The public hearings of the Nantucket Conservation Commission began at 7:40 p.m.
Members present were: M. Arnold, L. Leske, P. Dunwiddie, L. Dunn and P. Waine.
Members absent were: C. Pearl and A. Silva.
1. Public Hearings:
A. E. Garrett Bewkes - SE48-299 - Squam Road. At the request of the applicants
agent, John Shugrue, the public hearing was continued until June 20, 1985
B. Harvey B. Matthews - SE48-300 - Quidnet Road. Michael Bachman was present
as the agent for the applicant. An upland figure of 28,619 sq. ft. and
wetland figure of 9,646 sq. ft. were given for this lot totaling 38,265
sq. ft~~~e~ Dunwiddie reported than on his field inspection he found
than the,lot~~ covered by more than 50% wetland vegetation (high bush
blueberry). Mr. John Roe informed the Commission that at sometime
during the year this area floods and the depressions in the area fill and
sit with water in them. At the request of the applicants agent the public
hearing was continued until June 20, 1985 to gather information regarding
the 100 year flood level and to hire a botonist to look at this site.
Mark Arnold wants to see replication and revegitating clauses in any Orders
of Conditions. P. Waine moved to continue this hearing. So voted.
C. Paul Dujardin -SE48-301 - Eel Point Road. The Chairman read a letter from
J. Graham Goldsmith, Architect regarding revisions to the project. At the
request of the applicants agent, Jeff Blackwell, the hearing was continued
until June 20, 1985.
D. Robert M. Kaye - SE48-305 - Top Gale Lane. Michael Bachman was present
as the agent for the applicant. The Chairman read a letter from David
Haines of IEP regarding the surface of the tennis court. The court will
consist of an asphalt layer over a gravel base and sealed with a coat of
acrylic latex. It was reconfirmed that the area is on an upland. P. Waine
moved to close the public hearing. So voted.
E. Spinnaker View Trust - SE48-303 and 304 - North Beach Street - Glenn Wills
was present as the agent for the applicant. P. Waine moved to continue
the hearing until June 20, 1985 to allow the agent to get informantion
about (1) the peak elevation (2) storm water drainage plan and (3) total
amount of fill to be used. So voted.

F. Brant Point Corporation - SE48-302 - Hulbert Ave. Leo Asadorrian was
present as the agent for the applicant. There was much discussion about
protecting the dune located on the site. Neighbors of the lot were
present to voice their concearns about the flood control. The Chairman
read a letter from Louise Cutting who is concearned about flood control.
P. Waine moved to continued this public hearing until June 20, 1985 in
order for the agent to gather information regarding (1) the erosion rate
of the bank (2) the effect the dwelling will have on the dune and (3)
if applicant wants, a revised plan of the footprints of the house. So
voted.
The regular meeting of the Nantucket Conservation Commission was called to order
at 9:00 p.m.
1. Minutes of May 23, 1985:
Lee Dunn asked that the public hearing minutes have more detail in the
future. The minutes were approved by unanimous vote.
2. Orders of Conditions:
a. Long Pond Realty Trust - SE 48 282, SE48-286 thru-293. The commission
voted to set up a Public Meeting for Tuesday June 11, 1985 with
Town Counsel to review the minutes and public hearings regarding this
project, and to discuss writing a denial for these projects or Orders
of Conditions.
There was discussion about how the commission could find a way to
write up Orders of Conditions which would withstand legal challenge.
It was the consensus of the Commission that the applicant had not
submitted any credible data that would allow them to make a judgement
on how many bedrooms and what size septic systems could be safely
placed in this area. All the evidentce to date suggested that this is
a very critical area and the Perkins Jordan study should be used as a
guideline for these applications. The commisssion would like to have
the applicant resubmit the Notices of Intent in order for the applicant
to provide data needed to determine how many bedrooms this area can
support.

b. Robert M. Kaye - SE48-305 - Top Gale Road - P. Waine motioned to issue
an Order of Conditions. The Commission wants the letter regarding the
tennis court surface as part of the plans for the Notice of Intent.
So voted with P. Dunwiddie opposed.
3. Requests for Determinations:
a. Richard Ray - The commission voted to issue a negative determination and
to check number three of the notice statine that the work is within the
Buffer Zone, but will not alter an area subject to the protection under
the Act.
b. Julie Perkins ~ The Commission voted ot issue a negative determination.
P. Dunwiddie opposed this decision. Number three of the Notice was checked
stating that the work is within the Buffer Zone, but will not alter an
area subject to the protection under the Act.
4. Correspondence:
a. The Chairman read a letter from MASSPIRG
5. Other Business:
a. A Committee was formed to meet with Town Counsel to go over the wording
of the Nantucket Wetland By-Laws. The Commission scheduled the first
public hearing regarding the By-Laws for June 20th, 1985.
The meeting was adjourned at 10:25 p.m.
