The regular meeting of the Rights of Way Committee was held in the Town and
County Building on July 9, 1980 at 8:00 PM with Mr. Waine being absent.
The committee was increased from five to seven members. New members are
Mr. Donald Visco and Sylvia Howard.
Mr. Yacus made a motion to approve the minutes of June 25, 1980 seconded by
Mrs. Marble, voted unanimously.
Mr. Frank Hardy attended the meeting to discuss the Shimmo Pond Road.
Mr. Hardy stated that he will close off the end of the road if the Town does
not want to take the road. He stated that he does not want to be liable.
Mr. Visco stated that there is no purpose in recommending that the Town take
the road. The road is too narrow. When the Town takes a road it is a 40' wide
road as required by the Planning Board. The committee recommended to Mr. Hardy
that when he sells the lots abutting the road he should sell or convey his
fee and interest in the road as well. so that the abutters own to the center
of the road. Mr. Hardy agreed and said he will see his attorney about it.
Mr. Hardy was reminded that if the Town needed the road, it could take it by
eminent domain.
Regarding the matter of Mr. Robert Blair, of Lily St. Mr. Yacus will look up
the deeds and/or easements regarding the land or way to the ditch.
Regarding the matter of Mr. George Kiddoo, of North Bluff Sconset. The
committee will look up deeds and Sconset Path provisions.
Regarding the matter of the 20ac. . on Esthers Island belonging to the Town~
(Trustees of Shore Reservation). Mr. Barrett stated that he will compare
the areal map with the survey map.
Mr. Eldridge asked if the chairman heard anything about Polpis Harbor.
Mr. Barrett said he (Mr. Alexander M. Craig Jr.) is in the process of submitting
a plan to the Land Court for registration. The committee feels that Mr. Craig
has no record title to the land abutting the Harbor on the North.
The committee scheduled the next meeting for July 30th.
Mr. Eldridge made a motion to adjourned the meeting, seconded by Mr. Yacus,
so voted. Meeting adjourned at 9:15 PM.
