HomeMy WebLinkAbout1980-03-12 " '.... The regular meeting of the Right of Ways Committee was held in the Town and County Building on March 12, 1980 at 8:00 PM with all members being present. Mr. Yacus made a motion to waive the reading of the minutes and approve them, seconded by Mrs. Marble, so voted. The committee received lettersfrom the County Commissioners written by Mr. Holmes, (representing Preston Manchester) regarding the Miller property requesttng that the Town lay it out and take it as a road. At the present time the Miller property (which was given to the Town many years back) is a long and narrow lot. The intent was that it be a road. Mr. Yacus stated that in his opinion it is unfair that the committee should be expected to vote on this tonight as none of the members have seen these letters or the plot plan before. Mr. Holmes stated that they were given to the com~ittee some time back and that the committee cancelled their last meeting, so this request is not sudden. Mr. Yacus said that the abutters should be asked as to how they feel about it. It would increase the traffic, and perhaps open up the area for subdivisions. Mr. Holmes stated that most of the land abutting has already been subdivided. Mr. Holmes explained why this access is necessary for the developers. After considerably more discussion, Mr. Eldridge made a motion to recommend that the County Commissioners layout Millers Way as a road with the abutters to assume any costs of improvements thereon, seconded by Mrs. Marble so voted. Mr. Yacus and Mr. Waine abstained. Mr. Barrett voted in favor. Mr. Yacus said that he abstained because he felt that there was not enough information, i.e. the abutters feelings on this matter. Mr. Waine said he has not seen the condition of the road in the last year. Mr. Barrett stated that the Conservation Commission is having a meeting tomorrow night regarding Massachusetts Ave. and that he was requested to attend and stated that if any other member would like to come to please do so. Meeting scheduled for 7:45 PM. HINCKLEY LANE: Mr. Yacus submitted a copy of a deed and a plot plan of Hinckley Lane and its abutters. He further stated that the posts are on land owned by Mr. Heinz. Mr. Barrett suggested that the County Commissioners consider taking only the end of the road and said they should ask Town Counsel what problems it may present. Mr. Yacus made a motion that the Town Counsel be consulted as to whether rights of adverse possession exist in Hinckley Lane or any part thereof, in the event that the Town wishes to take it, seconded by Mr. Waine, so voted. WANNACOMET STREET: Mr. Yacus submitted a plot plan showing that the Town owns two lots on Wannacomet Street. Mr. Eldridge made a motion to recommend that the County Commissioners take Wannacomet Street from Nonantum Ave. to mean low water in a southerly direction, seconded by Mr. Yacus, so voted. The committee again discussed Low Beach Road and will view the site. Mr. Eldridge made a motion toadjourne the meeting, seconded by Mrs. Marble, ~voted.
