MINUTES OF JANUARY 5, 1989
The public hearings of January 5, 1989 were called to order at 7:31 PM.
Members present were: Bill Willet - Chairman, Peter W. Dunwiddie, Lee
Dunn and Henry Wasierski. Members absent were: Carl Borchert, Granville
Cranston and Donald Visco. Administrator present: Ben McKelway.

A. Comments, questions from press and public.
1. Tina Coughanowr of Horsley Witten Hegemann wanted to discuss an
upcoming application for Jones in Squam with the Commission
informally prior to filing. The application would be involving a
lot having a limited building area and large wetland area. She
asked the Commission if expansion towards the intermittent stream
would be allowed in order to avoid cutting down existing
vegetation which the applicant wished to keep. Bill Willet and
Peter Dunwiddie decided they would personally prefer to look at
the site before making that decision.
2. Lynn Zimmerman of the Nantucket Land Council wanted to speak
briefly about Conservation Restrictions and offered to supply
each of the Commissioners with a book about them written by
Stephen Small. Lee Dunn asked what incentives were in place for
property owners to want a Conservation Restriction. Lynn said
the main reason to want one was ultimately to protect the land
into perpetuity, but there were also 3 tax advantages to the
owner: 1) it lowers the value of the property and thus lowers the
state tax; 2) the difference in the value between the property as
taxed normally and as taxed with the Conservation Restriction
would be the owner's gift to the Town; and 3) it lowers the value
of the property and thus lowers the local tax.
Melissa Philbrick of Vaughan, Dale and Philbrick commented that
many ConComs on the mainland actually write Conservation
Restrictions into some Orders of Conditions, and this is
considered common legal practice in Boston. Ms Zimmerman said it

is important to remember that each piece of land is different and
must be considered on a case by case basis. Lee Dunn thought the
ConCom could consider Restrictions in the future as long as they
could be recommended intelligently.
B. PUBLIC HEARINGS

abstained from all 5 hearings. Rachael Hobart of Vaughan, Dale
and Philbrick was present, in the absence of Melissa Philbrick,
as agent with the applicant, Randy Sharp. Tina Coughanowr of
Horsley Witten Hegemann and Jeff Blackwell of Hart-Blackwell
were also present as agents for the applicant.
NOTE: The following discussion applies to all 5 lots.
Ms Coughanowr submitted plans having proposed lines for
Conservation Restrictions for some of the lots. Ms Hobart
requested a continuance of the hearings for lots #20, #22 and #23
pending draft documents incorporating Conservation Restrictions
on those lots to be presented at the next meeting on January 19,
1989. A motion was made to continue the hearings for those lots
at the request of the applicant. The motion was carried.
NOTE: The following discussion applies specifically to lots #21 and
#2~.
Lot n:
Ms Coughanowr had spoken with Liz Khoulaharis at DEQE who
outlined 3 options to solve the dilemma on this lot: 1) require a
1:1 replacement of wetland vegetation; 2) require no replacement

of wetland vegetation; and 3) require the applicant to overcome
the presumptions and issue a Notification of Non-Significance.
Peter Dunwiddie did not think the wetland vegetation was
significant enough to require replacement. Ms Coughanowr said no
fill was involved, only extensive grading and resurfacing. She
said although the applicant was requesting a waiver, he was
willing to consider a Conservation Restriction to compensate for
that request and that all setback requirements would be met.
Henry Wasierski thought the replication would serve no real
purpose and would likely do more damage than good. Ms Hobart
wanted to put all discussion about the Restriction on hold until
the next meeting. Ben McKelway was concerned that the proposed
draft she would present would be harder to change if not
discussed with the Commission first. Ms Hobart said in this age
of word-processing anything could be changed later. Ben said he
meant it would be psychologically harder to change once drafted,
though.
Ms Coughanowr discussed the small 8-inch culvert to be used.
Peter Dunwiddie asked Lynn Zimmerman of the Nantucket Land
Council to provide the ConCom with information on criteria used
for establishing lines for Conservation Restrictions. Lynn said
there must always be an area large enough around the house to
allow for normal human activity such as gardening, landscaping
and outdoor activities, but this would be discussed in the book
she agreed to supply earlier. Lynn agreed to meet with Melissa
Philbrick to discuss the lines before the next meeting. Ms
Hobart stressed that they would be presenting merely working
documents next tL~e.
Ben McKelway wanted to know what the ConCom felt about using a
Notification of Non-significance here. Peter Dunwiddie said this
was a marginal wetland and the applicant was proposing use of a
Notification as one way of dealing with the work within it. He
said the questions were whether to require replication or not,
and whether to call it a wetland or not. Ms Coughanowr said
she thought the Order of Conditions could legally contain a
section that regards only this portion of the whole project to be
non-significant.

