Walter Barrett, IKchairman} Joe Yacus, Peter Eldridge, and Mrs. Sylvia Marble. Mr. Dale Waine ~ras absent. i i !I~r. Eldridge made a motion to approve the minutes of August 28, 1979 and waive the reading, seconded by Mrs. Marble, so voted. li~he Committee received a letter from Mr. Charles S. Thurber, on behalf of the Board of Selectmen acting as County Commissioners asking if the rutted Iroad off Western Ave. in front of Mr. Folger's property and that of Mr. Farrell II :~s a public way or any portion thereof. The Committee noted that this letter I t~hould have been addressed to Mrs. Whelden, Secretary to the County commissiOnerS,! ~s she takes care of the legal proceedures and the paperwork for the takings ~f the roads laid out in the Town of Nantucket. Mr. Yacus made a motion to ',set an overlay of Map # 87 showing the location of rutted road and will find put the owners and then go out and view the site, seconded by Mr. Eldridge, I~o voted. The Committee will report their findings to the County Commissioners ,as requested in the letter. i' l~he Committee discussed the meeting nights and decided to meet on alternate I~ednesday nights from the County Commissioners meetings. Mr. Eldridge made I~ motion to meet on the following Wednesday nights: September 19, 1979, Pctober 3 and 24, November 7 and 21, December 5 and 19, at 8:00 PM in the, Wown and County Building, seconded by Mr. Yacus, so voted. , ! l~he Committee voted to give the Selectmen (acting as County Commissioners) an I~napproved copy of their minutes to keep them informed of the Committees Iprogress prior to their own meetings. i~r. Eldridge who attended the County Commissioners meeting earlier reported i 0 the Committee on the Polpis Harbor matter, and the status of Eat Fire I prings Road leading to the Harbor. 1.) The matter is moving along slowly. .J No appraisal has been done yet. 3.) Apparently Mr. O'Brien does not wn the road, the Bass River Savings Bank is forclosing the Glasser property t this time. Mr. Gardner made a motion to contact the Bass River Savings ank regarding the road. The Selectmen requested input from the Rights of ay Committee and indicated that they will support them. Mr. Yacus made a otion to have Mr. Eldridge gather information on the original proposal of olpis Harbor use and intended boat ramp and launching facilities, seconded y Mrs. Mar51e, so voted. he Committee discussed the 1976 Town Meeting Article 25 which states liTo ee if the Town will vote to accept Section 6H of Chapter 40, Mass. General aws, pertaining to making repairs on unaccepted roads and reading as follows---. I (Voted by Town Meeting as recommended) he Committee also discussed Chapter 434, Acts of 1975 - IIAn Act validating I nd confirming the laying out, alteration, relocation, discontinuance or " cceptance of public ways in the Town of Nantucketll. Approved July 9, 1975. r. Eldridge asked what rights the Town has in roads that have been used by I he public for over 70 years. Mr. Barrett responded, the Town has rights of adverse possession. The committee will check on the roads that have been re- orded in the Registry of Deeds, under Chapter 434. he Committee discussed their budget, of which Mr. Eldridge gave a copy to he County Commissioners earlier this evening. he Committee received a bill from the I & M for advertising in the amount of $12.00. Mr. Yacus made a motion to refer the bill back to the Selectmen, as this was advertising for appl icants for the Rights of Way Committee. Seconded, by Mr. Eldridge, so voted. -...
