Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of September 5, 1985 page 1 The public hearings of September 5, 1985 began at 7:30 p.m. Members present were: M. Arnold, P. Dunwiddie, L. Leske, P. Waine, D. Visco. Members absent were: L. Dunn. A. Public Hearings 1. Sesachacha Pond - SE48-317 - Mr. Donald Oliver of the Pond Opening Committee was not present. Through other members of the opening committee he asked that the hearing be postponed. The chairman said he would not postpon~ but take testimony from the audience and continue the hearing. John Roe- reviewed his submitted paper "Sesachacha Pond Opening, Issue Review and Notice of Intent Critique." John Shey - an attorney for Mrs. Rosemary Evans, property owner where the cut is proposed, gave testimony on why the pond should not be opened. These are all outlined in a letter from Mr. Shey dated Sept. 17,85. Arnold - brought up Mr. Visco's belief that the Commonwealth of Mass. does not have any rights to the Ponds of Nantucket due to an Act of 1693. Only the Proprietors of Nantucket have rights to Ponds and to two rods around the ponds. Shey - disagreed with Mr. Visco saying that Chapter 131 Section 4 does give the state to regulate activities in the ponds. (See page 8 of letter dated Sept. 17, 85 from Shey.) Richard How - Vice president of the Quidnet-Squam Association. the associations concearn with the wells in the area with high William S. Pettit- The chairman read a letter from Mr. Pettit the salt content in the wells of Quidnet. L. Leske - moved to continue the hearing. So voted. Expressed salt content. concearning 2. Hummock Pond - SE48-318 John Roe -reviewed his submitted paper "Opening Hummock Pond: Issue Review and Notice of Intent Critique. Visco - There is salt water intrusion allover the island. Roe - The wells that have salt intrusion are also happening well inland. Dunnwiddie - Questioned the flooding of Millbrook Rd. Meridith Bernard - expressed her concearn with the erosion that would happen with the cut. Waine - moved to continue the hearing. So voted. Clark Cove - SE48-316 Roe - summarized his submitted paper: Pond Opening: Review of the Notice of Intent for Olarks Cove, Reed, Squam, and Miacomet Ponds. Leske - moved to close the hearing. D. Visco abstained, P. Waine opposed. So voted. 4. Miacomet Pond - SE48-313 Roe - summarized his submitted paper. Waine - moved to continue the hearing. So voted. 5. Squam Pond - SE48-314 Roe - summarized his submitted paper. L. Leske - moved to close the hearing. D. Visco abstained. So voted. 6. Reed Pond - SE48-315 Roe - summarized his submitted paper. Dunwiddie - landowners around the pond expressed their support for opening to Mr. Dunwiddie but have not showed up for any of the three meetings. Leske - moved to close the hearing. D. Visco abstained. So voted. 7. Woodbury Realty Trust - SE48-312 - Revised drainage plans were presented. Robert Daylor was present as the agent. Daylor - an easment to Lily Pond was found. The town and the developer have mutual benefits in using this easment for a new outlet. With the new system: (1) abandon existing drain that flows under the grange and (2) eleminated all storm water discharges. This cuts the five year storm basis in half to 17 cubic feet. In the 100 year storm basis peak rates are cut in third. We have improved the hydrolics of the new drain, instead of a ten inch clay pipe, a new 18 inch drain is in its place. Everything else remains the same. Daylor - the effects on the four wetlands are: (1) Brush Road wetland will be unaltered. (2) Wetland number four is unchanged. (3) the small grassy wetland could see long-term reductions in the flows to it. The previous plan had a discharge into it. The wetland is now 5400 sq. ft. Can't tell what the alteration will be. (4) The Fertell property wetland : Have Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Sept. 5, 85 page 3 removed part of the watershed,to maintain the wetland characters they have provided a four inch pipe through the dyke. That will deliver a discharge of one CFS. Tend toward maintaining wetland but can't say they would be exactly the same characteristics. They would see a substantial reduction of flooding and storm damage reduction. Leske - What are the