A motion was made to continue the hearing for more information
about Conservation Restrictions and consideration of the
non-significance of a portion of the lot. The motion was
carried.
Lot 2~:
Ms Coughanowr submitted a supplemental report dated January 5,
1989 summarizing issues raised during site visits and past
hearings concerning wetland boundaries and the variance being
requested. She said Hart-Blackwell had surveyed the alternative
house site discussed at the last meeting and anticipated problems
with the extensive grading needed due to the steep slope of the
site. Jeff Blackwell said Bob Epple was working on a new bridge
design which may be able to span the entire length without
using pilings.
There was further discussion about some of the wetland boundaries
and wetland scenic views. Randy Sharp said using the alternate
house site would involve disturbing some of the older trees and
he was concerned about the negative impact on wetland scenic
views. Ben McKelway added that the ConCom is never obligated to
approve a crossing though a wetland. Ms Coughanowr agreed with
Mr Sharp and stressed the need for extensive site work.
The possibility of a second dwelling being built at some point in
the future was another concern of the Commission and Ben McKelway
thought the impacts should be nailed down now. Lynn Zimmerman
said the Notice proposed limiting additional dwellings in the
future. Peter Dunwiddie found difficulty in bypassing 2 other
potential building sites in favor of a third one closer to a
wetland. Ms Coughanowr admitted they were having to balance
buildability with wetland scenic views. Henry Wasierski wanted
to see just how offensive it would be if the house were built
into the side of the hill at the alternative site.
A motion was made to continue the hearing for the following

1) more detail on alternative bridge designs;
2) more analysis of alternative house sites and more
detail on regrading at one of them;
3) information about a possible second dwelling in the
future and
~) some photographs taken from Polpis Road representing
views of one alternative house site to be used in
comparative analysis for the wetland scenic views issue.
The motion was carried.
6. D & K Realty Trust - Hummock Pond Road (56-59). Rachael Hobart
of Vaughan, Dale and Philbrick was present as agent for the
applicant and submitted abutters notification. Tina Coughanowr
of Horsley Witten Hegemann was present as a geologist and wetland
scientist for the applicant. Attorney Donald McNamee was present
for abutters, the Powers.
Ms Coughanowr gave a brief site description of the shrub swamp
having a manmade ditch running through it. She said the primary
dwelling would be 63 ft away from the wetland and the secondary
dwelling would be 55 ft. One change had been made to the original
Notice of Intent in moving the well 20 ft farther from the
wetland boundary.
Peter Dunwiddie said he had no problems with the application.
Attorney McNamee requested time to review the application for the
Powers. A motion was made to continue the hearing for comments
from Mr McNamee and a DEQE file n~~er. The motion was carried.
7. Nantucket Land Council/von Summer - 29 Hulbert Ave (29-23). Tina
Coughanowr of Horsley Witten Hegemann was present as agent for
the applicant and submitted abutters notification. The results
of a recent field inspection were read.

Ms Coughanowr gave a brief description of the project stating
this was a 19,500 sq ft parcel with elevations ranging from 0 - 8
ft MSL. She said the following work was proposed:
1) an 1100 sq ft addition to the existing garage located ~5
ft away from the edge of a currently non-migrating
coastal dune which is cut off from Nantucket Harbor by
the seawall;
2) exterior and interior renovations to the house with no
change to the footprint;
3) construction of a deck and boardwalk;
~) grading and filling on the landward portion of the site;
5) remove the existing gravel driveway and add plantings of
indigenous plant species;
6) basic landscaping around the house;
7) build a proposed walkway over the dunes;
8) build a seasonally removable stairway down to the
beach; and
9) face the seawall with wooden planking and run additional
planks along its top edge to allow for walking out its
length.
Bill Willet wanted to see more detail on the grading work. Ms
Coughanowr offered to provide a contour plan showing the existing
and proposed grades. Bill asked if the walkway could be brought
in closer to the house. She said the plans were still conceptual
and flexible and that would certainly be a possibility. Peter
Dunwiddie asked if the seawall and the groins were still intact
and she said yes.
Abutter Jane Merrill said the bulkhead had been made of cement
all along and had never before been covered with wood plar~ing.
Peter wanted to know how the facing would be attached. Ms
Coughanowr did not know presently, but she would find out.

