Other Business Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of October 17, 1985 The public hearings of October 17, 1985 began at 7:30 p.m. Members present were: M. Arnold, L. Leske, L. Dunn, D. Visco, P. Waine and P. Dunwiddie. A. Public Hearings: 1. Austin Farm Realty Trust - SE48-336. Mike Bachman was present as the agent. New plans were subrnitted showing where work was to be done in the original Orders of Conditions and the area where the new Notice of Intent shows retention area and road changes. Mr. John Roe has asked that pipes be used instead of a large retention area. The Planning Boards engineers are looking into that proposal now. If they accept it there will be a lot less area disturbed by work. P. Dunwiddie moved to continue the hearing SOl that another field inspection could be done. So voted. 2. Michael Kane - SE48-333. The commission would like to see the material taken from the top of the area exavated for the pond used to revegitate around the edge of the pond. The fill taken out will not be stock piled. P. Dunwiddie moved to close the hearing. So voted. 3. Elizabeth McIlvain - SE48-332. John Shugrue was present as the agent. The new application is for a three bedroom house. The septic system has been moved 10 to 15' further from the wetland. The house is approximately 55' from the pond. There will be approximately 800 yards of fill used. L. Leske moved to continue the hearing for a field inspection and for Mr. Shugrue to correct his septic/well seperation. So voted. 4. Leonard Sherman - SE48-335. John Shugrue was present as the agent. The applicant wants to put in a 12' wide driveway with a 12" culvert 75' long. Approximately 350 yards of fill will be used. The drive will go over intermittent streams. L. Dunn moved to continue the hearing so that Mr. Shugrue can get the area brush cut for a field inspection. So voted. 5. Mike Omara - SE48-337. John Shugrue was present as the agent. The appli- cant would like to build a house with septic system with light grading on Polpis Road. P. Waine moved to continue the hearing for a field inspection. Long Pond Realty Trust - SE48-321, 323-330. At the request of the applicant P. Waine moved to continue the hearing. So voted. 7. Martin Levine - SE48-334. The commission was waiting for a DEQE file number. That being issued P. Waine moved to close the hearing. So voted. B. Regular Meeting: 1. The minutes of October 3, 1985 were approved by unanimous vote. 2. Orders of Conditions a. Miacomet Pond - SE48-313. L. Leske moved to approve the opening of the pond only when the level of the pond is reaching Miacomet Road. P. Waine seconded the motion to open. D. Visco opposed having any conditions of when to open. P. Dunwiddie and L. Dunn opposed to opening. The motion to allow the pond to be opened was denied. b. Hummock Pond - SE48-318. P. Waine moved to approve the opening. P. Dunwiddie moved to deny the opening. L. Dunn seconded the motion to deny the opening. The notice does not adequately address the issues of fisheries management or salt water intrusion in surrounding wells. No alternatives were considered to address the flooding issue or the erosion issue. D. Visco and P. Waine opposed the motion to deny the opening. The motion to deny the pond opening was approved. c. Sesachacha Pond - SE48-317. L. Leske moved to deny the opening based on the Perkins Jordan study that shows that opening the pond allows for salt water intrusion into surrounding wells and lowering the pond lowers the ground water elevations which increases the salinity in wells. The Notice of Intent does not adequately address fisheries management and alternatives to dealing with the flooding issue. L. Dunn seconded the motion to deny the opening. D. Visco opposed. The motion to deny the opening of the pond was approved. d. Martin Levine - SE48-334. L. Dunn moved to issue a standard Order of Conditions. So voted. Leske moved to issue Orders of Conditions stating that he use organic soils for the upgrading of the pond. So voted. f. Woodbury Realty Trust - SE48-312. Orders of Conditions were discussed. P. Dunwiddie submitted additional conditions and modifications to the proposed Orders of Conditions. The commission voted to require a $20,000 bond to insure the performance of the plans for the revegita- tion and construction of the compensatory wetland and second to guarantee the performance of the drainage calculations and related engineering work within the wetland areas of the project. The term of the bond shall run from the date of the beginning of construction until the Commission issues the Certificate of Compliance. 3. Requests for Determination a. Gustave Rathe - Hummock Pond. L. Dunn motioned to issue a determination that the area is subject to protection under the act and a Notice of Intent is required. So voted. b. Allan LaFrance - Quidnet Road. L. Dunn rnotioned that the work is within the buffer zone, but will not alter an area subject to pro- tection under the act. Therefore said work does not require the filing of a Notice of Intent. So voted. 4. Audience to Press in Public a. Mr. John M. Greenleaf's letter of October 13, 1985 regarding a portable building of Indian Summer Sports was read. Mr. Greenleaf would like the building removed. The commission advised Mr. Greenleaf to bring his complaint to the Board of Selectman as they are the people who granted Chris Emory permission to leave his building up. 5. Planning Board Referral a. Myles Reis - Appleton Road. L. Leske motioned to send a leter to the Planning Board stating that the proposed subdivision is not subject to protection under the Wetlands Act. There being no further business the meeting was adjourned at 11:00 and the next meeting was rescheduled for November 7, 1985
