The open session of the meeting reconvened at 7:52 PM in the
Large Group Instruction Room at the Nantucket High School.
Present were CommIssioners William Wi llet, Peter Dunwiddie,
Donald Visco, Henry Wasierski, Lee Dunn, and Carl Borchert. Also
present were Ben McKelway, Administrator and Bruce Perry,
Secretary.

the Planning Board at this time for the road layout only. She
asks that the nl~west plan submitted ceplaces p,-evlous plans III
the file.
Mr. Jay provides an overview of the site using his plans.
The plans show the wetland boundaries; the 25 and 50 foot
setbacks from these boundaries; upland sites; road location;
and possible house sites. lhe main road encroaches on the 25
foot undisturbed buffer but does not go through any wetlands.
There is not flexibility in the cuI de sac location. He had
looked at the option of clustering the houses hut they would

Mr. Dunwiddie asks if all the houses are going to be
constructed.
Mrs. Philbrick responds that the boards need to review the

Mr. Dunwiddie asks if the neighbors would be willing to
more their wells?
Mr. Borchert responds that he IS familiar with the
engineering of the other wells and septic and the topograpl1Y
of the area would make it difficult.
The commissioners review the plans in an attpmpt to fInd another
configuration that woul~ work on the lot.
Mr. Dunn remarks that i t ~;eem~.; that t.hey have done all that
they could.
Mr. Emack suggests clOSIng this beforp he files the State

Mr. Willet responds that the Commission would lIke to see
the State filing first.
Mr. Borchert asks what IS creating the marsh that IS

Mr. Emack responds that the wetland boundary is at 10 - 11
foot elevation. The wet area is probably surface groundwatpr.

Mr. Borchert suggests that the staff talk with the Health
Department concerning the allowable flows.

Mr. Shugrue comments that two wetland areas will be
impacted.
1.) A tupelo and red maple wetland that extends the
full width o-f the pr-operty along Wauwinet Road. I !lave
moved the driveway as far south as possible to minimize
the impact of the work.
2.) A small wetland next to the house site. The
proposal is to fill a small portion of It to allow
construction ~nd decks.

Present for the applicant was Bob Lmack and Dick Earle
of Nantucket Surveyors; Arthur Reade counsel; and
representatives of First Winthrop.
Bob Emack provides an overview of the proposed projects
which include construction of a pool, croquet lawn, putting
green, outdoor dining area with propane fire pits, decks on
cottages at or near grade, new concrete walk to the bulkhead.
Within 25 feet of what could best be described as a coastal
beach includes a portion of a five foot woad panel fence
required around the pool, the pavers block walkways, some of

areas, i.e. the croquet lawn and putting green, should be
submitted.

wetland. The new decks on the cottages are within 100 feet but
will not alter the resource area.

Mr. Gardner adds that the last couple of feet of the ditch
will be moved to allow clear access to the pond down the path
and to brushcut the vegetation.
Mr Borchert asks what the surface of the path will be ?
Mr. Gardner responds that it will remaIn natural. The new
bank will be seeded. A new two rail fence will be put on
either side of the path to direct people. The parkIng areas

Present for the applicant was Andrea Stevens, resource
planner for the Land Bank.
Mr. Willet reads the inspection report.

Mr. Willet comments that the Commission received a letter
in opposition from Bruce Perry who lives across the pond from
the project.

currents and the fuel will float on the surface. It is an

dismantle the pipeline before another solution is found. We
are going to meet with the Board of Selectmen to finish the

Mr. McKelway states that there are d number of cases that
are in violation of the Order of Conditions. How does the
Commission want to proceed 7 As examples, he listed projects
by Rick Kotalac, Lugosh, and Quentin Holmes.
After some discussion of the cases the consensus was to notify
the violators by certified mail before issuing an enforcement
order.
