Meeting of July 4th Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 June 20t 1985 The public hearings of the Nantucket Conservation Commission began at 7:40 p.m. Members present were: M. Arnoldt P. Wainet C. pearlt P. Dunwiddiet L. Lesket L. Dunn. Members absent were A. Silva. 1. Public Hearings: A. E. Garrett Bewkes - SE 48-299. Squam Road. John Shugrue was present as the agent for the applicant. The commission discussed the fact that this drive way was the only access to the property and because it did not restrict the water flow they believe thay are exempt from having to do any kind of replication. The agent told the commission that he would not ob~ect to rloing the rpplication. p. Waine moved to rlo~e the hearing. So voted. B. Harve" B. Matthews - sE48-3no - ('\uidnet Road. Michaf~l Bachman was present as the agent for the applicant. The agent asked to have the public hearing continued until July 25th as he has hired a botanist to come and study the area. The commission reminded the agent that they have also asked for a 100 year flood level and a replication plan. C. Paul Dujardin - SE48-301 - Eel Point Road. Jeff Blackwell and Paul Furley were present as the agents for the applicant. A completed Notice of Intent along with revised plans were submitted. P. Dunwiddie noted that the erosion rate for this area is 2.2 ft. per year. The applicant has submitted plans for a hoosethat may be moved when needed. The commission wants~ to have in the Orders of Conditions a clause stating that when the house is movedt the concrete from the foundation must be removed. L. Leske moved to close this hearing. So voted. D. Spinnaker View Trust - SE48-303 and SE48-304. North Beach Street. Glenn Wills was present as the agent for the app~icant. The agent presented a cross section plan showing (1) the location of the catch basin (2) detail of the drainage ditch (3) the fill lines and approx- imate amount of fill to be used and the grading. Brant Point Corporation - SE48-302 - Hulbert Ave. Michael Bachman was present as the agent for the applicant. The agent asked to have this Notice of Intent withdrawn. P. Waine moved to accept this withdrawl. So voted. Mrs. Louise Cutting and Mr. and Mrs. Shawt neighbors un Hulbert Ave. were presentat the public hearing. Louise Cutting submitted evidence of the erosion rate of her property on Hulbert Ave. and the Commission now has that information on file in their office. F. Joseph Teelier - John Shugrue was present as the agent for the applicant. The agent plans to use hay bales with snow fence to protect the wetlands. He also proposes a new sidewalk with a curb. P. Waine moved to contineethe hearing until a file number is issued from DEQE. SO Voted. G. Nantucket By-Laws - The commission feels that the present wording of the Nantucket Wetland By-Laws give to many implied powers to the commission. They feel that they must re-engineer the by-laws so the applicant has set rules to go by. The commission discussed some of their areas of interest and concearn along with members of the audience. The hearing concluded with the commissioners setting up a public hear- ing for July 11th to discuss (1) distance for septic systems and (2) the distance for set backs from coastal banks. The commission also asked to have any other topics of interest in the by-laws to be brought up no later than the next meetingt July 11tht to allow them to schedule public hearings on these topics. The regular meeting of the Nantucket Conservation Commission was called to order at 9:00 p.m. 1. Minutes of June 6t 1985 and June lIt 1985: P. Dunwiddie asked to have June 6ths minutes changed to show that he reported that parts of Harvey B. Matthews lot were covered by 50% wetland vegetation and not all as the minutes of June 6 read. Orders of Conditions a. Spinnaker View Trust - SE48-303 and SE48-304 - The commission issued standard Orders of Conditions for both lots. 3. Planning Board Referrals: a. J. Arnold Teasdale - The commission voted to advise the Planning Board that this area is not subject to the Wetlands Protection Act. b. Walter Glowacki - The commission voted to advise the Planning Board that this area is not subject to the Wetland Protection Act. c. Islander Realty - The commission voted to advise the Planning Board that this area is not subject to the Wetlands Protection Act. d. Robert Coffin - The commission voted to advise', the Planning Board that this area is not subject to the Wetlands Protection Act. e. Alexander Craig - The commission scheduled a field inspection. 4. Correspondence: a. Gilbert Tree Service - a proposal for the removal and burning of logs and slash at Warren's Landing was read and reviewed. C. Pearl moved to advertise for bids in the Inquirer and Mirror. So voted. b. Robert Brown - The Chairman read a letter regarding property on 24 Cliff Road. The committee advised Mr. Brown to submit a request for determination. c. Susan McMaster - The Chairman read a letter declaring the appoint- ment of Nantucket Surveyors as her representative for property at 34 Western Ave. 5. Field Inspections for July 4t 1985 at 4p.m. a. Morgan - Nobadeer Ave. b. Hood - Nobadeer Ave. c. Mosher - Cliff Road d. Fleming - Madaket Road e. Craig - Hulbert Ave. f. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 June 20t 1984 page 4 6. Other Business: a. Richard Snyder - Cohen property Cliff Road. Orders of Conditions say to restore the dune. Commissioners want applicant to bring in sand and replicate and revegitate as needed. Mr Snyder feels that the dune they have created now is a durable dune. The commissioners scheduled a field inspection for Monday to take another look at the work that has been done. b. The regular scheduled meeting of July 4t 1985 was rescheduled for July 11 t 1985 c. Charlie Pearl announced his resignation tonight after serving on the commission for 12 years. The commissioners expressed their gratitude and asked Charlie to be a consultant for the Sconset area as his knowledge in this area will be greatly missed. The meeting was adjourned at 10:00 p.m.
