Minutes of November 7, 1985
The public hearings of November 7, 1985 began at 7:30 p.m. Members present
were: M. Arnold, M.J. Williams, L. Dunn, L. Leske, P. Dunwiddie, D. Visco.
Members absent were: P. Waine.
A. Public Hearings:
1. Austin Farm Realty Trust - SE48-336. Hummock Pond Road. The consensus
of the commission was that after looking at the whole site:::the:"road--was
in a good location. L. Leske moved to close the hearing. M.J. Williams
abstained. So voted.
2. Elizabeth McIlvain - SE48-332. John Shugrue and Theodore Tillotson were
present as agents for the applicant. The chairman read superceeding Orders
of Conditions from DEQE regarding the previous filing SE48-279. Mr.
Tillotson requested the commission to issue new Orders of Conditions for
the three bedroom house, having it subject to the same conditions set by
DEQE for the five bedroom house file number SE48-279. P. Dunwiddie expressed
his concearn with the scenic views, which the Nantucket By-Law requires
the commission to protect. L. Leske moved to close the hearing. L. Dunn
and M.J. Williams abstained. So voted.
3. Leonard Sherman - SE48-335. At the request of the applicant, the public
hearing was continued until November 21, 1985
4. Mike Omara - SE48-337. Polpis Road. The field inspection report noted that
the work was in an area that would not have an adverse effect on the
wetlands. P. Dunwiddie moved to close the hearing. M.J; Williams abstained.
So voted.
5. Marion Morton - SE48- at the request of the applicant the abbreviated
Notice of Intent was withdrawn and a new Notice of Intent has been filed
with the Commission. That public hearing will be November 21, 1985.
6. Long Pond Realty Trust - SE48-321. The project is a three bedroom house
on a corner lot. The septic system is located out of the 100' Buffer Zone.
Only the house is located in the Buffer Zone and is located approximately
25' from the wetland. L. Leske moved to close the hearing. M.J. Williams
abstained. So voted.

7. Carl Jelleme - SE48-338. The commission asked the agent, John Shugrue,
to flag the edge of the wetland and stake the outside limits of the
house and tennis courts. L. Dunn moved to continue the hearing for a
field inspection. M.J. Williams abstained. So voted.
8. James Cabral - SE48-339. Pond View Drive. Robert Emack was present as
the agent. The project is located within the 100' Buffer Zone, approx-
imatly 20' from a vegetated wetland. The ditch will be 6" wide and done
with a ditch-witch. Backfilling will be done each night. L. Leske moved
to contiuned for a field inspection. So voted.
B. Regular Meeting:
1. The minutes of October 17, 1985 were approved by unanimous vote.
2. Orders of Conditions:
a. Elizabeth McIlvain - SE48-332. L. Leske motioned to issue Orders of
Conditions set by DEQE for file number SE48-279, and adding three
additional conditions. (1) to limit the impact on scenic views the
applicant will leave all live trees between the house and the wetland
unless they have prior written consent from the Nantucket Conservation
Commission to remove them. (2) The project shall not restrict the
recreational access to the pond. (3) Haybales shall be used during the
construction to protect the wetland. L. Dunn and M.J. Williams abstained.
So voted.
b. Austin Farm Realty Trust - SE48-336. The commission voted to issue
Standard Orders of Conditions. M.J. Williams abstained. So voted.
c. Long Pond Realty Trust - SE48-321. The commission voted to issue Standard
Orders of Conditions. M.J. Williams abstained. So voted.
d. Mike Omara - SE48-337. D. Visco motioned to issue standard Orders of
Conditions. M.J. Williams abstained. So voted.

3. Request for Determination
a. Edward Strojny - D. Visco moved to issue a negative determination
stating that the area is not subject to protection under the Act.
M.J. Williams abstained. So voted.
b. Design Associates - 18 Crows Nest Road. The commission voted to issue
a negative determination stating that the work described is within
the Buffer Zone, as defined in the regulations but will not alter an
area subject to protection under the Act. Therefore, said work does
not require the filing of a Notice of Intent. M.J. Williams abstained.
4. Other Business
a. The commission voted to discontinue the use of Conservation funds for
the feeding of ducks at Con sue Springs.
b. A field inspection was scheduled to look into the dumping of fill on
Al Silva's property on N. Liberty Street.
L. Dunn moved to adjourn the meeting at 9:30 p.m. So voted.
