Commissioners Present were William Willet, Granville Cranston, Henry Wasierski, Lee Dunn, Dan Kelliher and Peter Dunwiddie (arrived at 8:25 PM). Others present were Ben McKelway, Administrator and Bruce Perry, Secretary. ~ COMMENTS AND QUESTIONS FROM PRESS AND PUBLIC NONE ~. PUBLIC HEARINGS 1. David Jay - Quaise Pasture Road - NAN90-006 (26-20.3) Present were the applicant David Jay and Melissa Philbrick, counsel. Mr. McKelway states that the State has discarded the original filing by the Jays due to the lack of response from them within six months. The hearing will be under the local by-law only and the Jay's have already filed a new NOr with the state that could be discussed at the next meeting, he adds. Mrs. Philbrick adds that when the new file opens next meeting, she will request that all the information that has been presented in all the previous hearings be brought into the new NOl. She adds that the original Notice has been amended to include only the driveway location. Mr. Jay shows the Commission some colored plans and explains the project. He states that approximately half of the fifty acres is wetlands and the proposed driveway encroaches on the 25 foot undisturbed buffer in two places. At the cuI de sac, the road and a culvert encroach ten feet into Bordering Land Subject to Flooding, he says, but compensatory flood storage volume will be will be provided in the form of swales. Mrs. Philbrick states that the applicant had been in front of the Planning Board on Tuesday and they still want the road paved. There had been some discussion concerning a "trigger mechanism" that would require the road to be paved only after the construction of a certain number of houses, but, said Ms. Philbrick, the Board is worried that the further away the :.~-~~~~ 4 Town of Nantucket Conservation Commission (508) 228- 7230 6 Chestnut Street Nantucket, Massachusetts 02554 Meeting Minutes May 31, 1990 Page 2 developer gets from the project, the less likely it is that the improvements will be done. Also in the new NOI is some information concerning the drainage calculations for the road, and she adds that she would like the Commission to comment within the next two weeks so that the engineers could respond. She promises to give a copy of the Planning Board staff recommendation to the Commission. Mr. Wasierski comments that the road is in the first wetland. Mr. Jay responds that the designed right of way is as close to the property line as possible, although it is laid out to be 40 feet wide. The intent is to put the drive as close to the edge of the right of way as possible. Mr. Wasierski asks what makes the road stay out of the wetland within the 40 foot layout? Mrs. Philbrick states Order of Conditions. that the location could tie ill It ~-- 11-! the Mr. McKelway reiterates that although there are proposed house sites and septic system locations on several plans in the file, these are not included in the NOI now before the Commission. Mrs. Philbrick agrees. Mr. Jay said that his family has discussed the possibility of selling a portion of the tract to the Nantucket Conservation Foundation, but no agreement has been reached. The application is just for the road. Mr. Dunn asks if any of the lots crEated would need a wetland crossing to provide access ? Mrs. Philbrick shows the Commission the change in location of one of the lot lines that would prevent the need for a wetland crossing. MOTION: To continue the hearing for additional information and the opening of the State NOI at the request of the applicant was made and seconded. Francis - 39 Dukes Road SE48-590 (56-328) *** NOTE: All the Francis NOI were discussed concurrently *** Present for the applicant was Bob Emack of Nantucket Surveyors. Mr. Emack states that the septic easement is not in place at the present time and adds that it would be ineffectual due to the fact that Ms. Francis owns both lots and she could easily remove the easement before the lots sold. He suggests that the Commission identify the plan in the Order of Conditions. r-ir. Wasierski agree,s, commenting that if the Plan for the septic leach location is identified in the Order, then there is no other way to install it without coming back to the Commission. For the draft of the Order of Conditions to be prepared for the next meeting, there was discussion about making the easement a condition, requiring the plan to be recorded with the Order, and requiring an acceptable easement to be submitted to the Commission before work begins. MOTION: To close the hearings for the two state NOr (SE48-589 & 590) and the local NOI (NAN89-003) was made and seconded. UNANIMOUS 3. Present was Melissa Philbrick. Mr. McKelway states that he had talked with Jim Mahala at DEP, who had stated that