Arnold, P. Bennett, C. Borchert, G. Burchell, A. Silva, C. Pear P. Waine Members absent: None Present for owner: Ed Strojny, applicant Type of project: Driveway located near wetlands on Monomoy Creek Road Called to order: 7:30 PM The Chairman called the public hearing to order. He explained that the Commission had been informed that a driveway had been..construtted near a wetlands and the owner had been issued an Enforcement Order along with a letter requesting the location of the driveway and the house on the site. Mr. Strojny, applicant for the owner - Ms. Ann S. Garrett - pointed out these locations. The Chairman explained that no file number had been received from DEQE as of this time. He further explained a field inspection was usually scheduled at the hearing and the Order was issued at the next regular meeting contingent on the receipt of the file number. Mr. Strojny stated the construction without an Order had not been intentional and explained the topography of the site. P. Bennett questioned as to whether any more work would be performed on the road. Mr'- Strojny answered that the only rema i ni ng work woul d be the 1 ayi ng of the trench. C. Pearl moved to close the hearing. So seconded and voted. The hearing was closed at 7:44 PM. t - ------- Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 November 3, 1983 The regular meeting of the Nantucket Conservation Commission was called to order at 7:45 PM by Chairman Borchert. Members present: M. Arnold, P. Bennett, C. Borchert, G. Burchell, C. Pearl, A. Silva and P. Waine. Members absent: None. 1. Minutes Gf the meetinq of October 20, 1983. Approval of the minutes was postponed until the next regular meeting. 2. Audience to press and public. The Commission discussed allowing Mr. Ed Strojny to lay a trench on property owned by Ms. Ann Strong Garrett on Monomoy . Creek Road. A Notice had been filed but the State had not yet issued a file number. P. Bennett moved to allow the laying of the trench subject to the receipt of a file number. Seconded by G. Burchell. Voted unanimously. 3. Randy Sharp - Notice of Intent. C. Borchert explained the process of issuing an Order to the audience. The Chairman read various field inspection reports of the proposed dwelling and s2ptic system to be located on Polpis and old Pplpis Road. The Chairman noted the lea~n facility plans~had been changed from a pit to a field to minimize the chance of drainage of the nearby wetlands. The Chairman also questioned Mr. Michael Bachman as to whether he had received two letters in opposition to the project. Mr. Bachman stated he had not. Mr. Bachman stated the water level was still undetermined and that Mr. Robert Leichter, engineer for the septic system, had found ordinary soil conditions on the site. The Chairman expressed concern over the pump chamber levels and the excavation levels for the house. G. Burchell moved to deny the project on the recommendation of the field inspection team. C. Pearl seconded the motion. Mr. Bahhman questioned as to whether a new application for a project on the site could be made immediately. C. Borchert replied in the affirmative. The Commission voted in favor of the motion. A Silva abstained. The Commission and Mr. Bahcman discussed the possibility of the Commission hiring a professional consultant to review the septic system plan on the site if a new plan was submitted. The Chairman stated it was indefinite who the consultant would be. Mr. Bachman questioned the Commission as to ths opinion of a proposed dwelling and system on the lot if they were located at the other end of the lot. The Commissioners stated that might constitute an acceptable alternative. 4. Beverly Hall - Determination. The Chairman read the field inspection report for the proposed garage to be located on Tennessee Avenue. It was moved and seconded to accept the recommendation of the team to issue a negative Determination - Number 3 - for the .project So voted unanimously. 5. Sconset Bluff. The field inspection report of the Bluff was read by the Chairman- It was moved and seconded to accept the recommendation of the team to forward a letter to the DPW stating erosion control work should be delayed until the bank silde again. So voted unanimously. 6. Dionis beach, property. The Commission reviewed a plot plan of property located near tne beach. It was moved and seconded to request the applicant to file a Request for Determination. So voted unanimously. 7. Consue Sorings property. The Commission discussed an offer of property owned by Ms. Gwen Gal I lard. The Commission reviewed the terms of the agreement as set forth in a letter sent by Robert F. Mooney Esquire. P. Waine moved to purchase the property for the sum of $22,000. Seconded by P. Bennett. A Silva amended the n,otion by changing condition 1 to that the fence would only be constructed on high ground. Seconded by P. Bennett. The Commission voted unanimously to purchase the property and to forward a letter to Mr. Mooney stating the same. 8. Planning Board Referral Forms. The Commission voted on the following plans: Robert Kaye - Top Gale Lane - 2 Lot Subdivision Not Subject Edward Burchell - Surfside and Cato Lane - 90 Lot Subdivision - Not subject 9. Michael Driscoll Esquire - Surfside Sewer Beds. The Chairman read a letter from Attorney Driscoll representing the ).urfsid~ Civic Association regarding the "replanting of the sewer bed area. It Was moved and seconded to place the letter on flle. M. Arnold stated the members of the SCA were very seri,ous about court action as mentioned in the letter. The Commission voted to place the letter on file. M. Arnold abstained. 10. ! William Hance - Town owned properties. The Commission reviewed a letter from Mr. Hance concernlng the status of the properties and the possibility of transferring them to the Conservation Commission. The Chairman referred the matter to the Land Acquisition Committee. So voted. 11. .Katherine and William Barney - Donation. The Commission voted to accept the donatlon and torward a letter to Mr. and Mrs. Barney expressing its gratitude. There being no further business, the meeting was adjourned at 9:18 PM.
