HomeMy WebLinkAbout2007-10-16 " TOWN OF NANTUCKET / COUNTY ROADS AND RIGHTS OF WAY COMMITTEE Approved MINUTES October 16, 2007 CALL TO ORDER Chairman Allen Reinhard called the meeting to order at 4:00 on Tuesday, October 16, 2007 at 2 Fairgrounds Roads, with a quorum present. In addition to Chairman Reinhard, in attendance were: D. Anne Atherton, Nat Lowell, Sylvie O'Donnell and Harvey Young. Planning Director Andrew Vorce was also present. Committee members Charles Sayle III and John Stackpole were absent. Also in attendance were four members of the public: Ed and Judy Metcalf, Ian Golding and Judy Zurheide. Selectman Brian Chadwick was present for a short time before he aI1d Mr. Vorce excused themselves. @ -1 o :~;~: :::;:: :;::::. -< APPROVAL OF MINUTES --- The minutes of the September 18 meeting were approved as distributed. It "'ta.s noted ttat the Minutes of the Committee for the last two years have been posted on the TON website;r::> \0 .j:,;. N UPDATE: SPRUCE STREET Mr. Vorce reported that everything is place. However, Marine Home Center has placed boulders in the area, making it difficult for a neighbor to pullout of his parking place. Chairman Reinhard has spoken with this neighbor, and others. A long-term maintenance plan is needed. Marine Home Center is not interested in negotiating an easement. It cannot legally construct a fence, hence the placement of the boulders. The ROW Committee has done all the work necessary (cleared title assuring public access), bringing about a positive outcome to a lengthy process. However, the remaining issues are between the neighbors. A sign is needed at the end of Spruce Street with an arrow indicating -7 PUBLIC FOOT PATH. This is the site of an eventual Harbor Walk, a goal of the present BOS. COMMENTS: PLANNING DIRECTOR Mr. Vorce commented on three matters at this point in the meeting, as he had to excuse himself prior to adjournment. Squam Landing: This path is a 30-foot layout. The former owner erected a fence. The current developer, River Light, is responsible for an "encroachment" into the roadway. The result is that we have "lost" three parking places. Mr. Vorce will approach the attorney for the developer (Ms. Alger) requesting, strongly, that the three spaces be recreated. "We" would like to see minimal parking. The Quidnet Squam Association could initiate contact with River Light to resolve the matter. The shoulder should be kept open. Cow Pond Lane to Sparks A venue: There is a footpath in this area. Problems exist with vandalism. The Cemetery Work Group has discussed the matter. One possibility is to construct a fence around the cemetery to divert foot traffic. The footpath is Town-owned property: It is not part of the cemetery. The Committee should monitor the situation. Allens Way: There is an easement that can be used as a footpath. AlIens Way is a private way. ROW Committee, Minutes, October 16, 2007 2 ROW IMPROVEMENT PLAN: NEXT STEPS A number of phone calls to the Chairman have resulted from the recent publicity. The comment was made to add the word "water" on page 2. The recommendation is for two new positions: is this wise? Where is the documentation? A surveyor / engineer will be expensive: Is such a position needed? We must be specific as to the needs. The priority of the ROW Improvement Plan is the map. This will consist of a base layer depicting public and private roads. The information has to be verified. The deeds must be checked. The research is pretty straightforward. Marge Colley is interested in assisting with this project. The tricky part comes with the public-access points because over the years there are public-access points that have NOT been taken. The next step would be to begin the process of completing the takings. No base map that shows public and private roads is currently available on the TON GIS system. MOTION: Mr. Young moved that a sub committee be formed to work on the map. Mr. Lowell seconded the motion. Following discussion, the motion was adopted unanimously. Ms. Atherton, Mr. Young and Chairman Reinhard will comprise the sub committee. Mr. Metcalf indicated that he would be interested in assisting the sub committee as a community volunteer. UPDATE: EAST CREEK ROAD This is TON property. The road has never been laid out. Mr. Vorce has requested $30,000 for survey work. The remaining owner of a piece of property in the area has no interest in selling it to the Land Bank. If built upon, a new structure would block the view of Our Island Home. The area is abutted by Spruce Street and East Creek Road. It would be a "wonderful" public place. OTHER BUSINESS Washing Pond Road: Conservation restriction on this property. It is now protected land, but this does not mean public access. TON property behind the Surfside lots, about 30 acres, now protected by Article #75 from ATM2007. NEXT MEETING Then next meeting of the Committee is scheduled for December on a date and time To Be Determined. ADJOURNMENT The meeting was adjourned by unanimous consent at 6:00.