altering a Bordering Vegetated Wetland (BVW) would require replication. Brushcutting and mowing in BVW are considered wetland alterations, he reported, so such work must meet the performance standards. However, if a Commission were to decide that replication would be counterproductive, the DEP would take that into account, on a case-by-case basis, in their decision whether or not to appeal the Ccncom's decision. MOTrON: To continue the hearing at the request of the applicant was made and seconded. UNANIMOUS 5. VanGreenby - Long Pond Drive - SE48-587 - (59-17) MOTrON: To continue the hearing at the request of the applicant was made and seconded. UNANIMOUS 6. Robert - Beechwood Road - SE48-588 (25-37) Commissioner Willet abstains from the discussion and vote. Present for the applicant was John Shugrue. Mr. McKelway asks if the dirt pile that was piled near the wetland has been removed? Mr. Shugrue states that the pile will remain there until the Order of Conditions has been issued by the Commission. Mr. Wasierski responds that he was under the impression that the pile would be moved by this meeting. It had been discussed at the field inspection and during the last meeting. Mr. Shugrue stated that he wanted to dispute the NOI filing fee that the Commission's staff had recommended. He states that he feel the fee should be Category 1 - an addition to a single family dwelling. Mr. Perry contends that the fee should be Category 2 - a new dwelling on the property. The building has its own septic system, cooking facilities, bathrooms and meets a majority of the criteria under the Town's zoning by-law ("Dwelling - A room used or intended to be used by one (1) family or household for living, sleeping, cooking, or eating.") and while there is no space designated as a bedroom on the plan, there is space available for sleeping. Mr. Shugrue states that the building is only one room and it will not be used for sleeping. Mr. Dunn responds that the Gillies out in Wauwinet just made a case before the Commission that because there are ten people sleeping in the house in the summer in three bedrooms including the loft, the septic replacement should be designed for five bedrooms. He asks if the door can be locked? Mr. Shugrue responds affirmatively and that the enclosed space is that of a 27-foot octagon -- approximately 1,000 square feet. MOTION: To consider the NOI as a Category 2 filing was made by Mr. Dunn and seconded by Mr. Wasierski. Mr. Wasierski asks if the building permit stated that the structure was not for human habitation? Mr. Shugrue states that the building permit was issued for a pool house. In favor: KELLIHER, CRANSTON Abstain : DUNN Ms. Cheryl Creighton, of the Nantucket Land Council, comments to the Commissioners that it was unfortunate that they did not decide to follow the staff's recommendation on the structure because the building could be used for habitation. Furthermore, she said, here was a clear opportunity to impose a fine for a violation. The project was begun without an application or a permit. Unlike questionable violations uncovered 10 years later, this is here and new. Imposing a fine would not have been arbitrary, she said. Because of such leniency the community is not taking the Commission seriously. * 9. GrEenhill - Hoick's Hollow Road - (23-1) Present for the applicant were John Shugrue and Melissa Philbrick. Mrs. Philbrick states that the new NOI is to relocate the driveway, abandon the old drive, and validate the work that was done without a permit at the existing house. She adds that the centerline of the proposed driveway location is flagged with red flags and the location was moved at the recommendation of the landscaper to avoid some trees. Mr. Dunn states that this change moves the driveway closer to the bank and adds that the regulations state only the minimum requirements and that on this large lot there should bE plenty of room to keep the drive away from the bank. Mr. Richard Vogt of 30 Quidnet Road states that this development is large and is being put through piecemeal. The bank is steep with waterfowl nesting at its base and the runoff from the road will go down the bank also, he adds. He reiterates his concern at the piecemeal process, adding that it is an enormous single family project and the worst case for the pond due to the method of filing. Mrs. Philbrick responds that due to the positive Determination and community concerns, the plans for the house are being redrawn; they will not be ready until the fall. She disagrees that the filings are being presented in a piecemeal manner. The driveway complies with all state and local regulations, and the remaining vegetation will screen the drive from the pond edge, she contends. Mr. Dunn states that almost the