Cohen Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 Minutes of August 8, 1985 The public hearings of the Nantucket Conservation Commission began at 7:30 p.m. Members present were: M. Arnold, L. Dunn, D. Visco, L. Leske, P. Waine and P. Dunwiddie. 1. Public Hearings: a. Woodbury Lane Realty Trust - SE48-312 - Mr. Daylor presented to the Commission replanting and revegitation plans along with a review of the Notice of. Intent and plans submitted and suggestions for Orders of Conditions. Dunn and Dunwiddie - questioned the statement in the Notice about which wetlands were significant to the prevention of pollution. Daylor - any area that has an inflow or outflow is significant. Leske - concearned about how the proposed restrictions of the use of the land will be enforced. Howard - Homeowners Assoc. will be enforcing restrictions and the Conservation Commission will have the power to enforce. Woodbury Trust is working with the DPW on who will be responsible for any damage to Lily Pond. Leske - How would the Trust feel about a green belt to buffer the Wetland area? Daylor - The grading plan shows that we intend to have natural vegetation, not grass or lawns, around the wetland. Dunwiddie - If Wetland # 4 water table will be lowered one ft.and if the water level does dictate where the wetland -perameter is going to be, how will lowering the water table not change the wetland area, even if you maintain the same amount of water? Daylor - The breakout point remains the same. We are going to the upland area and lowering it one foot. Brock - Who did the wildlife observations and were they site specific observations? Daylor - IEP did the observations and they were site specific. Brock - Who ever did the observations, did not contact any neighbors about animals which use the area seasonally, such as deer. What wildlife will be effected in the buffer zone during construction? What kind of migration will be cut off by roads? Will each house be covered by this Notice or will each get individual conditions? How much vegetated wetland is going to be effected by the construction of the pipes? Visco - Some contractor will be hired to clean them. D. Visco moved to close the hearing. So voted. b. Sesachacha Pond - P. Dunwiddie moved to continue the hearing to allow the applicant time to sign the Notice of Intent and to secure written permission of the land owner, Rosemary Hall Evans, to have the Board of Selectman act as her agent. So voted. c. Hummock Pond - L. Leske moved to continue the hearing to allow the applicant time to sign the Notice of Intent and to secure written permission of the land owner, Julius Jensen III, to have Ethe Board of Selectmen act as his agent. So voted. d. Clark Cove - L. Leske moved to continue the hearing to allow the applicant time to sign the Notice of Intent and to secure written permission of the land owner, Julius Jensen III, to have the Board of Selectmen act as his agent. So voted. e. Miacomet Pond. L. Leske moved to continue the hearing to allow the applicant time to sign the Notice of Intent. So voted. f. Squam Pond - L. Leske moved to continue the hearing to allow the applicant time to sign the Notice of Intent and to secure written permission of the land owner, Nantucket Conservation Foundation to have the Board of Selectmen act as their agent. So voted. g. Reed Pond - L. Leske moved to continue the hearing to allow the applicant time to sign the Notice of Intent and to secure written permission of the land owner, Alice G. DeJonge et aI, to have the Board of Selectmen act as her agent. So voted. 2. Regular Meeting a. Audience to the public Daylor, Howard and Bachman representing Long Pond Realty Trust (files # 282 and SE48-286 - 293). Would like to resubmit applica- tions with seven, three bedroom homes, with permanent restrictions to the balance of these lots. The commission said they would be receptive to a new filing. c. Planning Board Referrals 1. Stone Barn Trust - The commission voted to advise the Planning Board that this area is subject to the Wetlands Protection Act. 2. Gerhard Andlinger - The commission voted to advise the Planning Board that both lots are subject to the Wetlands Protection Act. 3. Austin Farm - The commission voted to to advise the Planning Board that lots 3,4,5,6,18,19,20,21,22,23,24,28,29,30,31,32, and 33 are subject to the Weltands Protection Act. d. Orders of Conditions 1. Susan J. McMaster-Collum - SE48-311 - The Commission voted to issue a standard Order of Condition. L. Leske and D. Visco abstained from voting. 2. Thomas Hood and Joseph Morgan - SE48-309 - The commission voted to issue a standard Order of Conditions. e. Certificate of Compliance - 1. Dunn - SE48-93 - P. Waine moved to issue a Certificate of Compliance. So voted. 2. Dunn - SE48-211 - Only part of the Conditions completed. A Letter from L. Dunn was to be written explaining about the part of the project that was not done. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 f. Extention Permits 1. Dunn SE48-219 - A field inspection was scheduled for Monday August 19, 1985 at 4:00 p.m. g. Correspondence 1. DEQE - Paul Dujardin SE48-301 - appeal about future erosion control. The commission will amend the the Order of Conditions. h. Other Business 1. Cohen - SE48-240 - The commission issued a cease and desist order along with a letter to be written by L. Leske explaining the urgency of this matter being rectified immediately.