After a request from the chairman for any other public comments,
a motion was made to continue the hearing for:
1) a plan showing existing and proposed contours;
2) information on how the wooden facing would be attached;
and
3) a DEQE file number.
The possibility of keeping the porch and not adding the deck was
discussed, and Ben was asked to find a similar previous filing
along Hulbert Ave to refer to at the next meeting. Abutter Sandy
Craig wanted the record to reflect that his father had built the
house. Attorney Arthur Reade commented on the abutter
notification procedure and explained the 300 ft rule used by the
Nantucket Assessor's office. The motion was carried.
C. REGULAR MEETING
1. Requests for Determination
a. Consue Springs house (55.1.4-15). Christopher Holland was
present as agent for the applicant, the Nantucket Conservation
Commission. Ben McKelway said Charles Sayle, Sr. did not like
the cupola and thought the new building should be just like the
original one. Mr Holland said the cupola is actually known as a
lantern or a light in architectural terms, adding the gazebo has
traditionally been thought of as a truly playful item.
Henry Wasierski thought it would be good to put the new design in
the Inquirer and Mirror to solicit public comment, and suggested
putting it in as an item in the "Development Watch" section.
Mr Holland went on to describe the base wall that would be
covered with shingles, the idea being to make it vandal-proof,

while still complying with HDC regulations. He preferred not to
submit tonight's design to the newspaper, but said he was working
on a new drawing having the lantern toned down a bit. He agreed
to submit the new drawing.
Ben McKelway said that according to Charles Sayle, Sr, the
existing pipe going down to the spring had been driven too deep
to draw water any more. Henry Wasierski agreed to go out with Mr
Holland to investigate the actual depth of the pipe. There was
more discussion about the spring and pipe design. Mr Holland
pointed out that the entire structure was to be prefabricated
off-site except for the concrete base.
A motion was made to issue a negative Detel~ination stating the
work described in the Request is within the Buffer Zone, as
defined in the regulations, but will not alter an Area Subject to
Protection Under the Act. Therefore, said work does not require
the filing of a Notice of Intent. A note was added: New
Structure may be no closer to the top of the bank than previously
existing structure. New structure must be built off-site. There
shall be no disturbance of the bank, and no litter or debris
shall be left behind after the project is completed. The motion
was carried.
Chairman Bill Willet took the opportunity to publicly thank Chris
Holland for his contribution of overseeing this project.
b. Metcalfe - 10 North Beach Street (~2.~.1-37 & 38.1). Henry
Wasierski abstained from the discussion and vote. George
Metcalfe was present with agent, Lloyd Arnold. The results of a
recent field inspection were read. Two letters of opposition
were read from Joseph Damsker and Elizabeth Little.
Peter Dunwiddie suspected that much of the site was originally
wetland that has been filled in various places over the years.
Mr Metcalfe said the site used to be the Gordon Folger Hotel's
garbage dump. A motion was made to issue a negative
Determination stating the work described in the Request is within
the Buffer Zone, as defined in the regulations, but will not