entire driveway is planned to be within 50 feet of the bank. He says the 25-foot undisturbed buffer is to be considered only if necessary, not as a guideline as to how close a drive could be to a resource area. There are plenty of other ways to get to the houses on the property. Mr. Wasierski states that wildlife interests should be addressed, due to the fact that the drive is within 30 feet of the bank and the buildings are proposed within 100 feet of both banks. Mrs. Philbrick comments that there lS adequate vegetation for the wildlife concerns. Mr. Kelliher comments that if the topography Df the area requires that the drive be located where proposed, then it might be alright. But if it is located there for views or other reasons then it should be moved. Mr. Dunn states that the Commission needs to look at the entire project including the Existing house that is within 50 feet of the bank. Mr. Wasierski adds that the Commission is already bending over backwards handling the unpermitted work already done, and it is time that the applicants give something back to the Commission. Mr. Vogt asks the composition of the road. Mr. Shugrue responds that it will be gravel. Presently there is a noise-activated security system that turns on a number of bright lights at night, and this needs to be addressed as to its impact on wildlife, he comments. He also voiced concern about the impact of the large platforms at the edge of the water, stating that the Greenhills had hosted many people the previous weekend, and several boats were on the water in the vicinity of the dock. Mr. Cranston pointed out that the other side of the pond has already been developed with large houses. Mr. Vogt acknowledged this, but maintained that is no excuse for building up this side of the pond as well. He said he IS very concerned with what the overall building program will look like when it is completed. Mrs. Philbrick states that people still have the right to do what they want with their own land. She said it is better for the development to be concentrated in one area than to spread out over a largE tract of land. She said zoning would allow many more buildings, and larger ones. Mr. McKelway interrupted Mrs. Philbrick to say that is the third time she has made a veiled threat that the land could be subdivided and fully developed if the Greenhills so choose. He asked what is to prevent them from doing so after they get the permits they are requesting now. He then asked if the Greenhills have considered a conservation restriction for the rest of their property. Mrs. Philbrick said the Greenhills have not considered a conservation restriction, as far as she knows. Mr. McKelway then suggested that the Commission request a full accounting as to exactly how the land could be developed to its maximum potential under present zoning rules. If this is going to keep coming up, he explained, the Commission should know what is a real possibility and what is not. Mr. Dunn agrees, recalling that Mrs. Philbrick had mentioned it before. ~C"',~ Town of Nantucket Conservation Commission . (508) 228- 7230 6 Chestnut Street Nantucket, Massachusetts 02554 Meeting Minutes May 31, 1990 Page 9 Mrs. Philbrick acknowledges potential problems with subdividing and developing the property, due to the access issue and the location of wetland resource areas. She points out that the current NOI is for the driveway, which is permittable under current regulations. Mr. Dunn responds that what the regulations do not consider is the perceived quality of the property. In this case, there does not seem to be any necessity to go to the minimums allowed in the regulations. Ms. Cheryl Creighton states that the Commission needs to consider the cumulative impacts of each piece of the project, and the driveway is one of those impacts. Mrs. Philbrick states that she will go back to the Greenhills with the Commissionls concerns, but that she can present a plan that they will approve of also. __1. , Ull.L- Y Mr. McKelway states that Mrs. Philbrick's comments tonight indicate that if the Commission were to approve the project with the condition that the driveway be moved further away from the pond, the Order of Conditions may be appealed. For that reason, it is important to get specific evidence as to the wildlife impacts of the driveway on record during the public hearing process. He reminded the Commission that they can hire a scientist to do a wildlife evaluation and then bill the Greenhills for the study -- up to $2,500. Mrs. Philbrick said the Greenhills want to cooperate with the Commission and would not appeal the Order of Conditions. Stevens - Old Quidnet Milk Route - (20-53) Present for the applicant was Eric Urbahn. Mr. Willet reads the inspection report. MOTION: