Community Preservation Committee - Member Appointment ADJOURNMENT MINUTES Nantucket Land Bank Commission Regular Meeting of May 12, 2009 Land Bank Meeting Room, 22 Broad Street Nantucket, Massachusetts CALL TO ORDER: 4:05 P.M. PRESENT: Johnson, Reinhard, Stackpole. ABSENT: Bartlett, Gardner. A. EXECUTIVE SESSION: Upon a motion made and duly seconded, it was VOTED to go into Executive Session. Each member was polled individually. All members voted yes. The Chairman noted that the Commission would reconvene into regular session and that the purpose of going into executive session was to discuss matters related to land acquisition. RETURN TO OPEN SESSION B. CITIZENS BUSINESS/ANNOUNCEMENTS: None. C. APPROVAL OF MINUTES: Upon a motion made and duly seconded, it was VOTED to accept, approve, and release the minutes of April 28, 2009, as written. D. PROPERTY MANAGEMENT: 1. Miacomet Golf Course: Commissioner Johnson initiated a discussion concerning bike path safety, specifically with regard to the lack of screening along Hole 16 of the course that runs along Bartlett Road, and reported that she would obtain an estimate for the purchase and planting of additional trees. 2. Fair Street Property - Project Update: The Director reported that the Commission on Disabilities would be appearing before the Board of Selectman to discuss the handicap accessibility issue caused by the parking along the sidewalk on Fair Street. 3. Annual Dirt Road Maintenance Review: Property Planner Bruce Perry provided aerials outlining the maintained dirt roads across Land Bank properties and presented a cost estimate for the annual grading and filling ranging from $19,000 to $22,000. Commissioner Stackpole requested that the Angler's Club property off Cliff Road be included in this year's road maintenance as previously voted by the Commission. Upon a motion made and duly seconded, it was VOTED to proceed with the dirt roads maintenance as presented. 4. Gaillard Property - Lease Request: The Director presented a request from the Marine Department to lease the Gaillard House for the 2009 summer season for the housing of three marine biologists. Upon a motion made and duly seconded, it was VOTED to approve the leasing of the main house to the Marine Department until October 1, 2009, with rent set at an amount to be determined based on the cost of utilities. 5. Miacomet Beach - Use Request: The Commission considered a request submitted by Pamela Patton to hold a catered family clambake at the Land Bank's Miacomet Beach property on Friday, July 3, 2009 from 5 p.m. to 8:30 p.m. with table seating for 25 people. Upon a motion made and duly seconded, it was VOTED to approve the request subject to the property being left clean of any trash or debris that might be caused by such use. . Ladies Beach - Use Request: The Commission considered a request from Susan Warner of Nantucket Clambake to hold a family clambake at the Land Bank's Ladies Beach property on Saturday, August 22,2009 from 6 p.m. to 9 p.m. with table seating for 40 to 50 people. Upon a motion made and duly seconded, it was VOTED to approve the request as presented. 7. Gardner Property - Use Request: The Commission considered a request from the Equestrian Center to place horse jumps on the southerly end of the fields at the Gardner property from early June to mid August. Upon a motion made and duly seconded, it was VOTED to approve the request as presented. 8. Chase Cottage - Removal Discussion: Mr. Perry reported that Madaket resident Ted Jennison contacted the Land Bank with an interest in relocating the Chase cottage to his property in the area. The Commission determined to consider the request and asked Mr. Perry to file the appropriate permits for its relocation. E. TRANSFER BUSINESS: 1. Transfer Record Nos. 29786 through 29837: The Commission reviewed transfers for the period of April 1, 2009 through April 30,2009. a. Current "M" Exemption - No. 29808 Christopher P. Connolly and Jurgita Budaite: The Commission authorized placing a lien against the property as a result of the purchasers claiming the "M" exemption as first-time buyers of real property. b. Additional Information Not Provided: The Commission asked staff to request additional information and/or documentation to support the purchasers' claim to an exemption from the Land Bank fee for the following transfers: No. 29798 Henry B. Sheets 2004 Trust No. 29803 LLD Realty Trust No. 29804 LLD Realty Trust 2. Transfer Update: a. Additional Information Provided: The Commission found the following transfers to be in order based upon the additional information and/or documentation provided: No. 29693 Richard E. Behrman QPRT # 1 No. 29680 Richard E. Behrman QPRT # 2 No. 29681 Richard E. Behrman QPRT # 3 No. 29682 Richard E. Behrman QPRT # 4 3. "M" Exemption Update: a. Adjustment Paid 3rd Payment Received - No. 27919 Ryan Chadwick: Ms. Hunter informed the Commission that Ryan Chadwick's third payment in the amount of$I,OOO was received, leaving a balance of $832.45 to be paid before his release of lien can be provided. . Land Bank Commission May 12, 2009 Page 3 F. FINANCIAL BUSINESS: l.Monthly Transfer Statistics: The April 2009 transfer statistics were presented. 2. Warrant Authorization - Cash Disbursements: Upon a motion made and duly seconded, it was VOTED to approve and execute the May 12,2009 warrant document in the amount of $208,797.82 to be provided to the county treasurer. 3. Warrant Authorization - 2007 Series A Semi-Annual Bond Payment: Upon a motion made and duly seconded, it was VOTED to execute the May 12,20092007 Series A Semi-Annual Bond Interest Payment warrant to be provided to the county treasurer in the amount of$305,159.38. G. REGULAR BUSINESS: 1. Community Preservation Committee - Land Bank Member Appointment: The Director informed the Commission of Polly Miller's resignation as Community Preservation Committee Land Bank representative, and that Ms. Miller had forwarded what was expected ofC.P.C. members by electronic correspondence for the Commission's review. The Commission determined to the review the expectations and appoint a new representative at the next meeting. ADJOURNMENT: Upon a motion made and duly seconded, it was VOTED to adjourn at 4:53 P.M.