alter an Area Subject to Protection Under the Act. Therefore,

After the Determination was signed, it was realized there were
only 3 signatures, since Henry Wasierski had abstained. Ben
McKelway said Town Counsel had advised that all documents have
~ signatures, but the general concensus of the Commission was
that it would not be a problem.
c. Shapiro/Marden - Pocomo Road (15 - 18 & 19). Lee Dunn
abstained from the discussion and vote. Attorney Reginald Marden
was present as agent for the applicant. The results of a recent
field inspection were read.
Mr Marden stated that there were no stairs or walkways planned at
this point and this section of the Harborfront is experiencing
minimal erosion at the present time.
A motion was made to issue a negative Determination stating the
area described in the Request is not an Area Subject to
Protection Under the Act. A note was added: This applies to the
area 100 ft or more from the top of the coastal bank. The motion
was carried.
2. Orders of Conditions
a. V. Linburg - SE48-51~ - 31 Codfish Park Road (73.1.3-11). John
Shugrue was present as agent for the applicant. Bill Willet had
spoken with Mr Linburg about reducing the size of the house or
moving it back further from the dune edge. He requested more
time to consider those suggestions. A motion was made to defer
issuance of the Order of Conditions until January 20, 1989 at the
request of the applicant with his understanding that the
statutory 21-day period would be waived with his consent based on
a written statement from his agent John Shugrue. The motion was
carried.

3. Certificates of Compliance
a. McKerrow - SE48-421 - West Chester Street (~1-337). Glen Wills
of Nantucket Surveyors was present as agent for the applicant.
Ben McKelway reported that Glen had told him attorney Melissa
Philbrick wanted a chance to speak with the Mr. McKerrow before a
Certificate was issued. The Commission decided to wait until the
next meeting.
b. Kotalac - SE~8-~57 - 129 Meadowview Drive (56-113.1). A motion
was made to issue a Certificate of Compliance certifying that the
work regulated by the above-referenced Order of Conditions has
beeD satisfactorily completed. The motion was carried.
~. Planning Board Referral
a. Nantucket Airport Commission - off Bunker (New South) Road. A
motion was made to advise the Planning Board that this
subdivision plan is not subject to the Wetlands Protection Act,
being an advisory opinion only and not a formal Determination of
Applicability. The motion was carried.
5. Other Business
a. DeBenedictus - SE48-340 (21-19) - discussion. Ben McKelway
explained that Health Agent Richard Ray had issued a Cease and
Desist Order and was waiting to hear that the septic system had
been repaired to conform to Nantucket Health Regulations.
b. Wauwinet House - SE~8-482 (11-17) - pier out - wedding May 6 and
SE~8-392 (11-17) catchbasins discussion. James Gay of
Engineering Management Corporation and Tina Coughanowr of
Horsley Witten Hegemann were present as agents for the applicant
with Russ Cleveland, General Manager of the Wauwinet Inn.
Mr Gay withdrew his request to put out the pier earlier in the
season than allowed by the Order of Conditions, and wished to
discuss the parking lot catchbasin instead. He asked Ms

Coughanowr to explain the modifications that had been made to
maintain good water quality and ensure the system worked
properly. She said it had been redesigned by Jim Freeman of IEP
and would be cleaned twice a year.
Henry Wasierski questioned the efficiency of the system and said
the catchbasin must have a solid bottom and solid sides with 1
outlet. He was concerned about the siphoning effect of the
proposed design, and suggested putting another elbow on. Lee
Dunn agreed saying they needed to deal with the hydrocarbon
separation problem and the sedimentation problem. There was
further discussion about the permeability of the soils and the
parking lot.
A motion was made to regard the changes as described as a minor
modification to the above-referenced Order of Conditions. Nelson
Jones representing the Wauwinet Landowners Association requested
a chance to refer the changes back to the members for comment at
the next meeting. He said the catchbasin was higher than the
road and has frequent, serious flooding problems into abutting
properties and the road. Lee Dunn was concerned about the
runoff. Mr Gay thought the new parking lot had better drainage
than the old one.
Mr Gay offered to redraw the plans to incorporate the plpe
modification discussed tonight and requested the vote be deferred
until the January 19, 1989 meeting. The motion was withdrawn.
c. Lugosch (Hood) - SE48-379 (27-23.1) - discussion. Mary Trudeau
of Daylor Consulting Group was present as agent with Daniel
Lugosch to respond to a recent letter from the Commission
requesting him to resolve the discrepancy between the state and
local Orders of Conditions issued for the project.
Ms Trudeau said Mr Lugosch never realized there was a problem and
the house had been built according to the Superseding Order of
Conditions, but he was willing to listen to any suggestions from
the Commission. The house is now 9 ft away from the wetland
instead of the 35 ft allowed by the local Order. Peter Dunwiddie