To issue a negative Determination as recommended in the inspection report was made and seconded. UNANIMOUS * b. Cairnes - Polpis Road - (25-32.2) Present was the applicant Rhoda Weinman. Mr. Willet reads the inspection report that recommends a positive Determination. MOTION: To issue a positive Determination for the property as recommended by the inspection team was made and seconded. UNANIMOUS * c. Stojack - Hummock Pond Road - (56-311) Mr. Willet reads the inspection report which recommends a negative Determination with a condition that the dirt be stored offsite or away from the wetland and hay bales be placed between the wetlands and the proposed work. Mr. Dunn asks if the property lS flat? Mr. McKelway responds that it was. Eilene McGrath, an abutter, asks what happens when she comes in to build on her empty lot with the septic located as proposed ? Mr. Dunn responds that the Board of Health regulations do not address wells and septic systems that are not in the ground. MOTION: To issue a negative Determination with the conditions that a siltation fence be located 15 feet away from the work and that the excavated dirt be located away from the wetland or taken offsite was made and seconded. UNANIMOUS * d. Wauwinet House - Wauwinet - (11-17) Present for the applicant were Melissa Philbrick and Jim Gay of Engineering Management Consultants, Inc. Mr. Say explains the project, stating that the existing stone dust will be taken up and be replaced with stone and sand with a wood border, designed to still be pervious between the flagstones. Mr. Dunn asks how much of the project will be in the wetland? Mr. Gay responds that approximately 60-70 percent, with the remaining amount being in the buffer. Mr. Willet comments that it will not be a great change from existing conditions. MOTION: To issue a negative determination with the conditions that the work is to be done by hand and that a siltation fence be placed on both sides of the footbridge was made and seconded. UNANIMOUS 2. ORDER OF CONDITlONS a. Hartrick - 31 Baxter Road - SE48-591 (49.2.3-8) Present was David Wiley, agent. 1lII'~ Town of Nantucket Conservation Commission (508) 228-7230 6 Chestnut Street Nantucket, Massachusetts 02554 Meeting Minutes May 31, 1990 Page 12 Mr. Wiley suggests that Condition # 3 be eliminated from the Additional Special Conditions. He comments that there has been no response from the Mass. Heritage program concerning this project. Mr. McKelway adds that the project is about 600 feet from the beach and potential nesting areas. He said he is not sure how far into dune areas piping plovers tend to nest. He explained that the reason this condition is used for stairways is because the noise during the construction may affect the birds. Mr. Wiley expressed doubt that the construction could affect the birds, commenting that there is work being done on a house next door to this project. Mr. Dunn said the construction could be done in a day or so. Mr. Wasierski pointed out that people will be walking from the bottom of the stairway across public land, destroying dune grass. MOTION: To remove Condition # 3 and issue the Order as amended was made and seconded. Mr. Wasierski opposed. All others in favor. ADDITIONAL SPECIAL CONDITIONS MICHAEL AND JANE HARTRICK DEP FILE NUMBER SE48 - 591 ASSESSOR'S MAP 49.2.3, PARCEL 8 31 BAXTER ROAD UNDER THE MASSACHUSETTS WETLANDS PROTECTION ACT ( MGL CHAPTER 131, SECTION 40 ) AND THE WETLANDS BYLAW OF THE TOWN OF NANTUCKET ( CHAPTER 136 ) 3. No cutting of vegetation is allowed except beneath and within one foot of the stairway before or during construction and to keep brush off the stairs in the future. The landing shall be no larger than 9 feet by 9 feet. No gazebo or cabana is allowed. Railings are required. 5. Contrary to the final approved plan, the closest vertical distance from the stairway to the soil shall be 18 inches, in order to achieve an approximate average of 2 feet between the stairway and the soil. 6. Members, employees, and agents of the Commission shall have the right to enter and inspect the premises to evaluate compliance with the conditions and performance standards stated in this Order, the Nantucket Wetlands Bylaw, the Regulations promulgated under the Bylaw, the Massachusetts Wetlands Protection Act, and pertinent Massachusetts regulations (310 CMR 10.00 through 10.99). The Commission may require the submittal of any data deemed necessary by the Commission for that evaluation. 7. The applicant, owners, successors or assignees shall be responsible for maintaining the stairway site, assuring the lasting integrity of vegetative CQvet- on the site and monitoring site activities so as to prevent erosion, siltation, sedimentation, chemical contamination or other detrimental impact to anyon-site or off-site resource area. It shall be the responsibility of the property owner of rEcord to see that the maintenance conditions are complied with as required by this order. 