The regular meeting of the Rights of Ways Committee was held in th e Town and
County Building on August 6, 1980 with Mr. Waine and Mr. Yacus being absent.
Meeting came to order at 8:30 PM.
Mr. Visco made a motion to waive the reading of the minutes and approve them,
seconded by Mrs. Marble so voted.
The meeting was called to discuss the petition received by the Town asking
the Town to post a sign regulating the accessible use of the Way known as
School St. Surfside. The fishermen attending the meeting opposed. The
abutters attending want the way closed during the day. (The abutters
blocked the way by erecting posts)
The abutters stated that the four wheel drive vehicles are too reckless
driving down the way, with no regard to the bathers on the beach. Mr. Eldridge
suggested they call the police for enforcement of the reckless drivers.
Closing the way would not solve it, they would find a way to get to the
beach. Mr. McMasters stated that the public now tresspasses over a portion
of his land because the way is not followed according to the layout on paper.
Mr. Barrett asked if there is any abutter who would object to the Town taking
School St. by eminent domain. Mr. MtMasters and his daughter objected.
Since one of the abutters is in an Estate, and did not sign the petition the
committee questioned whether they had the right to close off the way.
Mr. McMasters asked about removing the marker "Public Way", since it is not a
public way. The committee stated that they cannot give him permission to
remove it.
Mr. Visco made a motion to recommend that the Right of Ways committee
recommend to the County Commissioners to take by eminent domain for public
necessity and conveniece the way known as School St. from Western Ave. to the
Atlantic Ocean seconded by Mr. Eldridge, so voted.
Mrs. Marble made a motion to adjourn the meeting at 9:45 PM seconded by
Mr. Eldridge, so voted.