said the real problem is the Commission will never be able to
issue a Certificate of Compliance on the project because it was
not built in compliance with the local Order. He stressed that
the DEQE Superseding Order does not supersede the Commission's
own order with respect to the local bylaw.
Ms Trudeau said they can't do the big thing to rectify the
situation, meaning remove the house. Mr Lugosch asked the
Commission to consider that the zoning bylaw had changed during
this application process involving a 35 ft setback from the road,
and added that the Order of Conditions was issued under the old
Nantucket Wetlands Bylaw. Bill Willet suggested Mr Lugosch
consult his attorney about how he plans to get his Certificate of
Compliance and approach the Commission at a later date about the
matter.
d. Town Meeting articles - discussion. Ben McKelway had drafted 4
articles and opened them up for discussion tonight. #1 requested
$5000 to continue the program for the restoration of Warren's
Landing Recreation Area which the Co~~ission did not favor doing
again, since the Area had been restored and any maintenance costs
were covered by the line item budgeted for recreational area
maintenance.
#2 requested a vote by the Town to transfer to the Conservation
Fund of the Town any monies appropriated at the 1987 Annual Town
Meeting for use by the ConCom for the period of July 1, 1988 -
June 30, 1989 which shall not have been expended by June 30,
1989. Since this article has not been recommended now for
several years running by the Finance Co~~ittee, the Commission
did not favor submitting it again this year.
#3 requested changes to the Nantucket Wetlands Bylaw as drafted
by the Administrator. The Con~ission favored its submission. #~
requested the appropriation, borrowing of or transferring of
available funds $20,000 to be added to the Conservation Fund of
the Town for the acquisition of land and rights therein for
public use. The Commission also favored this submission.

A motion was made to delete draft articles #1 and #2 from the
Town Meeting Warrant and to submit articles #3 and #~. The
motion was carried.
e. Ratner - unauthorized dune walkway - discussion. Mr and Mrs
Ratner were present and had submitted a letter previously to
explain how and why the walkway was constructed. Mr Ratner said
he had bought the property in 1974 at which time there was approx
165 ft to the water line and no dunes were present on his
property then. He said there was no erosion for 10 years after.
He apologized for not having filed, but he did not think what he
was doing at the time ca~me under the Commission's jurisdiction.
Mr Ratner continued by drawing the layout on the board and
discussion followed about the present eroding conditions at the
site. He was fully willing to cooperate with any requests by the
Con@ission and said he was a conservationist by nature. Lee Dunn
thought the walkway was probably outside of the ConCom's
jurisdiction at the time of building and since the regulations
allow for walkways, Mr Ratner need not take any action now. Mr
Ratner doubted the walkway would even exist for more than 10 more
years due to the erosion. Peter Dunwiddie added that the erosion
rate there now is 27 ft per year. Bill Willet asked that he
check with the Commission before attempting any future work,
however. Mr Ratner was also asked to cut off overhanging
portions of walkway which had been undermined already.
f. Taylor - SE~8-397 (29-10) - further enforcement action?
Commission decided to leave further enforcement actions
Town Counsel, since Mr. Taylor has now taken the matter
court.

g. Winn/Stark - SE~8-272 (56-232.1) - discussion. Ben McKelway said
Mr Winn had called recently to say in his opinion all work
covered by the Order of Conditions had been completed and
therefore no new Notice was necessary. Mr Winn was not present.
After brief discussion, the Commission decided a new Notice of
Intent was necessary and asked Ben to inform him of that.

h. Town land at mouth of The Creeks - clean up? Ben McKelway
reported that the Commission had been asked by the Nantucket
Police Department to clean up abandoned boats on what they
believed was Commission property at The Creeks. After some
discussion, the Commission instructed Ben to pursue the matter,
but to avoid spending more than $300-~00 on it.
i. Polpis Rd bikepath route inspection with Town Engineer Gene
Crouch - meet at Island Lumber 9AM Saturday, January 7.
J. Weinman - SE48-439 (25-32) - request for minor modification. A
request had been received to accept as minor a modification to
the approved plans involving relocating the well further out of
the wetland. After reviewing the plans, a motion was made to
send a letter to that effect and not requiring the filing of a
new Notice of Intent. The motion was carried.