8. This document shall be included in all construction contracts and subcontracts dealing with the work proposed and shall supersede other contract requirements. 9. Used petroleum products from the maintenance of construction equipment, construction debris, and unused paint and paint- related products shall be collected and disposed of responsibly off the site. No on-site disposal of these items is allowed. 10. Any refuse material found on the site shall be disposed of at an approved landfill and in no case may these materials be buried or disposed of in or near a wetland. 11. CERTIFICATE OF COMPLIANCE Mr. McKelway explains what the Barnstable and Westport Conservation Commissions are doing concerning the enforcement of expired Orders of Conditions for which no Certificate of Compliance has been issued. a. Bewkes - 13 Crow's Nest Way - SE48-98 (12-19) Commissioner Dunn abstains from the discussion and the vote. Mr. McKelway reports that attorney Ted Tillotsen has requested this matter be continued until the files of the Historic District Commission could be checked for the HDC- approved plan. He said MI. Tillotsen told him that Mrs. Bewkes does not have the plans after all. He adds that the Commission has received a letter from Nelson Jones stating that there has not been any additional work on the house since the addition was constructed. MOTION: To issue the Certificate of Compliance as requested was made and seconded. UNANIMOUS b. Morton - Wauwinet Road - SE48-282 (12-14) MOTION: To continue at the request of the applicant was made and seconded. UNANIMOUS c. Wauwinet House - Wauwinet - SE48-392 (12-46) Present for the applicant were Melissa Philbrick and Jim Gay. He states that the work has been done and it is time to issue the Certificate and adds that he came down to the meeting specifically to answer any questions and get this issued. There was further discussion among the Commissioners concerning the project. Some stated they did not know enough about the project to issue a Certificate at this point. It was decided that Mr. Gay and McKelway would review the file and decide if the project was completed properly. MOTION: To continue the request for a Certificate of Compliance at the request of the applicant was made and seconded. UNANIMOUS d. Williams - Wauwinet - SE48-210 - (12-4) Mr. McKelway states that he has received the as-built plan from the Health Department as requested by the Commission, and it seems to be in compliance. He said the staff found that the Order had been recorded and the file now has proof of that. MOTION: To issue the Certificate of Compliance was made and seconded. UNAN I t-1QUS e. Keates - Wauwinet - SE48-149 (11-27.4) Mr. Dunn abstains from the discussion and vote as a Commissioner and is acting as agent for Mrs. Keates. Mr. Dunn submits an as-built plan for the property as the Commission had requested at the last meeting. He adds that while the septic tank is within the jurisdiction of the Commission, the leaching trenches are well outside. He comments that the Commissioners in 1980 had only held up the Compliance for more vegetation around the house, they did not care about the stairs, only that they were built on the bank. UNANIMOUS f. Smith - Wauwinet - SE48-141 (12-7) Mr. McKelway states that this project looks OK. He said it was unintentionally left off the agenda for the last meeting. MOTION: To issue the Certificate of Compliance was made and seconded. UNANIMOUS g. Huffman - Jefferson Ave. - SE48-384 (30-45) Mr. McKelway explains the project. MOTION: To issue the Certificate of Compliance was made and seconded. UNANIMOUS h. Greenleaf - 3 Hulbert Ave. - SE48-395 (29.2.3-06) Present for the applicant was Bob Emack of Nantucket Su.rveyors. Mr. Willet reads the inspection report. Mr. Emack states that the area had been replanted after the 1988 inspection by the Commission. lt seems that he has a hard time getting the beach grass to su.rvive. MOTION: To deny the request for a Certificate of Compliance and send a letter to the applicant stating that the area needs to be successfully revegetated was made and seconded. UNANIMOUS i. MOTION: To issue the Certificate of Compliance was made and seconded. UNANIMOUS At this time Commissioner Kelliher requests that the monEY being held by the Commission in regard to the Winn/Wilson file (SE48-272) be released to Mr. Wilson. He states that he had inspected the site and it has been revegetated with grass coming up under the hay. Mr. McKelway disagrees that the site lS revegetated and submits some recent photographs.