existing discharges to the Fertell wetland? Daylor - The five year storm sees twelve cfs. and the 100 year sees 23 cfs. With the four inch drain they will see one cfs. There is a substantial reduction of the discharges. Leske - Why do you need to reduce the flows? DaYfor - There was a concearn of the viability of the old drain. It was in response to the DPW and Planning Boards concearns about the old drains. Arnold - How large is the area to be excavated to put in the dyke? Daylor - 1500 sq. ft. of wetland. Waine - Is the drain under the grange functioning today? Daylor - yes, the rate of flow is 23 cu. ft. plus 12 cu. ft. per second. The change will be 17 cu. ft. The discharge will be cut in half. Waine - So the total rate of water into Lily Pond is less because it is draining slower? Daylor - yes, it is cut in half. There was always a reduction of flows in previous plans but it wasn't as large of a reduction. Arnold - Is there a guarantee that the proposed vegetation will survive in the types of soil that will be used to replicate the wetlands. Daylor - There is no reason why they wouldn't Shey - spoke on behalf of John Brock, Mr. Ernce and other abbuttersto the proposed sites. Shey feels the commission needs to ask"what is the base flow, and is the proposed flow sufficient water budget to support the wetlands?". Who did the wildlife observations and where did they get the list of species that may use the area? Would like the commission to have some kind of monitoring and conservation restrictions or bond to ensure the work is done as proposed and to assure that the wetland is replicated and maintained. Daylor - In response to the water budget - A four inch pipe was choosen as that is the amount of water seen in the ditch. Have not changed any water flows except the storm water discharge. There is a conservation restriction on the project that allows for monitoring, they have been submitted to the commission. A site specific survey was done by Dennis Lowry of IEP. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Sept. 5, 85 page 4 Dunwiddie - Do we have jurisdiction under our Local By-Law to protect wildlife who use adjacent land to wetlands? Arnold - Not outside the 100 ft buffer zone. Visco - Up until a few years ago those fields were all mowed and the hay bundled. The area is used by wildlife but not a significant area. Waine - Moved to close the hearing. So voted. 8. Lars O. Soderberg - SE48320 - Waine moved to continued the hearing to allow DEQE to issue a file number. So voted. 9. Dexter D. Coffin - The hearing was continued and a field inspection scheduled for Monday September 9, 85. 10. Dr. Linden H. White Jr. - SE48-319 - Waine moved to close the hearing as the field inspection report indicated to allow the project as planned. So. Voted. B. Regular Meeting 1. The minutes of August 22, 1985 were approved by unanimous vote after changing the name of Andrew to Wise. 2. Requests for Determination a. Islander Realty Trust - A field inspection was scheduled for Monday the 9th b. Andrew Leddy - A field inspection was scheduled for Monday the 9th. c. Robert Dorr Jr. - A field inspection was scheduled for Monday the 9th. 3. Extention Permits: a. Andrea Dodds - SE48-148 - The last extention issued was not due to be up until July of 1986. The commission advised that they apply for another extention closer to that time. 4. Certificates of Compliance - a. Cohen - SE48-240 - The commission voted to write new Orders of Conditions at the next meeting. Sanford - SE48-178 - A field inspection was scheduled for Monday the 9th. d. Glidden - SE48-81 - A field inspection was scheduled for Monday the 9th. 5. Audience to the Public: a. John Roe gave testimony that the ground water levels given by Richard Kotalac SE48-310 were wrong. The commission would like Mr. Kotalac to amend his Notice of Intent with the correct ground water levels. 6. Correspondence a. The chairman read letter from E.C. Jordan concearning Long Pond Realty Trust geohydrologic Analysis. b. The chairman read a letter from Marie C. Schnetzler consearning Dionis erosion. c. The chairman read a letter from Laura M. Worth expressing her concearns with the Woodbury Lane Development. The meeting adjourned at 11:00 p.m.
