HomeMy WebLinkAbout1979-10-24 ~ 'i The Rights of Way Committee met at 8:00 PM on October 24,1979 in the Town and County Building with all members being present. Mr. Donald Visco attended the meeting as requested. Mrs. Marble made a motion to approve the minutes of October 3, 1979, seconded by Mr. Yacus, voted unanimously. The Board of Selectmen refered a letter to the Committee from Mr. Artz regarding Hinckley Lane running from Cliff Road to the water. Ohe of the property owners erected some posts blocking this passage and eliminating parking facilities. He assumes the road is public. The committee will research the matter. The committee discussed Chapter 693 Acts of 1978 with Mr. Visco. This Act allows Towns to decide which roads to make improvements on, whether public or private. Which should have drainage, and which should be charged and how much, etc. The committee will formulate proposals for a By-Law to be submitted to the Town for vote at the 1980 Town meeting. Mr. Eldridge asked if the Town makes improvements upon a road (private) can the abbutters after a period of time still close off the road. The Town has no legal rights in private ways. Therefore the answer would be yes. The question was asked, if the Town makes improvements on certain roads does the status of the road change as far as being able to subdivide off the road. The answer is no. The committee discussed the 1838 roads or 1799 roads as frequently called. The committee received copies of the road work that Dr. Brown did for the Town. (finding out which were legally laid out and taken and recorded) Inasmuch as Town Counsel Goglia will be very bus)! with the upcoming Warrant Mr. Visco suggested seeking the aid of Mr. Ryckman, (professor of law) assistant to Mr. Goglia to help in the legal wording of the proposed by-laws, regarding Chapter 693. The proposed by-laws will have to be submitted prior to January 15th to be included in the 1980 Warrant. As soon as the committee has worked up a set of by-laws, a copy will be forwarded to the Board of Selectmen, (County Commissioners) for approval. The committee will request Mr. Lentowsk; to attend the next meeting of the Rights of Way Committee.
