minutes and land acquis!?on. ..s Commissioner Bartlett entered the meeting at this time. RETURN TO OPEN SESSION B. CITIZEN BUSINESS/ANNOUNCEMENTS: None. c. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was VOTED to accept, approve, and release the regular session minutes of July 28,2009, as written. D. PROPERTY MANAGEMENT: 1. Cisco Beach Property - Use Requests: The Director presented a request on behalf of high school student Carolyn Powers to hold a small surfing competition for her senior project at the Land Bank's Cisco Beach property on Sunday, August 23,2009 from 10 a.m. to 1 p.m. with anticipated attendance of 40 people to benefit the Massachusetts chapter of Surfrider Foundation. Upon a motion made and duly seconded, it was VOTED to approve the request subject to participants signing agreements releasing the Land Bank from liability. 2. Latici Property - Use Request: The Director presented written correspondence from Bruno Latici requesting an additional extension of his lease of the property which expired on June 24, 2008. Upon a motion made and duly seconded, the Commission VOTED to allow Mr. Latici to remain at the property until November 15,2010 3. Reith Property - House Disposition: Resource Planner/Ecologist Bruce Perry initiated a discussion on the disposition of the house at the Reith property and indicated that he'd received inquiries of interest from the Town and Cheryl Pizzo. Commissioner Johnson indicated that Miacomet Golf was still interested in relocating the barn/garage. E. TRANSFER BUSINESS: 1. Transfer Record Nos. 29964 through 30024: The Commission reviewed transfers for the period of July 1, 2009 through July 31, 2009. Land Bank Commission August 11, 2009 Page 2 a. Current "M" Exemption and Lien - No. 29990 Leslie W. MacDonald: The Commission authorized placing a lien against the above-referenced property as a result of the purchasers claiming the "M" exemption as first-time buyers of real property. b. Additional Information Not Provided: The Commission asked staff to request additional information and/or documentation on the following transfers: No. 22276 76 Goldfinch Drive Realty Trust No. 29970 Donald and Jere C. Freedman No. 29997 Harris Family Realty Trust No. 29998 Lundin Family Nominee Realty Trust No. 30008 Joseph P. and Kathleen Anne Baird c. Purchase Price Low: The Commission asked staff to request additional information and/or documentation from the purchasers to support the stated purchase price on the following transfers: No. 30021 Scott C. and Jasmine Milligan No. 30022 Jennie H. Voorhees and Michael J. Hamill 2. "M" Exemption Update: a. Transfer Discussion - No. 26306 Andrew and Jacqueline Moyer: Ms. Hunter presented written correspondence dated August 5, 2009 from Attorney Richard P. Beaudette regarding his clients' ability to comply with the five-year home ownership requirement of the "M" exemption and requesting a waiver of the penalty and interest that would become due at the time of the proposed sale of the second unit at their 1 Cynthia Lane property. Based on a previous vote at the meeting of April 14, 2009, upon a motion made and duly seconded, the Commission VOTED to waive the penalty and interest and executed a Release of Lien to be provided to the purchasers subject to receipt of the outstanding Land Bank fee in the amount of $4,000. F. FINANCIAL BUSINESS: 1. Monthly Transfer Statistics: The July 2009 transfer statistics were presented. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to execute the August 11,2009 warrant document in the amount of $72,908.32 to be provided to the county treasurer. G. REGULAR BUSINESS: 1. Special Town Meeting Article Review: The Director reported that there were several articles mentioning the Land Bank which would be on the warrant for the Special Town Meeting on September 21, 2009. If approved, Article 24 would allow the town to grant a conservation restriction to the Land Bank facilitating compliance with the mitigation requirements put forth by Natural Heritage in connection with the Town's proposed industrial park; Article 25 would authorize the Land Bank to potentially acquire road layouts as proposed and submitted by Planning Director Land Bank Commission August 11, 2009 Page 3 Andrew Vorce; and Article 26 would authorize the Land Bank to exercise its eminent domain power to acquire access across private beachfront property located on Western Avenue in Surfside as part of the Town's "one big beach" effort to make all Nantucket beaches open and accessible to the public.
