The regular meeting of the Rights of Ways Committee was held in the Town and County Building on March 26, 1980 at 8:00 PM with ~1r~ Barrett, Yacus, Eldridge and Mrs. Marble being present. Mr. Waine was absent. Mr. Yacus made a motion to waive the reading of the minutes and approve them, seconded by Mr. Eldridge, voted unanimously. The Right of Ways committee received a copy of an Interdepartmental Memo from the Board of Selectmen to the Finance Committee recommending the Town grant to Preston Manchester an easement running from Macy Lane northwest over an 80 foot strip of land known as Millers Way. Mr. Barrett stated that he spoke to Town Counsel Goglia who said that the property was given to the Town and that the Selectmen cannot grant an easement, however, the County Commissioners could. If the County Commissioners do not grant the easement, the Town could vote to do so at Town Meeting. Mr. Barrett asked Mr. Goglia 'about adverse possession, he said that it would have to be proven in Court. Such matters could not be resolved until they become a court decision. Mr. Barrett stated that he received a Zoning Bulletin regarding Land Court Rights of Way. It stated that no portion of a road can be closed, if on a Land Court Title. Mr. Eldridge stated that he has not had the time to check into whether Low . Beach Road is a Town Road, but will do so as soon as possible. Mr. Barrett notified the members that the Board of Selectmen did not submit Chapter 693 as an article. (Maintenance of roads other than public ways.) Mr. Eldridge asked if the commissioners heard anything on Pol pis Harbor from the NP&EDC or from the Selectmen. Commission has not heard anything. ; Mr. Klein told Mr. Barrett that there is no money available for such research. '1 The committee should try and get some information as to costs. Committee still awaiting action from County Commissioners. The committee scheduled the next meeting for April 16, 1980 at 8:00 PM. seconded by Mr. Yacus, so voted.
