Public Hearing for Lee Dunn
Notice of Intent SE48-2l9
Date: February la, 1983
Members present: P. Bennett, C. Borchert, B. Richmond, A. Silva, P. Waine
Members absent: G. Burchell and C. Pearl
Called to order: 8:02 PM
The publ~c hearing was called to order by Chairman C. Borchert. Mr.
John Shugrue was present as agent for the owner.
The Commission read the field inspection report of the site. Mr.
Shugrue informed the Commission the proposed project was for the construction
of two dwellings and septic systems to be located on Lots 908 and 909
respectvvely. The Commission requested Mr. Shugrue forward a letter stating
this.
P. Waine moved to accept the recommendations of the field inspection team
and to issue an Order of Conditions in the regular meeting. P. Bennett seconded
the mot ion.
B. Richmond stated he wished to wait until the meeting of February 27, 1983
to issue an Order as he had been absent from the viewing.and that the Commission
had 21 days after the close of the public hearing to issue an Order. It was
so voted. There was no opposition.
The hearing was closed at 8:17 PM.

The regular meeting of the Nantucket Conservation Commission was called to
order at 7:38 PM by Chairman C. Borchert. Members present: P. Bennett, C. Borchert,
B. Richmond, A. Silva and P. Waine. Members absent: C. Pearl and A. Silva.
1. Mr. William Holdgate - Possible Wetlands Violation. Mr. Holdgate addressed
the Commission concerning clearing and filling activity being performed
off the Madaket Road. The Commission voted to schedule a field inspection
of the site. There was no opposition.
2. Mr. Michael Bachman - New Notice of Intent f~r Neptune Construction Company.
Mr. Bachman submitted a new Notice with revised plans for a proposed dwelling
and septic system to be located on Top Gale Lane. Mr. Bachman also reviewed
a subdivision plan of property located "across. tfie .~ond ;from Jeremy's Pond
on Long Pond B,oad.
3. Minutes of the meeting of January 13, 1983 and January 27, 1983. P. Bennett
moved to accept the minutes of January 13 with the following amendments:
After Item 5, add an additional Item (SB) 4Mr. Pearl brought to the attention
of the Commission that recently a heavy four wheel drive vehicle was stuck out
on the beac~ in ;front of the Southall property. In rescuing said vehicle from
the beacQ several other vehicles were involved and consequently damage was
caused to the dunes and vegetation in the area/' Also .amended was the following:

A. Silva seconded the motion. There was no opposition.
P. Bennett moved to accept the minutes of January 27 with the following
amendment: Change Item 2 - Line 18 to read ... the property was under a
purchase and sale agreement. (replaces lease agreement).
P. Waine seconded the motion. There was no opposition.
P. Waine addressed the Commission concerning the minutes of the meeting and
the Executive Session of December 30, 1982. Mr. Waine stated he had not received
these minutes and questioned whether at the meeting of January 13 if the
minutes of the Executive Session had actually been approved. The Commission voted
to refer the matter to Town Counsel for his opinion. There was no opposition.
4. Recess of regular meeting. The regular meeting was recessed at 8:01 PM in order
to conduct the public hearing for Lee Dunn - Notice of Intent SE48-2l9.
The regular meeting was reconvened at 8:17 PM.

5. Audience to press and public. A representative of Scheaffer and Roland meet with
the Commission concerning two Notices of Intent to be filed by the Town of
Nantucket - one for the reconstruction of the roadway on North Beach Street
to improve the sewer drainage conditions and the second to install a new storm
sewer on Easy Street. There was no opposition.

6. Neptune Construction Company - Notice of Intent SE48-2l3. Chairman C. Borchert
read the field inspection report concerning the relocation of the house on
the plans submitted with the Notice. The Chairman stated no further action
was needed as a new Notice had already been submitted with. the revised location
of the house.
7, Lee Dunn - Noti~e of Intent SE48-2l9. This matter was tabled until the next
regular meeting (see minute;~publ~c hearing).
8. Board of Selectmen - Removal of BUildings at Warr~~ding. The Commission
voted to place the letter on file. There was no opposition.
9. County Commissioners - North Bluff. Chairman Borchert read the letter and the
Commission voted to place it on file. There was no opposition.
10, Hazardous Waste Service Letter. The Commission voted to place the letter on file.
There was no opposition.
11. Town Accountant - Arthur I. Reade Jr. Bill. Chairman Borchert read the letter.
The Commission voted to forward a letter to the Town Accountant stating the
bill would be paid out of Line Item 8 of the 1982/1983 Budget. There was no
oPposition.
L2. Daniel Wheeler - Request to Determine Applicability. A motion was made and
seconded to issue a Determination that the property was not subject to the Act.
There was no oPposition.
3. Town Counsel - Fulling Mill Conservation Area. Charrman Borchert read a letter
from Town Counsel requesting that the vote taken in the Executive Session of
December 30, 1982 be retaken at the next open meeting when all me~bers were
present. The Commission voted to take the next vote when all rr.emoers were present.
There was no oPposition.
~. Plannin Board Referral Form - Paul Cronin Subdivision _ Cato Lane. A motion was
made and seconded that the property was not subject to the Act. There was no
oPPosition.
Merlin Nelson - Dredging of Pond. A motion was made and seconded to forward a
Notice of Intent and a letter referring _ the company of Holdgate and Colletti
as contractors for the proposed work to Mr. Nelson. There was no opposition.
Edward and Barbara Kuhn - Req~est to Determine Applicabilit~.
and seconded to issue a Determination with Item 4 checked.
A motion was made
There was no opposition.
Bills. A motion was made and seconded to pay the following bills: a bill of
$48.00.to Cape Cod Resource Seminars for conference dues and a bill of $60.00
to the Massachusetts Association of Conservation Commissions for annual dues.
There was no opposition.
There being no further business, the meeting was adjourned at 9:00 PM.
