Audience to the public . -, Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of August 22, 1985 The public hearings of the Nantucket Conservation Commission began at 7:30 p.m. Members present were: M. Arnold, L. Dunn, P. Waine, L. Leske, D. Visco, P. Dunwiddie. A. Public Hearings: 1. Sesachacha Pond - SE48-317. The chairman read the Notice of Intent. The opening is to be done to enhance marine fisheries and to prevent the flooding of three private dwellings. Mr. Holdgate - was present and sRid that he has participated in pond openings in the past and feels that there has never been anything detrimental done to the area as a result of the openings. Rosemary Evans - expressed her concearn of the tremendous amount of erosion to the dunes as a result of openings. Holdgate - the opening has been gradually moved to the North which has caused the erosion. Dunwiddie - understood that it was moved to the north because of the hardpan in the south, sand fills in the area that was opened and if the opening was done in the same location each time the force of water into the pond decreases. Visco- believes that the Commonwealth of Massachusetts does not have any rights to the ponds of Nantucket. In 1693 the Board of Selectman were given all rights to the Ponds. Mr. Holdgate - in order to enhance the fisheries the openings must occur in the spring and again in the fall. Waine - moved to continue the pond hearings until September 5, 1985 at the request of the Pond Opening Committee so that Mr. Oliver could be present. So voted. B. Regular Meeting: 1. The minutes of August 8, 1985 were approved by unanimous vote. 2. Requests for Determinations: a. Woodbury Lane Realty Trust - SE48-312 - The chairman read a letter from Susan Howard requesting a reopening of the hear- ings as new information is to be submitted. Dunwiddie - asked that the applicant review the proposed revegitation plan as two of the proposed species do not grow there now. He would like to see the applicant grow what is there now if possible. Visco - moved to reopen and readvertise the public hearing. So voted. 4. Audience to the Public: a. Dr. Lockland and Dr. Getlaw, summer residents in the Miacomet Pond area, expressed their disapproval of Richard Kotalac building on Highland Street, SE48-310. The chairman noted that the appeal period was up. 5. Correspondence: All correspondence on the agenda was read by the chairman. P. Dunwiddie took the Diones Dunes Critical Area plan home to review and answer by September 2, 85 as requested. 6. Other Business: a. Cohen - SE48-240 - Richard Snyder and Ken Dias were present as representatives. The commission asked to have a snow fence built at 14 ft. elevation to allow the build up of the dune and as a way of measuring forreview in a year. The commission asked that plans of the new walk way be submitted by September 5, 1985. A field inspection was scheduled for Monday, August 26, 1985. Mr. Stephen Andrew - a neighbor of the Cohens was present with pictures of the Cohen property in the past. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 August 22,85 page 3 Patricia Wright - a neighbor of the Cohens who has a right of way to the beach by Cohens property,was present to express her consearn of the erosion taking place. b. Austin Farm - Mr. Bachman informed the Commission that the Planning Board has asked for revised road plans. Orders of Conditions have been issued on the previous road plan. The Commission asked that the new plans be submitted to the Commission so that they may be attached to the Orders of Conditions. The meeting was adjourned at 10:30 p.m.
