'The Rights of Way committee met at 8:00 PM in the Town and County Building
don Septem5er 19, 1979 with a 11 members present.

Ijrn last weeks minutes it was Mr. Barrett who gave a copy of the proposed
I budget to the Selectmen at an earlier date, not Mr. Eldridge.

Mr. Barrett stated that Mr. Thurber will bring up the proposed budget to the
County Commissioners and expect them to take action upon the request.
Mr. Yacus made a motion to'waive the reading of the minutes and to approve them,
seconded 5y Mr. Eldridge, voted unanimously.
Regarding the letter from the Board of Selectmen asking if a rutted, road behind',
the Old Coast Guard Station is a public way or any portion thereof, Mr. Barrett ':
satd that thts road has been used by the publ ic for many many years and should "
not 5e closed. He further said, from the information we have gathered it is n-ot
a public way. Only the paved portion of Western Ave. is a public road.
Mr. Eldridge said that if the road goes through Mr. Folgers property, we would
I have nothing to say about it. The entire committee feels the road should not
be closed. According to a plot plan of Mr. Farrells property, he built his
first house tn the middle of, Western Ave, then land courted his lot, with the
ITown making no objection, the Town therefore lost that portion of the road.
Mr. Yacus made a motion to send a reply to the Selectmens letter stating the
feeling of the committee in opposition to the closing of the rutted road as
this is the only access west of Surfside to ~Jeeweeder Pond. Seconded by
Mrs. Marble, voted unanimously.
Mr. Eldridge brought up for discussion the Polpis Harbof~Access Road and the
long sought after ramp or docking facility for the use~~f the public.
Mr. Eldridge asked Mr. Craig to join the committee at the table. Mr. Eldridge
read a letter (dated 1968) to the committee on Board of Selectmen stationary .
addressed to Schofield Bros. Inc. regarding the Polpis Harbor project for a
pier or docking facility. This proposal involved no taking of land. However,
the land below the bank of Mr. Craigs property is still questionable as to
ownership. Mr. Craig stated that at the present time he submitted his land
plan to the Land Court and will wait for the Town to take action presumably
against him. Mr. Craig said the intended ramp was to be located at the Eat
Fire Springs_'side'Of Polpis~-Harbor. Mr. Eldridge refered to a section
regarding the cutting of Poplar Tree, that would mean that it is on the Po1pis
Har50r Access Road s'!de adjacent or on Mr. Grossmans property. Mr. Craig
said that he does not wish to put a financial burden on the Town and that he
would give the Town a permanent turnaround when the Town acquires the Eat
Fire Springs access road. Mr. Eldridge stated that you and Mr. Buckingham
keep saying that we will get the road, but Mr. O'Brien does not own the road.
The Bass River Savings Bank is forclosing on the property at this time and
the road is part of the land being forclosed. Mr. Craig said he talked to
Mr. O'Brien and his attorney at that they would give the Town the road.
Mrt'..Craig said there are other factors involved. Mr. Eldrige asked what these
factors are. No reply. Mr. Eldridge said the Town owns the Polpis Harbor
Access Road, (which was laid out to a 60' width but only 22' was taken- I have
not been able to find out why) and instituting a taking of the Eat Fire Springs
access road would take a great deal of time and expense and for what purpose,
the best location for docking is at the end of the Polpi5 Harbor accesS road.
Town Counsel himself said that you are playing with a can of worms. Mr. Craig
said you are willing to take my land, why not Mr. OIBriens? Mr. Eldridge said
the piece of land you want to give to the Town is too small for a turnaround.
Mr. Barrett asked Mr. Craig how would you feel about putting the ramp in
front of your property out over the water, not on your property. Mr. Craig
said he would object to that too. He does not want a public docking facility
in front of his lot. He said furthermore, Mr. 6rossmans view is out what way.
Mr. Yacus stated that Mr. Craig would object to any facilHy on that side of
the Harbor for public use, according to what he has heard tonight.
Mr. Eldridge asked Mr. Craig about his deed to the property. Mr. Craig said
originally there were two deeds and when they combined them, it was changed.
Mr. ~ldrigge asked when was this done. Mr. Craig said recently.

Mr. Barrett said the Town and Mr. Craig should work out something that would
be acceptable. Mr. Eldridge said he will check with Mr. Gardner who is
supposed to check with the Bass River Savings Bank regarding the Eat Fire
Road. .
The committee said they would notify Mr. Craig if they found out anything so
that he may attend the meeting. Mr. Barrett said perhaps the Town can acquire
