Thomas Shannon - Extention Permit . , Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 July 11, 1985 The public hearings of the Nantucket Conservation Commission began at 7:30 p.m. Members present were: M. Arnold, P. Waine, P. Dunwiddie, D. Visco, L. Leske and L. Dunn. Members absent were: Jeff 1. Public Hearings: a. Joseph Teelier - SE 48-307. DEQE issued a file number which the commission was waiting for. L. Leske moved to close the hearing. So voted. b. Margaret & David Cunningh~m - SE48-306 - Bel Point Rd. John Shugrue was present as the agent. With no further questions about the stairway P. Waine moved to close the hearing. So voted. c. Wayne Mosher - SE48-308- Cliff Rd. Glenn Wills was present as the agent. Wills informed the commission that hay bales will be added along the driveway,along with original plans in the Notice of Intent, to protect the area. L. Leske moved to close the hearing. So voted. d. Hood and Morgan - SE48-309 - Nobadeer Ave. Bob Emack was present as the agent. The commission feels that the joint stairway will reduce erosion. The commission wants in the Orders of Conditions a three foot horizontal seperation from the bank to allow vegetation to grow. P. Waine moved to close the hearing. So voted.' e. Richard Kotalac - Highland Street. The lot is 6,800 sq. ft. The septic system is 100 ft. from the well and the reeds. The house is 40 ft. from the reeds. Kotalac presented plans of which neighboring lots were buildable and which were not. His system was designed to meet Title V. This is in a Buffer Zone which is always dry. The commission wants to see the house moved back 10 ft. from the back line. P. Waine moved to continue the hearing until July 25t 1985 to receive a file number from DEQE. SO voted. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 f. Harvey B. Matthews - SE48-300 - Quidnet Road - Glenn Wills was present as the agent. After viewing the lot again the agent has revised his plans. The house has been reduced from four to two bedrooms and moved away from a grey area of concearn. The well has been moved to the cart path. The lot is in a zone B (100- 500 year fregquency of flooding). Mrs. Holland voiced her concearn about perc tests being done in March during a year of drought. Wills said they allowed a one foot margin when doing the perc test. L. Leske moved to close the hearing. So voted. g. Woodbury Lane Realty Trust - Robert Daylor presented pl~ns for the drainage system for this 25 lot subdivision. Maps were displayed showing the four wetlands that will be effected. Diagrams of the soil layers and relations to ground water were displayed along with proposed drainage systems including (1) a holding dyke (2) underdrains (3) catch basins and (4) in- jection system to divert subsurface water back down into the water table. Mr. Daylor addressed the problem of maintenance of the system saying that a homeowners association was to be established with each owner putting up a sum to be used for the maintenance of the system. Daylor claims the injection system is a simple one with a screen at the top and screen with filtering material at the bottom with a six inch pipe in-between. Anyone experienced with well digging on the island would be able to work on it. There would be no need to call experts. Daylor - all the work on drainage systems, roads, sidewalks for the subdivision will be done befor any homes will be built. Estimates the homes will be built within a five year period. M. Arnold expressed his concearn of a continual impact that digging and building will have to the wetlands of the area. P. Dunwiddie asked if there were any back up plans if the calculations proved to go wrong and the wetland either gets wetter or dryer. Mr. Daylor said they had no such plans but if the area were to get wetter they only thing that could be done would to be to set the system lower. Daylor - Li~y Pond should see all the flows it sees now. We didn't reroute any water. The water may take a different route into the pond but the same flows will end up there. By re-routing we believe we are helping to protect surrounding homes and streets from flooding. The peaks of water flow will be buffered therefor there will be a longer steadier flow. L. Leske - Won't there be a rise of Lily Pond on an average with- out these peaks and lows? Daylor - The differences will not be very great. Mrs. Holland expressed her concearns of the amount of pollution to the water quality with 25 new homes using fertilizers and such being injected into the water. Will it be adequately filtered? Daylor - The quality of water in this area will not