The Rights of Way -Jl11lliittee met at 8:00 pr~ in the Tovm and County Building
on October 3, 197~ with all members present.
The minutes of 9/19/79 should state that Mr. Yacus stated that Mr. Craig
would object to any boat related facility (not to any facility) on that side
of the harbor for public use, according to what he has heard tonight.
Mr. Yacus made a motion that the minutes of September 19, 1979 be accepted
with noted change requesteej above, seconded by Mrs. Marble so voted.
The Conmittee discussed Chapter 434 (regarding public roads) which did not
contain the same roads as listed in the Article approved by the Town meeting.
It was explained to the Committee that some of the roads listed under the
Article were previously taken by the Town under Chapter 90.
Mr. Barrett brought up the matter of guidelines for raod maintenance.
Section 6H Chapter 40 of Mass General Laws as accepted under Article 25.
f'ir. Barrett also suggested that the Committee invite ~lr. Donald Visco to
attend their next meeting to try and formulate a guideline for road
maintenance.
The Committee plans on reviewing roads that lead to the waters of Nantucket.
The Committee briefly discussed the matter of the Polpis Harbor Access, (boat
docking facility) and ownership of land from the bank to the water.
Mr. Gardner who stopped in during the meeting said he would bring up the
letter which was supposed to have been sent to the Bass River Savings Bank
with respect to Eat Fire Springs Access Road to the harbor at the next
County Commissioners meeting as to VJhy r'irs. \~helden has not ~'/ritten to them,
inasmuch as it was a vote of the Board to do so.
The Committee will obtain a COkY of I,lr. Craigs land court submission and
indicated that if the TOltm does not object, they vJOuld inasmuch as it is
still undetermined as to whether the Town or Mr. Craig ownes below the bank.
The original deed read from the bank, now it reads to the water on the new
deed.
Mr. Yacus said he spoke to Mr. Lentowski and that he stated it is his belief
that Mr. O'Brien will give the road to the Town. Mr. Yacus further stated
that Mr. Lentowski is concerned with the maintenance, patroling and continued
upkeep of the road and proposed docking facility.
It was the opinion of the Committee that the Department of Public W0rks
would be responsible for the maintenance of the access roads, whether it is
the Eat Fire Springs Road or the Polpis Harbor Access Road or both 1n the
event that the Eat Fire Springs Road were given to the 70wn.
