PROJECT: Stormwater Improvements Project Phase I,
Nantucket, Massachusetts (the "Project")
Ladies and Gentlemen:
The undersigned, as the Town of Nantucket ("Town") Town Clerk, hereby certifies,
warrants, and represents to you on behalf of the Town of Nantucket that:
1. The Town Clerk's office is responsible for maintaining a list of the public ways in
the Town of Nantucket (the "Public Ways List") and is knowledgeable about the public ways in
the Town.
2. The Project is to replace existing drainpipes, appurtenances and other
improvements related to stormwater drainage, located in portions of certain public streets and
ways in the Town of Nantucket, Massachusetts.
3. In connection with the Project, the Town has requested Deutsch Williams, as
counsel to the Town, to prepare a certification of the title to the property at which the Project is
located ("Project Site").
4. The Town Clerk understands and agrees that Deutsch Williams will rely on the
Public Ways List, which lists the streets and ways in Nantucket deemed by the Town to
constitute public ways.
5. The assumptions, statements and information supplied to Deutsch Williams,
including but not limited to the Public Ways List, are true, complete, and correct.

PROJECT: Phase II-A Expansion of Surfside Wastewater Treatment Facility,
Downtown Sewer Replacement, Nantucket, Massachusetts (the "Project")
Ladies and Gentlemen:
The undersigned, as the Town of Nantucket ("Town") Town Clerk, hereby certifies,
warrants, and represents to you on behalf of the Town of Nantucket that:
1. The Town Clerk's office is responsible for maintaining a list of the public ways in
the Town of Nantucket (the "Public Ways List") and is knowledgeable about the public ways in
the Town.
2. The Project is to replace existing sewer pipes, appurtenances and other
improvements related to sewer use, located under portions of certain public streets and ways in
the Town of Nantucket, Massachusetts.
3. In connection with the Project, the Town has requested Deutsch Williams, as
counsel to the Town, to prepare a certification of the title to the property at which the Project is
located ("Project Site").
4. The Town Clerk understands and agrees that Deutsch Williams will rely on the
Public Ways List, which lists the streets and ways in Nantucket deemed by the Town to
