Minutes of December 5, 1985
The public hearings of December 5, 1985 were called to order at 7:30 p.m.
Members present were: M. Arnold, L. Dunn, D. Visco, L. Leske, P. Waine and
P. Dunwiddie. Members absent were M.J. Williams.
A. Public Hearings:
1. Leonard Sherman. SE48-335 - Squam Road. At the request of the applicants
agent, John Shugrue, the public hearing was continued until December 19,
1985 so that a field inspection could be done.
2. Harborside Realty Trust - The applicant submitted plans for a proposed
stairway. P. Waine moved to continue the hearing until a file number is
issued by DEQE. SO voted.
3. Marion Morton - SE48-341 - Wauwinet. Glenn Wills was present as the agent.
Stan Humphries from IEP was present and reconfirmed his concern about
the project being considered as a primary dune and the need to protect
this. Wes Tiffany was also present and talked about the area being a
primary dune and the affect that wind transported sand will have on the
area. New plans for a winding drive way were presented. The square
footage of the parking area of the drive is approximately 450 sq. ft.
With the revised plan only one tree will be removed and the area along
the edge of the drive will be revegitated. P. Waine moved to close the
hearing. So voted.
4. Danielle DeBenedictus - SE48-340 - Sesachacha Pond Road. Glenn Wills
was present as the agent. The project calls for a temporary access
to get building materials to the site. M. Arnold noted that DEQE advised
the commission that this area is classified as a coastal bank and is
significant to the interest of flooding. The area is not a source of
sedement for the beach. The Bank is designated a Zone C and the house is
located in both a Band C Zone. Mr. and Mrs. Dick Denby were present and
voiced their concearn about the temporary road being flooded and creating
a mess. The applicant said that a snow fence and berm would prevent that
from happening. P. Waine moved to close the hearing. So voted.
5. Carter Cafritz - Hulbert Ave. Bob Emack was present as the agent. The

project is the demolition of an existing dwelling and the building of
a slightly larger dwelling to be located on the same spot. Mr. Emack
feels that the applicant meets all the performance standards to protect
the area. Letters from Edgar A. Anderson and Margaret Schoff, neighbors
of the applicant, were read. They voiced their concerns about the
zoning of this project. L. Leske moved to continue the hearing so that
the commission could hold a field inspection and review the Orders of
Conditions for Stuart Steele. So voted.
6. Robert McGrath - John Shugru was present as the agent. The hearing
was continued so that the agent could mark the edge of the vegetated
wetland and present detailed square footage of fill needed for the
project. A field inspection was scheduled for Monday, December 16, 1985.
B. Regular Meeting:
1. The minutes of November 21, 1985 are amended as follows:
a. Carl Jelleme - SE48-338 should read: The commission requested that
the tennis court be moved back another ten feet from the wetland.
b. Harborside Realty Trust - Was continued for the issuance of a file
number from DEQE.
c. Marion Morton - SE48-341. The Commission requested a new plan for the
driveway to maximize the stabalization of the primary dune located on
the site. The commission felt that a winding drive would minimize the
impact on the area.
2. Requests for Determinations:
a. Barbara Jenkins - Wamasquid Rd. The chairman read the field inspection
report. L. Dunn moved to issue a negative determination. So voted.
b. Stephen Lindsay - Madaket Rd. The chairman read the field inspection
report. L. Dunn moved to issue a negative determination as long as
the house is placed on the lot as plans show. So voted.
3. Orders of Conditions:
a. Marion Morton - SE48-341. P. Waine moved to issue a standard Order
of Conditions on the revised driveway plan. So voted.

b. Danielle DeBenedictus - SE48-340. P. Waine moved to issue an Order
of Conditions stating that (1) an asphalt berm be used for runoff
from the proposed temporary access road and (2) The temporary road
shall be open no longer than two months after the commencement of
construction unless a formal request for an extention is brought
bef6re the commission for review. So voted.
4. Certificates of Compliance:
a. Florence Clifford - SE48-189. Top Gale Lane. The field inspection
team noted that all work had been completed satisfactorly. P. Waine
moved to issue a Certificate of Compliance. So voted.
b. Sherburn Associates - SE48-277, AlIens Way. The field inspection team
noted that the gutters and downspouts were not installed as Order
of Conditions allowed and house number 8 was approximately four feet
closer to the pond than plans had shown. The commission voted to
have the chairman draft a letter to the applicant asking for an as
built set of plans for the project and explaining that a certificate
of Compliance can not be issued until all work is completed satisfactorly.
c. Joseph Dubarry - SE48-214. Hulbert Ave. Mike Bachman was present as
the agent. The applicant is selling the property and only part of the
project is completed. The applicant requested that the commission
issue a Certificate of Compliance-for the part of the project completed
and the new owner will file a new Notice of Intent for the remaining
part of the project which will be completed in one years time. The
agent suggested that a bond of the sum of $10,000 be put in escrow by
the buyer to assure the completion of the project. The commission
asked that the agent have an attorney draw up a legal agreement of
this nature. P. Waine moved to issue a Certificate of Compliance on
the bulkhead. So voted.
5. Other Business
a. Mrs. Philip Thomas - Michael Ferrone SE48-266. A letter from Mrs.
Thomas was read requesting an expansion of her septic system. D. Visco
moved that this was not a significant change and therefor a refiling
of a Notice of Intent is not required. So voted.

b. The commission voted to approve payment of a bill from MACC for
publications received.
c. Nantucket By-Laws - The Commission expressed their concerns for a
need of a consultant to gather needed information that would allow
them to make suggestions for a revised Local By-Law. L. Dunn and
M. Arnold agreed to meet to discuss a proposal of goals and objectives
for the commission.
d. Warrens Landing - The chairman requested that the Warren's Landing
Committee take the responsibility of writing a letter to Bruce
Watts requesting atime when the work would be done. The committee
agreed to do this.
There being no further business the Commission adjourned at 10:30 p.m.