be changed as the runoff from the top will not be injected, only ground water will be injected. Mr. Worth expressed his concearn about when the tests and observations were done. Were any done when the pond was full? Tests were done in January and February. Regional water table fluctuated less than a foot. Mr. Worth feels that when Mill Pond is full, conditions are much worse. Basements fill etc. There are springsin the area that have effect on Woodbury subdivision wetness a.ld when Mill pond is drained the spring goes down and area is less wet. He feels that these wetlands should not be disturbed. Don Kurtz a biologist form California expressed his feelings that the folklore and observations of neighbors should be listened to. He has seen water that goes up hill. Regardless of drainage system of area there is going to be some lowering of the water table. A few inches lowering in this sandy soil will make old basements crackt pipes snap. There will be an uneven subsurface water table. No literature has been provided of the square footage of runoff. All calculations seem to be taken from hydrolbgic water study not run off from drivewayst roads, roofs etc. He believes that the runoffs are likely to be greater than said. Dog urine and feces will not filter in the short distance in sand. Arnold - Anyone building in this subdivision must file indivdu~ly showing foundation plans etc. Mrs. Worth does not feel the town drainage system should be overloaded with private subdivision subsurface drainage and then dumped into Lily Pond which is a town park, wildlife refuge. Daylor - We are not changing direction of ground water in any way. So Lily Pond will not be changed by underdrains. Mr. Blair expressed his concearn of the agents not taking the concearns of Lily Pond abutters into consideration. He feels that there are springs in the area that have an effect on the wetness of this area. James Worth concearned with area when subdivision is complete. What is going to happen when heavy rains ? How will they control the 3 to 4 inches of rain when the ground is frozen and water is filling N. Liberty Street. Mr. Daylor - The system is designed to control that flow of water. Sandy Craig has a well that is now in use for the record. John Roe - Questioned the data given on where the ground water divide line actually is. One important well (5) is not giving clear readin.~s. John feels that the line may be wrong and the data given c0uld be keeping out a portion of the actual water shed and more water could be going into the area than agent suggests. Other areas may become dryer. The hearing was continued until July 18, 1985. Town of Nantucket Conservation Commission Town and County Building Nantucket, Massachusetts 02554 The regular meeting of the Nantucket Conservation Commission was called to order at 10:45 p.m. 1. Minutes of June 20, 1985: The minutes were approved by unanimous vote. 2. Orders of Conditions: a. E. Garrett Bewkes - SE48-299. P. Waine moved to issue a standard Order of Conditions. So voted. L. Leske opposed. b. Paul Dujardin - SE48-301 - L. Leske moved to issue Orders of Conditions stating that in the event that this building is moved, all foundation structures shall be removed and the area restored and revegitated. So voted. c. Joseph Teelier - SE48-307 - P. Waine moved to issue a Standard Order of Conditions. So voted. d. David Cunningham - SE48-257 - L. Dunn moved to issue Orders of Conditions stating that the tier for the stairway shall be three feet from the bank. e. Harvey B. Matthews -SE 48-300 - L. Leske moved to issue Orders of Conditions with a clause stating (1) the well shall be placed on the area of the lot known as the cart path and (2) no sub- sequent expansion of the septic system will be allowed. 3. Requests of Determinations: a. George Fleming - Madaket Rd. The commission voted to issue a negative determination and tos check number Qnet stating that the area described in the request is not an area subject to protection under the act. b, Butnell Corporation - The commission voted to issue a negative determination and to~ check number 3, stating that the work described in the request is within the buffer zone but will not alter an area subject to protection of the act. Alexander Craig - L. Leske moved to send two letters to the Planning Board stating (1) the road is not subject to the act and (2) any building on this lot is subject to the act. 5. Extention Permits: a. Thomas Shannon - SE48-138. P. Waine moved to issue a three year extention. So voted.- The meeting adjourned at 11: 30 p.m. and was continued until July 18, 1985. .
