Arnold, P. Bennett, C. Borchert, G. Burchell, C. Pearl, P. Watne Members absent: A. Silva Called to order: 7:51 PM Location of project: Polpis Road and old Polpis Road Type of project: Dwelling and septic system within 100 feet of a wetlands Present: Randolph Sharp, Robert Leichter Mr, Leichter presented the Commission with breakout calculations requested by the Commission at the previous meeting. The Chairman stated the Dreakout calculations prepared by the Commission differed from Mr. Leichter's figures and based on its figures, the Commission anticipated problemw with the septic system meeting Title V. The Commission asked Mr. Sharp if the building plans had been designed for the house. Mr. Sharp replied that plans had not yet been drawn up. G. Burchell moved to continue the public hearing due to lack of information. The Commission suggested the following information was needed to complete the Noti'Ce: proftle of system amount of fllling of driveway elevatinns of the house and driveway foundati'on plan effect of the trench line on the marsh P. Bennett seconded the motion. So voted, postponed qt 8:?2 pM\ Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Public Hearing - Town Wetlands ByLaw Date; September 22, 1983 Members present: M. Arnold, p, Bennett, C. Borchert, C. Pearl, A. Silva, P. Waine Members absent: A. Silva Called to order: 7:30 PM The Chairman. called to public hearing to order. Mr. Benjamin S. Richmond former Commission member, was present in the audience to answer any questions as he had prepared the modifications and format of the new ByLaw when he was on the Commission. Chairman Borchert read the modifications the ByLaw would have in regards to the State Wetlands Protection Act and explained the addition of three wetlands values protected by the Town ByLaw and not the Wetlands Act, recreation, wetlands scenic views and wildlife. The scope of these values was also explained. A gentlemen in the audience questioned as to whether the 100 foot buffer zone was taken into consideration under the new ByLaw. The Chairman replied in the affirmative. This gentlemen also questioned as to whether the Commsssion . building permits when they were issued. The Chairman replied the Commission did not but if building did occur in a wetlands area concerned citizens usually informed them. The Chairman stated the members would review the site and if more than fifty percent of the plants in the area were of a wetlands type the area would be classified as a wetlands. In addition, the Chairman stated if it was difficult to judge exactly how much of the plants were wetlands, Dr. Wesley Tiffney was called in as a consultant for more expertise. Mr. Richmond addressed the Commission and the audience stating that the modifications basically followed the Wetlands Act regulations before they were amended in April 1983. Mr. Richmond stated the new regulations under the Act were weaker than the previous regulations and the ByLaw. for the Town gave the Commission the authority they had under the previous Act. There being no further discussion, the' hearing was closed at 7:50 PM. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 September 22, 1983 The regular meeting of the Nantucket Conservation Commission was called to order at 8:03 PM. Members present were: M. Arnold, P. Bennett, C. Borchert, G. Burchell, C. Pearl and P. Waine. Members absent: A. Silva. 1. . Mr. "Fred Roland - Surfside Sewer beds reve etatin .. Mr. Fred Roland was present as agent or the owner - Town of Nantucket - to discuss the reseeding of the area with the Commission. The Commission and Mr. Roland discussed the method of reseeding with plugs or the alternative of reseeding by hydroseeding. Mr. Roland stated hydroseeding was half the cost compared to reseeding by plugs. C, Borchert stated Mr. Glowacki had a machine that could hydroseed. The method of hydrosed;ng was agreeable to all parties involved. 2. Minutes of the meetin of Au ust 25 and Se tember 8. P. Bennett moved to accept t e mlnutes as typed. Seconded by G. Burchell, P. Watne abstained from voting. All others in favor. So voted. 3, Mr, peter Halverstrom ~ Mioxes Pond area. Mr. Halverstrom addressed the Commission concer~ing access to the beach as existing and as proposed on a plan he distributed to the Commissioners. Mr. Halverstrom described the property in this area and explained a revegetation plan he hoped to implement. G. Burchell stated the Commission would probably be in favor of the revegetation plan but could not limit access on Town property to the townspeople. A field inspection of the area was scheduled with Mr. Halverstrom. 4. Richard Glidden Esquire - Determination. G. Burchell moved to i5sue q Determination checking Item 3 for the property located off Madaket Road, based on the recommendation of the field inspection team. So seconded by P. Waine. All in favor. 5. Requests for Determination. Field inspections were scheduled for a Request for property located on Polpis Road, owner Gilbert J. Heuer and property located on Eel Point Road, owner Elizabeth Sylvia. . 6. Town Counsel - Stock Donation. The letter was read by the Chairman. C. Pearl moved the Commission forward a letter to the Board of Selectmen recommending the gift be accepted and donated to the Conservation Commission Land Acquisition Fund in the form of cash. P. Bennett seconded. All in favor. 7, Theodore Cross ?roperty - Easton Stree~. The Commission reviewed a proposed addition to a dwelling located within 100 feet of the Harbor. A motion was made and seconded to request the owner or applicant to filfa Request for Determination. All in favor. 8. Stanley. Stern - Culvert Installation~ The Chairman read the letter ~regar9ing the install~tion of a culvert for a driveway located on Top Gale Lane. It was voted to place the letter on file. 9. ,Mr. Tom David - Foundation Plan. The Commission reviewed the foundation plan stamped by Robert Epple, P.E, for Notice of Intent SE48-207.- Carl Shulman. The Commission voted the engineered plan was adequate to satisfy the conditions in the Order. All iI, favor. 10, Mr. Robert Kaye - Request for Extension Permit. A motion was made and seconded to issue an Extension Permit for Order of Conditions SE48-22. All in favor. 11. Planning Board - Referral Form~ The Commission reviewed a subdivision for property located on Hooper Farm Road, owner Benjamin Cartwright. G. Burchell moved to forward a letter to the Board stating the property was not subject to the Wetlands Act. Seconded by P. Bennett. All in favor. 12. Board of Selectmen - Warren1s Landing Conservation area. The Commission read a letter concerning the removal of debris from the property. It was voted to appoint the Land Management Committee Chairman - G. Burchell - to oversee the proposed project. All in favor. 13. Cliff Road property. The Commission read the field inspection of the site concerning the filling of a small wetlands without a permit. Pictures of the site taken before and after filling were reviewed by the Commission, The Cha irman read a 1 etter from Mr. and Mrs. Coll etti, owners of the property, concerning the situation sourrounding the filling. M, Arnold moved to forward an Enforcement Order stating the fill should be removed and the site restored to its original condition. Seconded by G. Burchell. So voted. There being no further business, the meeting was adjourned at 9:27 PM.
