Warrens Landing -" Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of December 19t1985 The public hearings of December 19t1985 were called to order at 7:30 p.m. Members present were: L. Dunnt M. Arnoldt L. Lesket M.J. Williams. Members absent were: D. Viscot P. Waine and P. Dunwiddie. A. Public Hearings: 1. Harborside Realty Trust - Christman Cottages. L. Leske moved to continue the hearing until DEQE issues a file number. So voted. 2. Carter Cafritz - SE48-343 - Hulbert Ave. Bob Emack was present as the agent. P. Dunwiddie and L. Leske have not viewed the site or reviewed Stuart Steele file. Emack would like the commission to move on this hearing tonight. Stuart Steele - 4' wide stairway - final foundation plan - no coastal structures - no impeding dune movement Orders require final plan to be submitted to the commission before construction begins. House has begun but the commission has not received plans! Mark: The impact of the new house will not change existing conditions. Piling foundation will actually improve sand movement relative to existing full block foundation. The boardwalk on sand is to be replaced which is better than no walk at all as blowout problems from foot traffic. There will be a minimum disturbance to the dune with hay bales and fencing being used. Lee Dunn moved to close the hearing. So voted. 3. Leonard Sherman - SE48-335 - Squam Road. The public hearing was continued for a field inspection with John Shugrue. 4. Robert McGrath - West Miacomet Road. John Shugrue was present as the agent. Three areas of concearn were discussed. 1. If the Planning Board allows 16ft. wide then 200 sq. ft. of bordering wetlands are to be filled. If they allow 12 ft. then no wetlands to be filled. 2. If 16 ft. widet then 100 sq. ft. of wetlands to be filledt also 800 sq. ft. below bank to be partially filled. If 12 ft. wide then 30 sq. ft. of wetlands and 360 sq. ft. of bordering Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 wetland to be filled. 3. If 16 ft. wide then no wetland to be filled and 360 sq. ft. of bordering wetland to be filled. If 12 ft. then about 100 sq. i't. Even at 16 ft. widet still less than 500 sq. ft. to be filled and if the Planning Board allows 12ft. even less will be filled. Lee Dunn moved to continue the hearing so the applicant could talk to the planning Board about the critical places and allowing a 12 ft. width. Peter and Lucy are to check the delineation with Mr. Shugrue and Mark will speak to the Planning Board. The replacement area is not available to the applicant. B. Regular Meeting: 1. The minutes of December 5t 1985 were approved. 2. Requests for Determinations: a. Robert Garrabrant - Madaket Harbor. The field inspection report notes that the building is back from the buffer zone. A letter is to be sent stating that anything within 100 ft on the plan requires a filing of a Notice of Intent. The commission issued a positive determination stating the the area is an area subject to protection under the act. Thereforet any removingt fillingt dredging or altering of that area requires the filing of a Notice of Intent. b. Harborview Shopkeepers - South Water St't Oak St. South Beach St. Construction for new shop located away from water. L. Leske moved that the project is not significant. A negative determination will be signed at the next meeting as there was no form in file. 3. Extention Permits a. Dennis Shapirot SE48-239. Tristrams Ave. L. Leske moved to issue an extention for three years on this project which has not been started. 4. Orders of Conditions a. Carter Cafritz - Hulbert Ave.SE48-343. L. Leske moved to issue Orders of Conditions modeled after Stuart Steeles Orders from file number SE48-273. So voted. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 5. Correspondence- All correspondence on December 19t 1985 Agenda was read. 6. Other Business a. Nantucket By-Laws - L. Dunn and M. Arnold postponed discussion until after Christmas. b. Warrens Landing - L. Dunn dropped a note to Bruce Wattst no response as yet. The meeting was adjourned at 8:40 p.m.
