The regular meeting of the Nantucket Conservation COmmission was called to
order at 7:30 PM by Chairman C. Borchert, Members present were: P. Bennett,
C. Borchert, G. Burchell, C. Pearl, B. Richmond and p. Waine. Members absent:
A. Silva.
1. Minutes of the meeting of December 3D, 1982. A motion Was made and seconded to
accept the minutes as typed. There was no oPPosition.
2. Audience to press and public. Mr. Michael Bachman addressed the Commission
concerning the DEQE Conferences to be held in February regarding the new
Wetlends Regulati<ms. The Commission Voted to send Commissioner B. Richmond
to one of the conferences. There was no oPPosition.
3. Neptune Constrnction Company - Notice of Intent SE48-214. Mr. Michael Bachman,
agent for the owner, reviewed the revised plan with the Commission for a dwelling
and sept<csystem tocbe located on Top Gale Lape._ G. Burchell moved to issue
a standard Order of Conditions for the proposeu project. B. Richmond seconded
the motion with the amendment that the standard coastal bank statement and
the standard Title V statement be added to the order. There was no oPPosition.
4. Roy K. Barrett Notice of Intent SE$8-218. Chairman Borchert explained that
due to an OVersight the public hearing had not been advertised and that the
Commissi<m Vote to schedule a field inspection for the proposed dwelling and
Septic system on Western Avenue before the next regularly scheduled meeting.
The Commission reviewed the plans and Voted to hold an inspection of the site.
There was no OPPOsition.
5. Robert E. Campbell Esquire - Order of Conditions SE48-201. Chairman Borchert
read the letter concerning the adjudicatory hearing for Susan B. SOuthall and
the Withdrawal of the abuttors for the adjudicatory hearing. The Commsssion
Voted to place the letter on file. There Was no oPposition.
6. Massachusetts Aeronautic Commission - ENF on Extending Taxiway with Holding Space.
The Commission reviewed the Environmental Notification Form and Voted to hold
a field inspection of the Site. There Was no OPPOSition.

The Commission voted to forward a letter
stating the land had been legally transferred to the Town on January 6, 1982.
There was no opposition.
9~Building Inspector - Hummock Pond. The Commission read a letter from the Building
Inspector concerning a possible violation of the Act. It was voted to hold a
field inspection. There was no opposition.
10, Town Warrant Article - Fulling Mill Conservation Area. Commissioner C. Pearl
addressed the Commissi~n concerning the submission of an Article to fund
the planning and construction of a passive recreation area at the newly acquired
Fulling Mill Conservation Area on Polpis Road. G. Burchell moved to submit
Article requesting the sum of $5,000 for such a prbje~t. The motion was seconded.
There was no opposition.
II, Max~e Schneitzler ~ Poisonous Substances. Ms. Marie Schneitzler addressed the
Commission concerning sUDmitting an Article in the Town Warrant concerned with
the disposal of poisonous substances. Ms. Schneitzler mentioned a conversation
she had had witIi the Health Inspector concerning the removal of weed killer.
The COJDnliss;i:on referred her to the Planning Board and the Health Inspector.
12. Conservation Commission Non-Zoning Bylaw. The Commission reviewed- a copy of
a model bylaw prepared by the Conservation Law Foundation. Mr. Donald Visco
and Mr. John Stackpole from the audience were present to express their support
of such a bylaw. There followed extensive discussion between members of the
audience and the Commission regarding the implications of such a bylaw. P.
Bennett moved to accept the Bylaw and submit it as an Article for the 1983 Town
Warrant subject to further review by the Commission. G. Burchell seconded the
motion. C. Pearl and P. Waine abstained from voting. Commissioners P. Bennett,
G.Burchell, B. Richmond and C. Borchert were in favor. The motion was passed.
l3~ ~t~ls. ^ moti~n was made and seconded to pay the folloWing bills: a bill of
$29.71 from New England Telephone, a bill of $80.00 for the Postmaster, a bill
of $79.44 for copier paper from Whip Copy, a bill of $17.95 for office supplies
from Newton's, and a bill of $10.00 for a conference from the Commonwealth of
Massachusetts, Ther~ was no opposition.
Thar~ being no further business, the meeting was adjourned at 9:25 PM.
